      This is why people who think they will be landlords and the tenants "will pay the mortgage" are nuts. My dad did rentals for years and he told me the happiest day of his life was selling his last one. Now tenants are suing landlords like if they trip on a step in the house and get hurt. Not to mention they can stay for years without paying and trash the place at the same time.

      @@drn13355 we have six rentals none of them have had real problems with tenants paying. They are all fairly expensive and we do extensive credit checks. We also will not anybody who has an eviction on the record.

Also, every court should require that in order for an eviction case to proceed, the non paying tenants should be required to put rent in escrow with the court or immediate eviction!

    Rent is income for landlords. Tenants think they can pay at any time or withhold but immediately stop paying after seeing a tax bill? How does withholding rent so a landlord has a harder time paying the mortgage help the situation at all? She’s a liar, just wanting free housing.

      Back in 1990 we were renting a house. Came home on Christmas Eve of all days to find a notice on the door that the house was being foreclosed on. Apparently they were taking our rent but not paying the mortgage. We kept paying rent anyway until the day we moved out 4 months later. Foreclosure or even the threat of it has nothing to do with the contract you sign to pay rent.

      @@makeminetexas3494 even if it is a rent to own ? The landlord, in that case, holds back part of rent for down payment, so in this case lease is broken, goes back to a normal rent lease. These renters are plain wrong.

      There should be a database for landlords to list past tenants on. They can put things on their records like this so the next landlord can see if they’re going to screw them over

    Her position seems to be "we shouldn't owe court costs because we didn't choose to come to court, the landlord did". But what she fails to understand is that she chose to make it necessary for the landlord to take her to court by not paying her rent. That's the whole crux of the matter.

      Thats why his lawyer asked for a deadline of 90 days or to be able to file a notice to quit. So even if she doesn’t pay he can get them evicted but they will never pay that on time so gives her time to destroy the home and owe more money that’s what will happen for sure

      Yes. If you listened carefully, the taxes were being paid on time by the " landlord's" mortgage company, but it was the TAX ASSESSOR'S office that made the error by not recording the homestead exemption properly, causing *extra* taxes to be assessed and levied. That's why the "landlord" got a refund after he found out what happened.

      She's financially illiterate. So much so that she can't understand that the benefit/value she has received (a roof over their head) has to be paid for. Her argument that IF the home WERE to be foreclosed on...thus potentially preventing them from becoming the owner...that they would prefer to disregard turning over legitimately owed unpaid sums so they could just run off with those funds to spend on a different place...is just a garbled way of saying they wanted to pocket a year's worth of free housing. For some reason, she's not able to understand that she just elucidated to the court her intent to steal. Remarkable.

    I’ve had that happen. Had notices come to my home about foreclosure and I called my landlord and they said they are taking care of it. Never once did I think oh yay I can take advantage of them and not pay my rent because IM STILL LIVING THERE.

      Honestly, plaintiff could easily have lost the case due to failure to appear. I completely understand judges being DONE with zoom hearings, considering the horrible behavior and technical difficulties people have over so many of these cases appearing on youtube. If you have an investment property in a different state, you need to accept that there are times your going to be required to travel for the sake of your investment. That's the investor's burden.

    So she stops paying because she thought the house would be foreclosed on because of a 1 year delinquency in property taxes. She was already in judgement for failure to pay, and thinks she didn't have to pay because if the house was going to be foreclosed, then she would lose the house and her money. What dizzying logic. I get it, but it's absolutely ridiculous.

      I don't even get that much! If the house was ever foreclosed on, the Defendants wouldn't be automatically thrown out. The new owner - whoever buys the house at a foreclosure sale - would then have to file an eviction action against the Defendants if the new owners want them out. So, not only is their "fear of foreclosure" not a cognizable legal defense, it has no real basis in reason. The Defendants are losing their home by not paying on their contract *much more quickly* than they would if the house were foreclosed on.

      Right!! My bf and I are in a tiny 725 sqft one bedroom apartment and pay around $1380-1440 a month. We pay the 30th or 31st every month, in full on time. No excuses

      The lawyer stated at the very beginning, that the plaintiff was appearing via zoom, due to him being in Texas. She was quite rude.

I don't know if the judge & the plaintiffs lawyer have had problems in the past but even so she shouldn't be taking it out on him during court that's unprofessional imo.

    It would be a great idea for a website/app that’s a database for landlords to list tenants on. So it shows who skips out of rent, how long they rented for, if they destroyed the property, etc…it’d be super helpful for landlords to help weed out the bums and future squatters. It’d also make it a lot harder the scammer/squatters that just go from place to place doing the same shit, to get a place to live

    My tenants are on a week to week agreement. Miss three weeks and I start eviction. It takes missing three payment periods to evict in my state. I’m not waiting three months.

    This happens ONLY because courts allow it to happen. Eviction should occur after 60 days of nonpayment. Period. Dont need backstories and reasons/excuses. Its plain and simple and done.

      Landlord stated that taxes WERE paid out of Rocket Mortgage's Escrow account. He also was still paying his mortgage. If I understood it correctly the problem she's basing her defense on was that the Principal Residence Exemption (PRE) was not properly filed or recorded on the property so they denied it for 2022 resulting in a tax delinquency notice of some kind. It takes a 3 year forfeiture and foreclosure process before the home is actually lost. The tax issue is a red herring. It was cleared up with the assessor's office and he got a REFUND! I know people who regularly pay their property taxes as much as a year or 2 late. They know the law and just pay the interest and late fees. That's why mortgage companies require escrow accounts: to make sure the taxes ARE paid.

