  • The Home Affairs White Paper aims to change the state of Naturalization in its current form. The new policy speaks of one getting an invitation to naturalize if they contribute positively to South Africa in various fields. A minimum investment activity could also get one an invitation to naturalize. No more permanent residence without an invitation.

      The government should and must "Al Capone" all these scoundrels that don't want to leave quietly and go back to their countries.
      There are hundreds upon hundreds of foreigners who have been earning a living from crimes like bank fraud, internet scams, car theft and hijacking, drug dealing, illicit cigarette sales, fake churches, illegal schools, illegal security companies and so on and so forth.
      They have managed to acquire property (movable and immovable) and set up businesses. All these acquisitions are from the proceeds of crime and should be attached by the state. The Asset Forfeiture Unit should move in and get to work.

    Imagine standing in street corners selling powder for ten years, then turn around and say I now deserve citizenship.
    The constitution should be read in the context of its spirit and not just the words (letter), meaning that when it was crafted what was the intent and what was envisaged and what was happening at the time, and what are the unintended consequences. The courts should then eliminate unintended consequences in their judgements.

      The harsh reality is that many Black South Africans find it difficult to accept the truth. It sounds harsh, but when he mentioned coming to South Africa to sell drugs, it's evident that we must acknowledge our role in allowing these issues to persist within our country. If South African police and authorities performed their duties effectively, unjust accusations towards foreigners would diminish. Likewise, if South African parents adequately educate their children, there would be fewer kids engaging with drugs. It's essential to take responsibility and address these underlying issues so they can be thoroughly resolved. They need to reinstate the regulations Malusi Gigaba had put in place when he was the minister. They were meant to protect South African women and children, but they were removed after he stopped being minister there.
    The most import one was that foreigners had to return to their countries to apply for marriage visas at the SA embassy in their own country, if they married South Africans, and even if they found jobs in South Africa they needed to apply for the work permit in their home country… it was a major deterrent.

    Let's not raise the hopes of our people so we don't get frustrated brothers and sisters.
    There is going to be one bill which will include the addition of the President's Vulindlela aspirations and nomadic visas which need SARS input.

Some they decide to remain in the country, but will bring their Nigerian woman to South Africa to enjoy the citizenship the husband would have acquired by using a South African woman.

All this judges against the immigration laws of South Africa.. who is holding them accountable ? - and if they blunder are their decisions revoked and they themselves castigated for wasting tax payers money or do they just get off ? This judges seem to always be on the chaotic and corruption side in SA. Who are this judges and who do they account to ?

    • @OasisSilvaMillion
      @OasisSilvaMillion День тому

      I don't think Judges are to blame. Judges are doing their job which is to interpret the law, how it was written when passed by Parliament is how the law is interpreted. If there is to be any meaningful change, it first has to come from the legislature via ammendments. Judges can't change laws. It's not corruption at all. The law is just being interpreted. The ones failing us are legislators who draft laws with having South africans in the hindsight.

      @desmondqoza123 День тому

      @@OasisSilvaMillion So the law says " South Africa is for all who live in it " then this judges assume that everybody including foreigners. So we must interpret that this law means only South Africans - whites, coloureds, indians and blacks not foreigners

    • @OasisSilvaMillion
      @OasisSilvaMillion День тому

      @desmondqoza123 The law doesn't necessarily state that. Laws on immigration and refugees come into play, the duration of the individuals stay in the country, marital status to a South African and so forth. This case is different with illegal foreigners. But the law allows for a certain degree of "protection" to immigrants and refugees or asylum seekers. As I said the judges can't do anything but interpret the law. If the law had said we should allow all illegal foreigners in the country then the courts would interpret the law in that way. The only way to have meaningful change in the discourse of law is to take it via the legislature, as the new minister is doing. Fighting it in court is meaningless. The Constitution is the highest law in the country so it becomes very tedious Fighting in the courts instead of taking it to parliament for a referendum or amendment to a law

    Are you also aware that many South African women treat these foreigners as slaves, because they are citizens, they treated them, sometimes they call police on them when they have not done anything. There was a South African lady that grinded bottles on the husband food becaus the man has a lot of money and business, eventually, the man died and such cases are never seen on the news. • @matthewdube9237
    @matthewdube9237 День тому +3

    This is good. But point of correction; all laws including the immigration laws must align with the constitution of RSA.
    The Constitution is the supreme law of RSA that's the reason the new minister says they need to look at all aspects of the white paper so that it aligns.
    There is no law in our country that can misalign with the supreme law called the constitution - that's why we can't take land without compensation without amending the constitution.
    That is why the bill can only be tabled before parliament in 2027 after passing the master of the constitution.
    We can't just insert what we want into any law, all must align.
    Without that Home Affairs will be whipped in any litigation and pay huge costs. They have been paying huge costs in lost cases in the past because of not aligning with the constitution hence Section 34 declared unlawful by the CC.
    Just wanted to correct that. But in the main great improvements for our country.
    Thank you bro!
