The Canadian Charter of Rights and Freedoms is the guide for what Canadians Freedoms are, and defines what is and isnt acceptable regarding Canadian Freedoms. In my city, there was an old widow that owned and lived in her sewing shop in the poorest business district in the city. She didn't have many friends, but enjoyed the birds that would come to her bird feeder on the side window of the shop. Only thing is, the birds would dump, and it'd land on the shops roof below. As soon as a rain came, itd wash away. No one seen it, or smelt it. Anyways, shop owners even across the street to her to court over the bird feeder. The poor woman could barely feed herself, and they expected her to pay some ridiculous fine if she was found guilty. She had already took down the feeder at that point. Something g funny happened though. A good human rights lawyer took on her case probono. Now get this. She had friends that lived in the same neighborhood as the spineless prosecutor. They took photos of her bird feeder in the back yard, and sent them in as a complaint ect. They were shown in court, and the case was thrown out. Ironic hey.
The comedian did not belittle the boy or make fun of his disability. He just used as an argument for the joke that he believed Gabriel was one of many children who are terminally ill and receive a visit from a famous person (this is very common), and the conclusion was black humor. But I don't think it was a direct offense. In fact, the joke would work with anyone, even those without disabilities.

As a comedian, I would like to hear an exact translation in English of what the joke is in it's entirety. That said, there's nothing wrong with Dark Humour, but, there is a line that you don't cross out of professionalism. Should there be any real worry for comedians, no. The reason why is that most comedians realize the difference between appropriate and not appropriate. There truly is no need for any comedian to make a joke about a specific person in a personal way, unless that person has brought it on them self. I highly doubt that a 13 year old boy brought the joke on himself as he isn't even old enough to be in a comedy club in Canada. So, and I know I will probably get lots of hate for saying this by other comedians, but there truly was no reason to single out the boy who was not part of the show as an audience member, and make an attempt of a joke towards the boy and wishing he would die. That is nothing but poor in taste and unprofessional in every way. It would be much different in another setting like a comedy club or an event with the person present and making themselves part of the show as an audience member and acting out and engaging the comedian, but even then there is a line you just don't cross. Doing stand up comedy is very freeing and relies on making comedic light of current topics or topical situations, but there is never a need to make it personal to an unknowing and un public person, especially a 13 year old with a medical condition that could end his life at anytime. NO CLASS COMEDY RUINS IT FOR ALL COMEDIANS!
Maybe the nuance of the joke didn't come through and that sucks for the comedian --live and learn but there is no case to sue, it's a freaking joke. Jean-Marc Parent made his career out of making fun of handicapped people in wheelchairs for decades. And he wasn't even funny... He never got sued and no one ever complained to my knowledge. I think Mike got sued cause he specifically targeted a child. So somewhat logical for the victim & his family to take offense since it was directly targeted at him. I agree with the freedom of speech for the comedians, but in this case, he went too far by targeting a specific person. He could have protected the child's identity by simply changing the name & the problem would have been solved. A costly error for Mike, but hopefully others will learn from his mistake and try to at least change the names of their future targets.

But like I said, I think the issue is not that he made fun of the sickness... It's more that the target was a child. If I understood correctly, that's the point they were fighting. Is that the childs' already difficult life was affected by being directly targeted. We can look at it from both sides... The parents trying to cash in on Mike's success for using their story... I also think the parents saw this as an opportunity to cash in, perhaps due to a combination of feeling wronged at first but then just dragging it through the years cause they are not getting the results they hoped for. I think the lesson Mike and others learned from this is to perhaps at least change the name of their future targets if the subject is a child. I don't think this would even be an issue if the target was an adult at the time.

I highly doubt that a 13 year old boy brought the joke on himself as he isn't even old enough to be in a comedy club in Canada. So, and I know I will probably get lots of hate for saying this by other comedians, but there truly was no reason to single out the boy who was not part of the show as an audience member, and make an attempt of a joke towards the boy and wishing he would die. That is nothing but poor in taste and unprofessional in every way. It would be much different in another setting like a comedy club or an event with the person present and making themselves part of the show as an audience member and acting out and engaging the comedian, but even then there is a line you just don't cross.
Doing stand up comedy is very freeing and relies on making comedic light of current topics or topical situations, but there is never a need to make it personal to an unknowing and un public person, especially a 13 year old with a medical condition that could end his life at anytime. NO CLASS COMEDY RUINS IT FOR ALL COMEDIANS!

Maybe the nuance of the joke didn't come through and that sucks for the comedian --live and learn but there is no case to sue, it's a freaking joke. The joke was not aimed at the kid on the first place, the joke was aimed at society - they make a kid *famous* just for dying and then he doesn't die. But society wouldn't give a damn about his condition if someone didn't turn him into a story..

Jean-Marc Parent made his career out of making fun of handicapped people in wheelchairs for decades. And he wasn't even funny... He never got sued and no one ever complained to my knowledge.
I think Mike got sued cause he specifically targeted a child. So somewhat logical for the victim & his family to take offense since it was directly targeted at him. I agree with the freedom of speech for the comedians, but in this case, he went too far by targeting a specific person. He could have protected the child's identity by simply changing the name & the problem would have been solved. A costly error for Mike, but hopefully others will learn from his mistake and try to at least change the names of their future targets.
@Unfiltered Reality don't get me wrong, I'm actually a fan of Mike. I'm just saying it's unfortunate that he had to get punished for something that others have been doing for decades. But like I said, I think the issue is not that he made fun of the sickness... It's more that the target was a child. If I understood correctly, that's the point they were fighting. Is that the childs' already difficult life was affected by being directly targeted. We can look at it from both sides... The parents trying to cash in on Mike's success for using their story... Or that the child was victimized and probably hurt/harassed in consequence to Mike's joke. 2 sides to each coin 😉
@Unfiltered Reality I agree with you. I also think the parents saw this as an opportunity to cash in, perhaps due to a combination of feeling wronged at first but then just dragging it through the years cause they are not getting the results they hoped for.
I think the lesson Mike and others learned from this is to perhaps at least change the name of their future targets if the subject is a child. I don't think this would even be an issue if the target was an adult at the time.

That's why the judge took away the 7k for the parents. Comedians look at life differently than most. They try to make light on bad situations. But some ppl get highly offended or embarrassed if the comedian directs the joke on them solely. I know I would be embarrassed if it were directed to me.
