According to VHA Directive 1134 the VA doctor is required to and must complete a DBQ, medical statement, or Nexus letter when requested. It is part of their job description.
I suffred a back injury aboard ship in 1969 and was denied benefits until 2009. I needed back surgery because the pain became unbearable. The VA still gave me a hard time and I had to request a review in which the review officer apologized after looking at my induction medical which didn't show any back problems which the navy claimed it was a congenial back condition. The back surgeon disputed the claim and said he saw old fractures to the pars, this probably occurred when my lower back impacted the catwalk railing as I was given a jet blast boost as I was trying to get off the deck. So the VA is giving me a 20% right leg and a 10% left leg for radiculopahty. Should I be given something for my back and the chronic pain I have not to mention the phripial poly neuropathy and restless leg syndrome I now have?
I was just told, at a C&P Exam and being stopped mid-sentence while describing my back symptoms to the examiner, "lumbar strains can only be muscular in nature and that radiculopathy can’t be a secondary condition to a lumbar strain." Simple question: Is this true? I was surprised because everything I have read seems to suggest that a lumbar strain can be, and is often, a musculoskeletal condition.

This is a great video session, I am rated with back/legs service connected condition I'm, IAM in constant pain, I get shots every 2months in my hip and back for years. I have arthritis all over my back and neck which I have not applied for. Do you handle veterans cases???
I was service connected disabled for a fall on the helicopter 25 years ago. But now I have severe back pain and also sacroiliac issues. But I was denied but I have no record of going to the medic for my back so they denied it.
I broke my right foot in service and it was never taken care of properly in the navy in 1998. I've had knee, hip, and back issues since. I have herniations in my S1, L5 but am not rated for it. Only for my foot 20%, hip 10%. I am always in pain and have been in pain for years but cannot get a dr to help me with writing a statement supporting my condition.
I try and go to the VA every year. When I go to the examiner, they never check anything. They just use whatever notes they have and maybe ask one question. Last examine the examiner said he did not have any updated medical records and would try to get it. I had an MRI done on both ankles and I complained about my lower back and left side of my neck. Months later nothing changed with my rating.
Thanks for the info. Sometimes the provider can't finish their notes right away that day due to seeing so many patients in one day (follow up appt usually takes just 30min. New pt is allotted at least 1 hr.). Some provider do their notes on weekends when they're off to catch up with charting. I work with them and I'm a patient too. I often don't see my notes as a patient for days to weeks.
Interesting that they rate amount of movement. Do they take into account the fact that I have to pay a yoga instructor to help me maintain flexibility? Granted, I'm not incredibly flexible, but also I'm not as inflexible as some either. I have been doing yoga for 20 years and still can't do asanas like the instructor.
I'm currently filling for additional compensation and one filing was for chronic pain in my back and ankle. My DAV rep is telling me there is no filing for this and I'd have to declare it at my c&p exam to have them recognize it. Is this true, or have I picked the wrong organization to represent me. I had the vfw do it for me last time and that also went unproductive.

I was exposed to Asbestos while in the air force, this is documented in my service medical records, I was just diagnosed with Pancreatic Cancer. I had a back injury while in the service and have 40 %, My back pain has also caused me to gain weight and was diagnosed with sleep apnea. Can someone from your office help me with my appeal.
All i know is what i have been through, the first chart only goes up to 40%, chart two starts after that and goes up to what i was never told. The charts should be available online through th VA web site

The exam could go either way; I did my second C& P exam with a TDIU rating of 90 percent total and permanent with both knees... I got a new rating of 100 percent back, 50 percent feet and 10 percent tinitus. My first exam went ten years of back pay. I have five new and material claims currently at the board pressing the argument for date when entitlement occurred forty years ago... You have to know your claim to the core and make a calculated risk for back pay claims of this magnitude... CC& K did have my claim for a minute but dropped it...

So I’m a helicopter mechanic in the Marines and I fell off a helicopter stub wing 4 months ago and I’m in physical therapy and I am coming up on my first limited duty. They are talking about putting me on steroids and I can hardly lift or bend over. Is this something they might medical board me on? Or something that might end my career. What would be the disability rating?
So if the VA goes mainly off ROM are you saying that if a person has had a spinal fusion, cant stand strait that their rating is no different than some who has the same ROM as with just some back pain??

I would suspect ill need multiple surgeries from my service connected injuries, however it will take me out of work for some time. Is this something that is necessary for compensation. Im just trying to understand. I had a spinal fusion, my forward flex was 50, but started to hurt at around 25 or 30. I cant stand strait.....have chronic pain with lots of meds, pain and weakness in legs to point I need a cain to walk...…...the VA wanted to take 20% away just cause they are douche canoes...….im fighting with them now about it. But are you saying with all this im looked at the same as someone who has some pain that cant bend more than 50 forward?? If that's how they rate things there is a serious problem.
I went to DAV last year on April 20th to try to get an upgrade add an illiac condition that said it was bilateral but was only compensated for one of them. I am trying to add the one iliac condition that was not added along with secondary condition with my lower lumbar and arthritis in my spine. I have not been informed what I need to do to get an upgrade. Not even sure who or where to go to. Can you help direct me?

I wish it would be that easy, but I’ve been to plenty of C&P exams. Here in Texas all the C&P examiners seem to be bought out, because I have told the examiners the same problems and they seem not to report it in my case when asked to fill a report on my well being before the exam. I turned in the questioner and told the examiners.

