    It depends on the state. In Georgia, unwed mothers have sole custody of their children, even if his name is on the birth certificate.

      I should've added that if both parents sign a paternity acknowledgment form, then it will be joint custody.

    In Texas, my wife was a citizen of Haiti unmarried but living together as husband and wife for 5 years and bought a house together. She kidnapped my children told them out of Texas and then back to Haiti. Never to be seen again not FBI, police or State Dept. She filed for child support before she left the country in 1995. Now I am 75 years old dying and homeless with nothing to live for and READY TO DIE. I have NEVER seen a judge for trial and no attorney has ever been allowed to speak for me in court. Still owe Texas $11,000; New York State for same case and same children where she filed $53,250; Plus New York takes my stimulus checks and Federal refund; VA hospital $2,700; IRS $3,500 taxed for money never received but sent to Texas. Former AG of Texas go to prison for embezzlement of public funds and income tax evasion. Public NEVER allowed to vote on any child support laws. Take away your house, car, drivers license, 50% of below poverty income and 50% of your Social Security and your pass port. For your kidnapped and murdered American children from 31 years ago and next 60 more years.

    in Virginia ( where I live) the mother has full rights until a judge says otherwise but in NC a grandparent can take a grandchild and keep it until a judge rules on custody.

    Single dad mom doesn't want my son but I do.
    I raised him and actually love him but she has the narc disorder and has done something effecting us both. On fs 3 years scocial services won't help intentionally play games to not allow us chance to get custody.

    what if you find out the father of the child is mentally incompetent to care for the child. I'm facing some legal problems of child safety and father's rights and it seems they care more for his rights than her safety. What should I do?

      The safety of the child comes first, Jamela Sullivan. The mental competence is something that should be evaluated and all courts recognize this. Talk to someone who knows the laws in your state and can get this rolling.

    My children were born during wedlock in 2007 and people were pleasant duringy my 13 year marriage my children talked to me anytime called me and now they don't call on fathers day now abd they have threatened vpeopoe I've known since 1997 after divorce. During marriage my mom was the only one to call and check on them. Now on their birthday they didn't answer the phone but my ex wife and others on Alabama who have an agenda think they can arbitrarily bring children form Mississippi back here which is crazy now that people are misusing their identities. And mine too. I would never move them from where they are comfortable people in motives in Alabama want their adult movie contracts together I guess and Ron grimes is the corrupt police investigator he tried to get my birth certificate from nC as an adult which is illegal and now in their birthday they don't answer I was told exes were not invited and insecure adults who are 80 abd molested children who send adult pics of their male hood to children abd mine after.theu took sy my lowest point abd were pleasant in 2098 when my children were born.. what was premeditated since 2007 I was led into two assaults since two surgeries and my children were not brought to see me. .says a lot. I think they wanted me out if the way since 3006.

    The Father has equal custody rights when and if he pursues his rights, ie. signing the child’s certificate, otherwise he does not! Courts will also want proof of paternity before granting his rights so a DNA test is in order. How about a child born out of someone else’s marriage. Does the step parent have rights to a child born out of their marriage? Child was conceived prior to their marrying. Bio Father, step mother, bio mother.

    That's what happened to me my mom had epilepsy and her mom was trying to force her to give me up for adoption but it never happened

    The complications of these issues seem to be because we have not created a national policy that protects the rights of unmarried men. It seems that we have created and applied laws unevenly

    Going through a similar situation my daughter was take away from me by her Mother .My name is on birth certificate and I still had no rights until filing court papers. In nyc . As a male you have no rights to a child until you fight for it 🤷🏾‍♂️🤷🏾‍♂️

    Dr. Jenkins, You mentioned these issues can get complicated and we have to focus on the best interests of the child. Agreed. But from your experience in-and-out of the court process, which group is most qualified (Intellectually, Morally, Experience-wise, and time-wise) to determine the best interests of a child: a family court judge OR a family/child psychologist? And I don't mean a psychologist in the form of a forensic evaluator... I mean a private practice psychologist that the 2 parents go to in order to mediate parenting time. To be more direct, I am wondering if we need to forego the family court system with judges making decisions, and instead create a legal process where families go directly to private psychologists to help settle these issues, in a binding way. Thoughts? Which of these 2 groups of decision makers would lead to better societal outcomes for families and children?

      The courts are involved because if people could work things out on their own they would. Some parents are bent on not agreeing or getting along and wouldn't like the psychologist, or not agree to what they thought is best, etc. Yes, in a perfect world it would be best, just not sure how you are going to enforce it.

First, I think you nailed it when you said "in a perfect world yes it would be better to have psychologists drive this solution with families" (Paraphrasing) I think the current custody system that is driven by lawyers and judges produces too many bad outcome. I do believe we need to overhaul family court. And I believe that we need to replace it with a system of licensed psychologists that do this work instead of judges. Enforcement is an obstacle, But an obstacle that can be overcome with Well-thought-out legislation to replace the current legal system on custody.

      @@LiveOnPurposeTV Second, You mentioned courts are involved because families can't work it out. There are many reasons families can't work it out, as you know. But I think a significant driver of that is because so many citizens know that courts tend to favor the mother for primary custody. At least one person in the parenting relationship, the mother, has a baked-in incentive to force the issue into family court... Because that person can expect favorable treatment. I have seen that gender bias in my own case.. And I moved mountains to overcome it and become a primary custodial parent as a dad. And I have seen it in countless other cases where I counsel dads. I think that if courts were forced to issue 50/50 custody as a temporary order on day 1 in court, Except only for extreme situations, it would greatly diminish the number of people that use the court to settle this matter.

    I’m legally married and have been for 9 years and I have a 6 month old child with someone else. The biological child’s father is abusive and I have a PFA and emergency custody and his name was removed from the birth certificate since bio dad never completed a AOP, does he have any rights

    The judge usually looks at mother and father has responsibilities, more than rights in California. Get papers of custody first.

    If his name isn’t on the birth certificate from being absent BUT knowing abt the pregnancy does he still have the same rights? Because my ex was absent almost the full 9 months can he come back and try to start drama if his name isn’t on it?

      There would probably have to be a paternity test so yes, he could still have rights.

      Sandy Brown, this depends on the jurisdiction of the state. In some states, it is presumed the father is the husband and paternity would have to be proved otherwise.

      @@LiveOnPurposeTV thanks for reply. My ex boyfriend ran off with our son at eight months old. And my legal married husband is in prison. Tx requires that the husband signs off saying he acknowledges that he's not the father. Unfortunately the husband refused to sign off so now I am going to proceed with a divorce. I have to go through to so much tape just to get my son back. He is now eleven months old. If I could change anything it would be to change the laws to speed up the process for a vulnerable baby. This is taking way to long.😔

      I was legally married and had a child with someone else during the marriage. The bio father was named on the birth certificate, but we never completed an AOP, and the form requiring my husband to have legal notice of the child and his rights.. I took the original form from the hospital regarding the birth certificate and had them remove bio dads name. It was an all day process but it can be done with bo court order depending on your married status and if the proper paperwork was not filled out… I did this to protect my child because his bio dad is extremely abusive and dangerous. I have a PFA and emergency custody right now, but I want to have his rights terminated

    What is our society & our country coming to that this is now a common thing. My cousin just screwed his life & knocked up a girl. It’s a bad situation. This is now 50% + of American children

    Marriage is a social contract for women and thus deal with the kids as their property. You have them for 9 months they're yours. The same as a landplot. The sooner society that laws were invented to serve it understands that both parents are REQUIRED the better. Society is guilty for murdering the souls of innocent children with rules are not equalized to real needs of humans.
