Old West Vignette: Wyatt Earp murders Frank Stilwell

- March 20th, 1882 -
Wyatt Earp chased Frank Stilwell over 100 yards over train tracks at the Tucson Train Depot and killed him at point blank range with both barrels of his shotgun.
Wyatt killed this man under the belief that he had been culpable in the murder of his brother, Morgan Earp, although there were no charges nor specific evidence to enforce that belief.
Wyatt Earp and others were indicted for murder in regards to this killing, and you can read the indictment here:

There are a lot of well written books on the subject and there is a minute by minute round for round account of the shooting from folks that saw it from a building across the street. The Book store in Tombstone has it all.

I love your Old West Vignettes. My opinion of Wyatt Earp has somewhat shifted from these two videos about his killings. Regardless, now I want to see a video on firing both barrels simultaneously of a SxS shotgun. Great video.

Urban developers and city planners has got to be the least decent profession they really deserve even more hate than they already get
I work with a lot of developers as part of my job and it does seem to attract an unprofessional and "money over everything" kind of person. Usually people that already have money and see it as an easy way to get more..... and it really is as you can buy a track of land, spend a few bucks to get it subdivided, and sell for easy profit.
That being said if you find a good developer/builder keep them close as they will be far more willing to take chances and create interesting spaces and communities.
I agree. So stop shopping at Walmart and other strip mall tyle places and support local businesses.

It's actually impossible to judge. We cannot go back in time and live the events. Stilwell may have run off his mouth around town, Earp may have gotten a good look at him during Morgan's murder. Context is everything and in this case, its missing or distorted by time. There has always been a thin line between justice and murder. It's really not my place to judge unless I'm drawing jury pay.
Even if he had seen him was it Earps place to act as judge jury and executioner?
Exactly. If you see someone kill another person and then kill him later, without him posing a direct threat, you're still a murderer.
In the culture of the time, in that place, pretty much yes.

At the point where you do it by the book, dig Wheeler style grid squares, record the stratigraphy, document all the finds categorically and have them stored with references in the local heritage association for future research. You might also need some permits.
A matter of scale: Ten guys privately funded, looters.
One hundred guys sent by a university, archaeology.
Run a city through force: Mafia.
Run a country through force: Government.
Size makes right.
Context. Digging up recently deceased? Is it Forensic Archaeology for a purpose or is wanton looting for valuables? Digging up centuries plus old graves? Same thing.
Like everything in life, context matters, and an identical act that is acceptable under one situation may not be under another.
You know, like shooting someone with a double barreled shotgun. Is is self defense, or murder?
Except when a university now goes on a dig all items must be held and stored in-country. We're no longer living in the 19th century where it was a matter of splitting it 50-50 with colonial overlords. Also looters are not held to account for where they found what and in which condition, things like provenance and context don't really matter when all you're doing is hawking it to the highest bidder.
Hell with legalities, Earp did the right thing.
I took my son to that railroad museum about a year ago. Never knew this took place right there. Great content.

Once the surviving Earps moved away, they stopped getting into gun fights. The surviving Cowboys on the other hand continued to rob, rustle and get killed in gun fights. It was a war between two factions in tombstone. Trying to list either party as innocent or murderers is inappropriate.
I ended up walking past this spot coincidentally on my last visit to Tucson. I recognized it thanks to this video and was able to point it out to my friends.
I find no blame in Wyatt’s actions.

Murder is such a harsh word. The Cow-boys swore to kill the Earps and their friends, so, this was just a pre-emptive strike to prevent their own untimely deaths. Case closed. Great video as always.

I love this content very very much just found it today but this is definitely something you should do more of! so many good old west stories and events, I personally have limited knowledge on these western topics but have always loved them and it started with Clint Eastwood the good the bad and the ugly when i was younger with my dad! awesome stuff karl as usual thanks man for putting effort and love for real history into your work.

When I think of Wyatt Earp, I remember the 1960's TV series with a clean shaven (i.e. no mustache) Hugh O'Brien as Wyatt Earp. A group of male singers singing a cappella at the beginning of the show and after the show, off camera, in the background, singing the theme song: "Wyatt Earp, Wyatt Earp, Brave, Courageous and bold; Long live his name and long live his glory and long may his story be told." He also had a tall sidekick deputy, called "Shotgun". Because the man's chief weapon was what looked like a 10 gauge double barrel shotgun. :-)
Well that was onesided and predictable. People tend to forget the gunfight was man on man. The cowboys started with 6 men to the 4 of the Earp faction. Three of them ran away including Ike. Then the outlaw faction bushwacked Virgil and Morgan. At this point anyone with common sense knows they are in a war and it is kill or be killed!