    The defendant attempt to launch her rocket at rocket mortgage never got off the ground.

    The judge was giving the attorney a hard time about the plaintiff not appearing in person, but based on what he was able to testify and stipulate to, it would have been a total waste of his time and money travel all the way there for the defendants’ BS.

    Lol So she stop paying because she was fearful it would get foreclosed. “If I’m going lose my home then I’d rather have the money.”. Fair but that doesn’t mean you get to live rent free in the mean time. 😂

      Actually, not "fair" . The money she saved by not paying her payments should have been placed in an escrow account, not her personal savings account.

    Judge is terrible, defendant may be called to testify by the plaintiff. Not allowing a virtual appearance? When he lives in Texas? We call that a "home field" move, where the judge treats a petitioner worse because they're from out of town. Seems courts bend over backwards to help out deadbeats. Haven't paid rent in a year and a quarter. This is why rent is so high but being a landlord still isn't profitable. We desperately need judicial reform.

      On procedure, you are absolutely correct. Not only that, but right after she allowed an attorney to appear by Zoom. Make it make sense?? And she had a loud the person to appear by Zoom previously. I'm glad she finally allowed the plaintiff to testify, although he didn't have to since the defendant basically admitted everything.

      I currently have tennents in my mom’s house… they will go pay the court their rent, but won’t walk 150 feet to pay me their rent… yet won’t leave, and keep appealing their case… when they know they’re in the wrong…

    This is crazy. In South Africa, many home owners are now using an eviction team to evict squatters because courts are too slow or lenient.

      Sad, defendants should face jail if they don't get a job and pay up. I worked 3 jobs= 60 hours a week, and I was older than these lazy losers. Both of them do that and you could pay this man his money easily in a couple months.

    I used my tarot cards to predict that the paper work on the house I'm renting to own was wrong for tax purposes. Therefore, I stopped paying money 4 months before I received notice of taxes owed. LOL. These people know how the system works, and had to be sued 2 times before for payment. At least he has this judgment, he can go after their tax returns now. I'm sure they are low income with a big child tax credit. That is probably the only way he will get money from that trash.

    Had to deal with this problem once upon a time working in real estate.
    Migrant single mother of three would always be late on her rent, then we’d have to take her to court, she’d cry and the judge would give an extension.
    This happened multiple times.
    Eventually the landlord sold the property.
    This also creates a scenario where landlords would need to be weary of putting single mothers in their properties, it’s terrible as they probably need it most but when the system is this broken most mom and pop landlords can’t afford the risk.
    I’m glad we had laws in Australia to protect tenants but this lady clearly couldn’t afford the rent.

      Absolutely! GOOD tenants need all protection they can get from predatory landlords… BUT landlords need protection from predatory tenants like this!! And this is absolutely predatory. She probably hops from property to property doesn’t pay and just drags it into litigation and then disappears.

    Telling the judge that the reason I have not paid any money towards my rent to own due to unreasonable court costs in the previous judgements in already nonpayment of seven thousand already due is a pathetic excuse and the defendants hasn't made any escrow in their defense then back to court with the same excuses adding three thousand more in non-payment towards their responsibilities' over a year behind in rent to own property

      Appearing virtually is a courtesy of the court, appearing in person is the norm.
      There's no reason he would need to appear virtually even if he's out of state.

    The fsct thatv these two haven't paid rent in over a year will follow them via credit report. They've pretty much cooked the goose.

      He’s got something weird going on with the taxes though. He’s claiming the homestead exemption on it even though it’s not his primary home ostensibly due to the renters having a “land contract” which I’ve only seen with mobile homes. So because they are getting about a 50% discount on taxes because it’s in their name, the renters shroud have been paying the taxes on it directly. So while the taxes are most certainly their business, not paying the rent is theft.
      Any landlord that does a “rent to own” is counting on late payments so they can keep all the money someone already paid. While most people think you can just chalk it up to rent, these agreements generally come with a large deposit; much larger than first/last/damage and are non refundable. Since people who go for these type of deals aren’t great about making payments on time, the deposit is forfeited and an eviction is filed. Rinse and repeat to new renters. Exactly like “buy here pay here” car lots operate. it’s a relatively easy way for a landlord to make more money than they would on just rent but this guy waited wayyyyy too long to evict them. In most states you can start proceedings the day after rent is due. Evidently whatever state he’s in makes you wait a lot longer. You take a risk renting to these types with bad credit hoping to collect more than normal rent and he just made a bad bet this time so I don’t really feel sorry for him. It’s the cost of doing business like tho.

    The tax bill comes but you have usually months later to pay it..mine comes the 1st week of January and dont have to pay till November...So most landlords use rent to pay the taxes least the landlords i know do...

    When a tenant withholds rent they are meant to hold it in escrow to be paid after adjudication/resolution of the supposed issue. It sounds like this person stopped paying (couldn’t pay?) and spent money meant to pay in the meantime instead of holding it, knowing that they might end up owing everything they withheld.

    Are you kidding?? The plaintiff's lawyer is arguing a dispute of court costs of $137 when the defendants have $10,000 outstanding that they prepared to pay? How much is plaintiff paying this lawyer who the judge ran circles around? I think someone's ego is getting in the way.
