God bless Teodoro Locsin who has the courage, guts, the balls to declare and to claim it openly as belonging to the Philippines, not Malaysia which repatriated a large number of Muslims even during this covid-19 pandemic. They were all taken care of and nourished back to health by Zamboanga City before returning to Basilan, Sulu, and Tawi-Tawi. It's really best If Malaysia contends with our Nation as a whole and not just with a small number of claimants. That country has not respected the Sultanate, and has only used our people for their own benefit. God bless the Philippines!

It does not matter if the Sabahans refused to join Philippines. They can leave anytime. Anyway, they are just TENANTS. What matters is that the land owner wants to take his property back. And according to the Constitution, the government has the power to enforce the law to protect it's citizen and it's properties. As a fellow citizen, I stand by and support the Sultan in his rightful endeavor to take what he owns by history and heritage.

@@rigobertolagumbay4560 , no need to revalidate because the idea or claim or accusation that only 1/3 of population favouring the formation of Malaysia came only 10s of years after the formation of Malaysia. And Cobbold Commission was not the only exercise and the report used. It was the final conclusion of the Secretary-General on Malaysia Mission that determined the formation of Malaysia. Not Cobbold Commission.
The sovereignty of Sabah and Sarawak as component states of Malaysia is intact and recognized internationally and recognized by the UN. This was confirmed and clearly stated in the United Nations Malaysia Mission Report "Final Conclusion of the Secretary-General", 14 September 1963. The last sentence of the report says:

@@abdulwahidmdtahir3660 I did not say that it was the Commission who formed Malaysia. I ONLY said that the Commission report was the one used as basis for such action made by the Secretary General. However, you people did not know the history of that land. The British did not even highlighted the fact that they are paying LEASE money to Sulu. Then your government inherited that responsibility and honorable fulfilled that obligation. Until such time that reports are coming how you abuse and mistreated Filipinos in Sabah as "illegal aliens" on their own land. Not even accorded them federal citizenship as mentioned in the 20 point agreement. Tapos sasabihin mo na ok iyan. As long as iyan na ang nagyari at nabuo ang Federataion of Malaysia ay ok na at idwongrade na lang ang mga pangaabuso na ginagawa ninyo sa mga kapatid namin na matagal nang nakatira diyan panahon pa ng mga pirata at slave trade. You di not even considered talking to Esmail Kiram who was the Sultan of that time and make him a supporter of Malaysia. Bakit siya tumakbo sa Presidente namin na si Diosdado Macapagal at humingi ng tulong na mabawi ang lupang inaakin ninyo? If Sabaha is not a place and it is a people, then look for another land to settle and return North Borneo to its true owner.

      @rigobertolagumbay4560 Рік тому

@@abdulwahidmdtahir3660 so you are saying that Lord Cobbold himself made the idea or claim in this summary?
Lord Cobbold summarised the Commission's findings as follows:
About one-third of the population of each territory strongly favours early realisation of Malaysia without too much concern about terms and conditions. Another third, many of them favourable to the Malaysia project, ask, with varying degrees of emphasis, for conditions and safeguards varying in nature and extent: the warmth of support among this category would be markedly influenced by a firm expression of opinion by Governments that the detailed arrangements eventually agreed upon are in the best interests of the territories. The remaining third is divided between those who insist on independence before Malaysia is considered and those who would strongly prefer to see British rule continue for some years to come. If the conditions and reservations which they have put forward could be substantially met, the second category referred to above would generally support the proposals. Moreover once a firm decision was taken quite a number of the third category would be likely to abandon their opposition and decide to make the best of a doubtful job. There will remain a hard core, vocal and politically active, which will oppose Malaysia on any terms unless it is preceded by independence and self-government: this hard core might amount to near 20 per cent of the population of Sarawak and somewhat less in North Borneo.

On the other hand, back tracking form history, Spain made a treaty with Britain and Germany to clarify it's southern border. Spain used to have a territory at Sabah. But Spain cannot contain the piracy and moro uprising in the region. So they made a treaty defining the borders of Spanish Philippines in the south. It excluded Sabah as part of the Philippines. This was also used in the Treaty of Paris 1898 with the US to define the boundaries of the new American territory in South East Asia.