For his part, Ike Clanton claimed that he and Stilwell were in Tucson for a court appearance and that Stilwell disappeared from their hotel room that night and was found dead the next day.
It's never a bad time to dispatch a bad guy.

A lot of people try to label Wyatt as a good guy or a bad guy, but they forget that revenge (or vendetta) is more of a personal act that doesn't have much to do with morality

I don't think your questions about Stillwell's death can be answered by looking through the lens of today into the mists of the past. It was probably murder. But it may have been moral.

Fascinating stuff.I remember reading a quote,supposedly from the time of Stillwell's killing,which said they didn't know whether to bury him or weigh him in as scrap metal since there was so much lead in him!
We need to be careful not to judge Wyatt Earp and his contemporaries by today's legal standards. Where wearing a badge representing the law was sometimes a moral grey area by one's actions. Those must have been real rough times out there on the frontier. Where one's survival depended on your whits, bravado, and the ability to fight well with fists, knives, and firearms.
Karl i really like your old west vignette series but i would like to make a request:
when you made your first video about Wyatt while it defenetatly was interesting and informative,but as a European(Greek) most of the info got over why head, later i researched more about the events and now understand the videos.
The request is if possible on old west videos to do a quick overview of the story behind the video's topic, assuming the total ignorance of topic from the viewer(for example saying as who Wyatt and Doc were what the cowboys were doing etc etc).

A fascinating story. and some what poignant as my husband passed over on March 20th 2008 - exactly 100 year later. He had a passion for Cowboy films and stories even though he was British in the UK, as I am also a Brit. We have spent a brief time in Arizona and passed through Tuscon on the Amtrack Railroad. Interesting ... !
That developer went all 'Poltergeist' on that project there.
A gravestone is as good of a marker for the passing of a life as a pile of bones under the ground. Maybe better. Obviously, we should take respectful care of human remains and not lie about reinterring graves, but for visitation purposes, the headstone is probably better.

Loved it. In my opinion, raised Southern and as a former police officer, Wyatt was a hero. He took the law into his own hands after he realized the family would never receive justice through the courts. He'd always been. a man of the law, priding himself in being so.
But, having seen it myself, sometimes justice is disguised as vengence. I don't recommend it, but in rare instances I believe it's justified.
Had someone murdered one of my family members and maimed another, especially my children, if I get there before the law, they can cart their bodies off and arrest me.
It's not murder until a judge or jury says it is. Did they? I wish people would stop confusing homicide with murder.

Nice job as always, Karl. I love the history vignettes. Vigilante justice may be necessary at times, but they have to make sure it is the right person, and for the right reason. And it is a very slippery slope. Remember "Summer of Sam", where the self-appointed neighborhood watch patrol guys start jacking people up just because they aren't from the neighborhood? That is the wrong way to do it. Tuning someone up when they are caught in the act is better, and often appropriate. Or the instigator of the brawl getting the worst end of it. Nothing wrong with that at all. Self defense is a good thing. With our modern viewpoint and frame of reference, it is difficult to justify Wyatt's actions in this and other instances. (I was a cop for 20 years, so i understand the law). However, as some commenters point out, given the state of the court and prosecution at the time, direct action might be justifiable, and necessary. However, you can't execute people just based on belief and maybe some vague circumstantial evidence. Tou have to have something solid. And vigilante justice should stop well short of death anyway, because you can't take that back. Anyway, my 2 cents, FWIW.
I agree with others that these are probably some of the best (even though its all good) content on InRange. I appreciate Karl's dedication and enthusiasm for this interesting subject.

The courts proved too fickle to both factions. Had the courts proven themselves, Morgan Earp and Frank Stillwell may not have been killed. At worst, they'd be put on trial and incarcerated. I doubt they'd be executed, even if found guilty, because of mitigating circumstances.
Yeah the Earp’s and their fellow riders were bad. However I’ll go with the Cowboys as being even more guilty than the Earp’s were. It the Wild West
Like Wyatt said, “when I left Arizona the killing and robbing had stopped.” Different time and no it was not better or just, it just was.

Good point at the end. I would say that when the law fails then vigilantes are needed, but It is a very fine line. One of the books I read on this event focused on what lead up to the shooting and how much politics played into it. Also it mentioned that the word "Cowboy" was a derogatory term at the time. I found that quite interesting.
