i feel very unsafe in west now a days due to police or traffic police. they have turned into egoistic agents rather than civil servants who are supposed to work for us. for me my cause of my existence. acouple of weeks back i was returning home on my boke at 2am after a movie with my brother . cinema hall was just 200 mtr away from my house. i took the normal route in which i saw there was cement mixing vehicle and few workers working ahead. there wasnt any barricade so i though maybe they are just fill big pot holes by the side so i was passing by them normally when suddent a police official in uniform asked me to stop. he was drunk which was understandable. he instantly tried to threaten by saying" who asked you to go from here" and was using slangs as well. workers tried to protect us and told us that to go fast from bacl side road and not to talk to officer. i asked my brother to get down as i wasnt able to turn bike . as i was turning bikei saw the officer was threatening my brother " andar dale tumko abhi? dale andar?" my brother is a student in IIT and was home for vacation and i am a CA fianlist. we both will be contributing to the nation and state in future with and perform our duties well. but sich threatening to my brother wasnt acceptable to me i didnt knew what could i do so i immediately asked my brother to get on the bike and i went back home from the back side road. a worker was with me too to ensure police isnt messing with me anymore. this is not the only incident ive faced similar incidents earlierwhere police are simply daba rhe hai kamzor ko and apne se upar walo ke samne doom hila rhe hai. now our first priority is to leave this state and move to place which is safe for u and can have mental peace. signing off from this state soon. i feel you bro this state isnt safe at all anymore and i have 0 respect fr police officisls here

Aftermarket exhaust is illegal unless you have RTO permission.
Doesn't matter if you have paid GST, have you taken RTO permission?
Local people have given petition to Baranagar & Belgharia Police station to take action against Aftermarket Exhausts.
They might sound good to you but it a nuisance for others.

In a certain case when police personnel stop a person pertaining to a loud exhaust there is an essential mechanism which is needed by the traffic police to issue a challan for a loud silencer and that machine is called a decibel meter which precisely measures the sound. So, if police personnel are not possessing any such device, he/she cannot issue a challan to anyone just on the mere suspicion that the sound emitted by the suppressor would be more than 80 decibels.
Any external modification is illegal. So it does not matter if your after market exhaust is making loud sound or not.

As a law student i suggest you make a good decision.Can you legally Action on the Kolkata high court to the Officer. It's not legal to take action after a pay Road tax and Exhaust tax.
So you can easily File a Case to a remote Officer and a Challan Officer.

1. Not even higher rank officers have the right to take the key until the rider has done a serious crime like murder or hit&run sorry to say but yes it is written in Indian law
2. They gave him a fine for not registering the bike to drive on the road after they checked that he does have the registration and all papers were intact
3. There more than 5 police officers and many didn't even had uniform and he was alone talking humbly while officers showing there dominance so who was escalating situation you know very well I am done if you are also a citizen then please support right thing cause the next number to be harassed can be yours 🙏

Actually Indian judiciary is such that if at all you file a case against these police personnels 90% chances judges won't be harse on police. Department too won't take strict action. If this was a case in US the compansation would have been enormous

You must get clear approval from the RTO if you want to change the exhaust. Exhausts that cause sound pollution above 100 decibels are strictly prohibited. The exhausts you install should not disturb other motorists and pedestrians on road

1. Any after market attachment/modification is illegal in any vehicle, even though these fittings are sold legally. Performance enhancement fittings are meant for racetrack/rally settings. 2. Never be aggressive with cops on duty, even if they have done something not according to law. In the West, aggressive response to cops results in arrest and prosecution. 3. You said you were arrested. Just asking/taking someone to the police station for questioning is not arrest, which is different. 4. Where is the corruption? Cops issued challan and not asked for bribe. You can always opt to challenge it in court or lodge complaint with higher officer. 5. Medical test is a procedure to verify if the driver/rider of a vehicle is under the influence of any intoxicant. 6. Assuming taking out the keys is legally wrong as you have said, you could have ignored it and politely said that this was not needed as you are parking the vehicle and co-operating with them. Since everything has a context, polices behaviour of grabbing keys has a social context as, let’s accept it, generally speaking - and not pointing a finger at you - there is a tendency among bikers/drivers to flee at the slightest chance. I have seen these on many occasions. These scenes do come out, though in rare channels. 7. As owners of superbikes, we must realise that these do make unusually loud noise which is very disturbing in city areas. Exhaust enhancements also raise the pitch, which can accentuate the impact of sound at any given decibel. So please ride/drive slowly thru populated areas, especially in the night. 8. Bottomline: always be calm and polite, keep smiling and most of the time things work out. That is my experience. Your case is all about ego all around, which is undertsandable as we are all humans first.