Before the treaty between Britain, Spain and Germany happened there was another significant event. On 22 July 1878, the Sultan of Sulu had relinquished all his possession and sovereignty of Sulu and it's territories including Sabah to Spain. The Sultanate of Sulu only remained as hereditary cultural and traditional entity without any sovereign territory.
In 1885, to resolve overlapping issue on Sabah and other issues involving other islands, Britain, Spain and Germany arrived to an agreement known as Madrid Protocol in which Spain surrendered Sabah to Britain. Sulu could not claim anything because they had already relinquished the sovereignty of Sabah to Spain, and then Spain surrendered Sabah to Britain.

@@deanjosephmendez9217 , "... learn history of Sabah...". It depends on which history and written by who.
      1. Philippines wants to claim Sabah because she claims that Sabah belonged to Sulu and Sulu as part of Philippines had given Manila right to claim Sabah.
      2. Sulu claimed that Sabah belonged to Sulu because Brunei had given Sabah (actually only eastern part of Sabah) to Sulu as a gift for helping Brunei to fight and defeat rebels.
      3. But Brunei refuted and denied having given eastern part of Sabah to Sulu. Yes Brunei did promise to give eastern part of Sabah to Sulu if Sulu help Brunei to fight and defeat rebels. But Sulu didn't come to help, or they came too late after Brunei had already defeated the rebels by themselves. So according to Brunei, eastern part of Sabah had NOT been given to Sulu. When Sulu soldiers returned to their Sultan they reported that they had helped Brunei defeating the rebels, they dared not telling the truth. So Sulu Sultan thought and assumed that eastern part of Sabah had been given to him. But there was no document signed by both Sultans regarding the transfer of ownership of eastern part of Sabah from Brunei to Sulu.
      4. When Brunei ceded Sabah to NBCC, it was the WHOLE of Sabah, showing that Brunei still owned the whole of Sabah. This cession agreement between Brunei and NBCC was documented.
      5. When NBCC went to Sabah to do their business, Sulu Sultan claimed that eastern part of Sabah was under Sulu. So NBCC had to make a deal with Sulu Sultan just so that they could do their business. This deal wether it was a lease, rent or cession was documented.
      6. BUT STILL THERE WAS NO DOCUMENT OF TRANSFER OF OWNERSHIP OF SABAH FROM BRUNEI TO SULU SIGNED BY BOTH SULTANS.
      7. Then NBCC transfered Sabah to the British government because NBCC couldn't afford to rebuild Sabah after WW2. This transfer was based on the fact that the whole of Sabah had been ceded by BRUNEI to NBCC, not by Sulu. It was up to NBCC to transfer Sabah to any other entity.
      8. The British government then gave Sabah and Sarawak independence. Subsequently the people of Sabah and Sarawak had made decision of self determination to join Malaysia.
      9. According to UN Charter, once the people had exercised self determination, all previous historical events and status would become null and void. What is in force now is what is internationally recognized and recognized by the UN i.e Sabah and Sarawak are component States of Malaysia. This was confirmed and clearly stated in the UN Secretary General report on Cobbold Commission which was even published in the Philippines Government Gazette.

      10. On the issue of payment of 'rent", it was officially called "cession money" not "rent". In Manila Accord meeting the descendent of Sulu sultan requested through Manila for Malaysia to continue paying what was left by the British. Malaysia agreed to continue paying even though she was not obligated to pay, with condition that Sulu should not make any physical claim. If Sulu breach the condition then the agreement would be null and void. And it was called "cession money" but in actuality it was merely "consolation money". But to use the term "consolation" was felt to be too degrading, thus the term "cession money" was continually used as used by the British before.