I was stationed at Rhein Main AB, Germany when Chernyonbol blew. The Environmental Health team did soil, air and water samples and said everything was in normal limits even though many farmers were recorded having to kill some of their live stock. Also, a base leaflet was published warning us not to play in standing water or sand. Requiring parents to brush off clothing and to shower when coming indoors(decontamination). Looking at the the spread of the radiation exposure over the European area shows just how wide spread the radiation had spread. It is highly suspect that we were exposed.

I have a 10% rating for lumbar strain and now I have chronic thoracic pain. How difficult would it be to connect the thoracic pain due to me compensating by positional relief for the lumbar strain?

Oh boy! What a joke. I always was reluctant about filling a claim to the VA. Apparently, I was right. Finally I was convinced to go ahead and filled. After so much pain ,and expenses,I have decided to go for it. What a disappointment. The system is set up to deny vets. They were polite, I give them that.
Had lumbar fusion before I got out of the army about 12 years ago, and still have back pain, can't sleep at times can't lay on my back, we're I work I have to stand for long periods of time can I request a C&P exam to have my compensation increase currently get 20%, was a service connected disability. I also still have all medical records from the Army when I got out in 2007

Just had a C&P for a ratings increase and my wife drove me and was present during the exam. I was having a very bad flare up of my back and the rater flat out lied about my forward flexion, I could barely walk that day and could flex forward I would estimate to be 20-25 degrees and she wrote that I flexed to 60 degrees! What to do now?

i got a 40% rating for my back and 20% for r knee and 0% for left knee i have a degeneritive back deseise. i was told i have degeeritive disc desease i have been filing for an increase for 20 years. i have used many different vso's from all the veterans groups but every time i need to appeal a decision they stop calling me back. You can find all your notes from any VA exam after 3 days in your Blue Button report in my healthy vet.

yea I am rated at 40% on my back and 80% total and have been for 2 years, yet they told me I didn't qualify for TDIU...………..

Most C&P exams are posted on the veteran's myhealth under records/blue button anywhere from 3 days to 30 days after the exam.

How often do you have to have flare ups to have it count towards rating?

I have low back pain. It hurts while standing, laying, sitting and walking? I only get relief from bending completely over.

But are you saying with all this im looked at the same as someone who has some pain that cant bend more than 50 forward?? If that's how they rate things there is a serious problem.

I went to DAV last year on April 20th to try to get an upgrade add an illiac condition that said it was bilateral but was only compensated for one of them. I am trying to add the one iliac condition that was not added along with secondary condition with my lower lumbar and arthritis in my spine. I have not been informed what I need to do to get an upgrade. Not even sure who or where to go to. Can you help direct me?

I wish it would be that easy, but I’ve been to plenty of C&P exams. Here in Texas all the C&P examiners seem to be bought out, because I have told the examiners the same problems and they seem not to report it in my case when asked to fill a report on my well being before the exam. I turned in the questioner and told the examiners.

What if lower back didn’t start hurting until after you receive 2 epidural during pregnancy but with last child refused because of the recent pain
If it happen while on active duty then it’s likely to be able to get it service connected.

I was in the hospital for 5 days but it was a civilian surgeon not a VA surgeon. This was back in October 2018.

I was stationed at Rhein Main AB, Germany when Chernyonbol blew. The Environmental Health team did soil, air and water samples and said everything was in normal limits even though many farmers were recorded having to kill some of their live stock. Also, a base leaflet was published warning us not to play in standing water or sand. Requiring parents to brush off clothing and to shower when coming indoors(decontamination). Looking at the the spread of the radiation exposure over the European area shows just how wide spread the radiation had spread. It is highly suspect that we were exposed.

I have a 10% rating for lumbar strain and now I have chronic thoracic pain. How difficult would it be to connect the thoracic pain due to me compensating by positional relief for the lumbar strain?
Just a general question? I been going to the VA for backpain and treatment before submitting a VA claim is this helpful. My treatment is being logged into the VA system does this help my case.

Oh boy! What a joke. I always was reluctant about filling a claim to the VA. Apparently, I was right. Finally I was convinced to go ahead and filled. After so much pain ,and expenses,I have decided to go for it. What a disappointment. The system is set up to deny vets. They were polite, I give them that.

Had lumbar fusion before I got out of the army about 12 years ago, and still have back pain, can't sleep at times can't lay on my back, we're I work I have to stand for long periods of time can I request a C&P exam to have my compensation increase currently get 20%, was a service connected disability. I also still have all medical records from the Army when I got out in 2007

Just had a C&P for a ratings increase and my wife drove me and was present during the exam. I was having a very bad flare up of my back and the rater flat out lied about my forward flexion, I could barely walk that day and could flex forward I would estimate to be 20-25 degrees and she wrote that I flexed to 60 degrees! What to do now?
Same thing happen to me. My rater/PA flat out lied on everything. I'm still fighting.

You can have a documented injury and they declare that your problems are do to age !

@John Gilday, thank you for watching. You have the right to request a copy of your C&P exam from your local VA Regional Office after the exam has been completed.

i got a 40% rating for my back and 20% for r knee and 0% for left knee i have a degeneritive back deseise. i was told i have degeeritive disc desease i have been filing for an increase for 20 years. i have used many different vso's from all the veterans groups but every time i need to appeal a decision they stop calling me back. The DAV or any Veteran's Service Officers. But I just want to say that you get what you pay for...
Get a civilian doctor. The military and VA don't take the time or have the training to properly evaluate you. The VA tries very hard to deny you benefits.
