Prior to amendment, the ownership was a fundamental right. Later, vesting Acts were passed. Hence we went to presumptive title. Now we are on the way to Land Titling, the conclusive title.. In my opinion, The Sub-Registrar's office of the area concerned, first verifies whether a piece of land or property is encumbered or not, as per their own records. If no such encumbrance is found, then a property is allowed to be registered and ownership transferred from Person A to Person B.
On the basis of this registered transfer only Person B gets ownership of the TITLE.
Based on this TITLE only, Mutation is carried out and Land Tax has to be paid.
Therefore it stands to Reason that the Land Tax Receipt is at least a Derivative or by-product of the registered deed

There are many rules regarding owning agricultural land in another state outside my own state of domicile. The rules are different in each state, and so if i buy agricultural land in another state outside the state of my own domicile, i may lose my money. I can go to another state, pay money to the owner, then go to the registration office and get the agricultural land registered in my name and get all the proper registration documents in stamp paper and I am now the official owner of that agricultural land. But, when i go to the village office with the registration documents to pay land tax and get my land registered in my name in the village office, does the problem start. Example.... I am domicile of Kerala, living in Kerala and if i buy agricultural land in Maharashtra state, the village officer in Maharashtra will ask me bring a certificate from the village officer in Kerala, stating that me or my parents own agricultural land in Kerala. That is because almost all states have the rule that only a farmer from another state can buy agricultural land in that state. So, unless I am a farmer in Kerala owning my own agricultural land in Kerala or my parents own agricultural land in Kerala, the agricultural land i bought In Maharashtra will not be registered in my name in the village office in Maharashtra. So, i cannot pay land tax, cannot get a bank loan or agricultural loan using that land, cannot construct any farm house in that land. I will not get any building permit or electricity connection or water connection. I will not get any certificate from the Maharashtra village office regarding my land. All i can do is farm my land using my own money ...
House plots in some colonies like laksham veedu colonies in which land has been given free by the government have a clause in the original pattayam that this land cannot be sold to others. It can only be passed on to the children of the original owner after the death of the owner. So, if anyone buys such a plot , the last owner will lose the land if anyone gives case against him in the court. And government will take over that land without paying any compensation. Some such plots have a condition in the pattayam that the land cannot be sold for the next 10 years. If the first sale of this plot was done before 10 years, and later this plot was bought and sold many times, even after 50 years, the last owner will lose the land if anyone gives case against him in the court. And government will take over that land without paying any compensation. So, Having aadharam and tax receipt of such land is of no use to prove ownership because condition given in the original pattayam created more than 50 years ago was broken..
The staff in the government registration office will not tell the buyer about any problems with the land that they are going to buy, because it is completely legal to buy and sell land in which building permit is not allowed.. Examples.. No type of building or construction will be allowed within 100 meters from a ASI archeological survey of India monument. Also repair of existing buildings within 100 meters will need the permission of ASI. Similarly, building permit will not be given in plots near defense property, airports, CRZ land, ESA land, EFL Area, agricultural land, estate land (thottabhoomi), paddy field, wetlands, Buffer zone within 1km of national park or wildlife sanctuary, land near river, lake etc. Many people go to registration office, pay money to owner, buy land and register the property in their name, pay land tax etc. But, later realise that building permit is not allowed in the land they have bought.

I Appreciate this video. It takes a lot of effort to create a video but very easy to criticise it. There are too many commentators who do nothing worthwhile but jus come and comment.They might be knowledgeable yet cant make a video and explain. Also this is purely for Academic purpose and i watched this purely on Academin interest. That being said It could have little more crisp and clear as what really is the Proof of Ownership. Today Possession Certificate is being issued by revenue department which merely says you are possesor and not owner if i have understood the term. So Technically Land is State Owned Entity which can be taken back at any given point of time ? Also please confirm what document the Proof of " interim " ownership if it can be called that way ?
Government can take back the land only after giving financial compensation to the present owner. This amount cannot be less than the price shown in the aadharam,, and also not less than fair value of that land. Owners who were not satisfied with the cash compensation have gone to court and got more cash compensation
SC must be kept in the dark about the party details and vice versa.Only then we can be sure that the judgements are neutral and not biased whatsoever.

അപ്പോൾ ഏതാണ് ശരിയായ ഉടമസ്ഥാവകാശ രേഖ ? ആധാരം എന്നത് രണ്ടു പേര് തമ്മിലുള്ള കരാര് മാത്രം ആണെന്ന് വേറെ ചില സന്ദർഭങ്ങളിൽ പറഞ്ഞിട്ടുണ്ട് , അതായത് ആ കരാറിൽ പറയുന്ന ഭൂമി അവിടെ ഉണ്ടാവണം എന്ന്പ പോലുമില്ല

I am not blamed you for this. As you know a stamp paper agreement is only a legal commitment between two parties. land records are kept with Revenue department in every state. Land tax receipt is issued by the government authority who has the possesion of land records. But registration is done only on the basis of this revenue records. I just pointed this contradiction in this verdict , as you told, just for an academic interest🙂

"ഭൂമി വിട്ടുതരില്ല" എന്ന വാദം *നിലവിലെ ഭൂടമയ്ക്കു പറയാൻ കഴിയില്ല എന്നതാണ് ഈ വിധിന്യായത്തിന്റെ ചുരുക്കം .!

നിലവിലെ ഉടമയ്ക്ക് സാമ്പത്തിക നഷ്ടപരിഹാരം നൽകിയാലേ സർക്കാരിന് ഭൂമി തിരിച്ചുപിടിക്കാൻ കഴിയൂ. ഈ തുക ആധാരത്തിൽ കാണിച്ചിരിക്കുന്ന വിലയേക്കാൾ കുറവായിരിക്കരുത്.. കൂടാതെ ആ ഭൂമിയുടെ ന്യായവിലയേക്കാൾ കുറവായിരിക്കരുത്. നഷ്ടപരിഹാരത്തുകയിൽ തൃപ്തരാകാത്ത ഉടമകൾ കോടതിയെ സമീപിച്ച് കൂടുതൽ തുക നഷ്ടപരിഹാരം വാങ്ങിയിട്ടുണ്ട്