From the British business man, it was passed on to the British North Borneo Company. And from the company it was passed on to the British crown as Protectorate without the knowledge and consent of the Sultan of Sulu. And later on it was passed on to Malaysia. Not fully true. Sulu only claimed that Sabah was given by Brunei to Sulu as a gift. But Brunei refuted this claim and denied ever having given Sabah to Sulu. There was no document regarding the transfer of ownership of Sabah from Brunei to Sulu signed by both Sultans.
It was a historical fact that on 29 December 1877, Sultan of Brunei ceded the whole of Sabah to BNBC and concurrently appointed Baron Von Overback, the co-owner of BNBC as Maharajah of Sabah and Rajah of Sandakan and Gaya.
When BNBC went to Sabah to start their business, Sulu claimed that Sabah belonged to Sulu. BNBC agreed to enter a "pajak" agreement with Sulu after they were advised by their fellow businessmen in Hong Kong who advised that Sulu would attack them if they didn't have a deal with Sulu. This "pajak' agreement was signed on 22 January 1878. BNBC and early generation of Sulu considered "pajak" in the agreement as "cession". But only later generation of Sulu claimed that it was "lease" or "rent". These led to an overlapping issue for BNBC.
However on 22 July 1878, the Sultan of Sulu had relinquished all his possession and sovereignty of Sulu and it's territories including Sabah to Spain. The Sultanate of Sulu only remained as hereditary cultural and traditional entity without any sovereign territory.
Then in 1885, to resolve overlapping issue on Sabah and other issues involving other islands, Britain, Spain and Germany arrived to an agreement known as Madrid Protocol in which Spain surrendered Sabah to Britain. Even though Britain had full control of Sabah, they still honoured the annual cession money payment to Sulu on good will. So did Malaysia when Sabah became a component state, Malaysia still honoured the annual cession money payment as consolation for the Sultan of Sulu.
The payment was stopped in 2013 after the Sabah standoff incident where the so called "Royal Sulu Security Force" infiltrated Sabah and occupied a village in Lahad Datu.

The agreement between Sultan Sulu and British North Borneo Company or BNBC on 22nd January 1878 involved only these two parties. On 22nd July 1878, Sultan Sulu relinquished his sovereignty on Sulu Archipelago and its dependencies thereof to Spain. On the same day, Sultan Sulu wrote to Governor General of Philippines and Governor of Sulu terminating the agreement between Sulu Sultanate and BNBC. The agreement between Sultan Sulu and BNBC on 22 January 1878 is null and void. On 24 July 1878 Governor of Sulu wrote to BNBC concerning the Spanish sovereignty on Sulu and its dependencies including North Borneo and the termination of the 1878 agreement between BNBC and Sultan Sulu. A letter was then written to the Spanish Government in Madrid and the issue was raised with the British Government. Finally, the issue on the agreement between Sultan Sulu and BNBC and the status of North Borneo was settled through the Madrid Protocol 1885. North Borneo belongs to the British under the Madrid Protocol. Again, on the 25th November 1957, the latter Sultanate of Sulu declared termination of the lease between Sulu and BNBC effective on 22 January 1958. Thus, the agreement is null and void twice. No payment is required as there is no new agreement. Earlier, the British (before formation of Malaysia) also do not have such an agreement. Malaysia is not responsible (like payment for cession/rent) as it does not involve (not exist prior to 1963) in any of the above agreement. Malaysia only make payment after the Manila Accord meeting in 1963 as requested by the Philippines Government. The token amount might be a gift to the Sultanate to cool down the situation. That is why the amount is ridiculously small in Malaysian dollar and not Mexican Gold Dollar used during that era (1878).
On 17th December 2002, in the case of ownership of the islands of Sipadan and Ligitan between Malaysia and Indonesia, ICJ make a decision rejecting Philippines intervention in the court case (historical and legal rights on North Borneo) on the ground that there is non-existence of an interest of legal nature. Attesting that the Bases of Peace and Capitulation agreement in 1878 between Spain and Sulu is definitive as Sultan of Sulu has definitively relinquished Archipelago of Sulu and its dependencies to Spain thus include North Borneo.

Sabah is owned by the Sultanate of Sulu! Papers and history is on the Sultanate of Sulu and Philippines.

Then give independence to Sultanate of Sulu then let them claim Sabah. Malaysia doesn't negotiate with a Sultan that doesn't have his own country, Sulu is now part of the Philippines, your Sultan is just only a PRIVATE INDIVIDUAL with government recognition due to his ceremonial royal title.
Give Sulu independence then we will talk. For now, it's either on Malaysia or Brunei (very first owner) hand.

The people of Sabah and Sarawak had made decision of self determination to join Malaysia. According to UN Charter, once the people of these territories had exercised self determination, all previous historical events and status would become null and void. What is in force now is what is internationally recognized and recognized by the UN, i.e Sabah and Sarawak are component States of Malaysia. This was confirmed and clearly stated in the UN Secretary General report on Cobbold Commission which was even published in the Philippines Government Gazette.
      www.officialgazette.gov.ph/1963/09/14/united-nations-malaysia-mission-report-final-conclusions-of-the-secretary-general-14-september-1963/
The last sentence of the report says "I fervently hope that the people of these territories will achieve progress and prosperity, and find their fulfilment as component States of Malaysia".
