Exactly. Those sheikhs know how these outdated marriage practices reflect on islam. Men receive sex and convenience. Women receive no inheritance, no child custody, no property rights, polygamous relationships, fatherless children and social stigmas of the arrangement. Islam does not respect women and an increasing number of them are becoming ex-religious or ex-muslim.
He is a mujaddid for western Muslims...so detailed and beautiful..I can't thank him enough for all his lectures like this..this is how Islam should of always been taught..we have a lack of ulama like this

A woman entering a misyar marriage typically isn't the husband's first wife 2. A misyar marriage tends to be kept private 3. I believe the majority of women entering misyar marriages these days are either divorced or widowed, in which case they don't marry with the permission of their wali Perhaps some combination of the above is why they tend to end in divorce. I'm no scholar but I would consider making it obligatory for a previously married woman to have a wali if entering a misyar marriage, as well as making it public, to minimize the potential negative outcomes. Exceptions should always be made for life or death situations like you mentioned. 4. The Hanafi opinion is that a wali isn't a requirement for a previously unmarried woman to get married. I don't agree with it, just putting it out there. I also have a couple of questions if you could please address them in a future episode: 1. What is your opinion regarding men taking second wives without informing their first wife (assuming they married someone who was halal for them, with the wali's permission and the public was informed in the area where the second wife lives)? 2. What qualifies as "informing the public" about a marriage? For example, do all of the husband's immediate family (parents, siblings, current wife or wives, current children) need to know?

even if the couple have agreed upon this it is still the woman who suffers, emotionally and financially, there is a very small percentage of success. I strongly feel disgusted by brothers who are looking for 2nd wife in vulnerable single mothers who are already struggling to let go of their rights. It's called having your cake and eating it, having said that if the sister is astute enough to stipulate her requirements within the Misyar contract, then that's a different affair. Sadly there are brothers out there committing zina or muta, at least with Misyar they are able to navigate the pitfalls of the temptations of this dunya by fullfilling their requirements in a halal way, or non haram way. Sometimes the husband's natural drive is much higher then his wife's, in this instance he is able to not hurt either wife, if the 2nd wife is not deceived from the outset, and fully on board with the situation.

Usually these Nikkah contracts aren't the norm, however they are there for spouses whom both wish to utilise them if their individual situation requires it.
Some of the worst liberties are taken with women converts, who often don’t have a committed wali or Muslim family to keep the husband/prospective husband in check. So the men get their legal residency status and/or citizenship without many obligations like having to pay any substantial mahr, pay for a wedding, etc. In one case I know well, there was a situation opposite to that of the first kind of ‘urfi marriage described in this lecture: the two got married in civil court with only a justice of the peace, after which the husband refused to go through with the Islamic nikah, although he had previously agreed to it. She refused to consummate the marriage until consulting with a qualified mufti in the nation’s capital who assured her that her marriage was absolutely valid as-is on the basis that her rights as a wife were legally protected by the state. Later on there were questions as to why the marriage was not done properly and the woman had no proof of the mufti’s approval. Very awkward… and incidentally the marriage was rife with verbal and psychological abuse and manipulation throughout.

It’s interesting how it’s always a win win for the men. It’s also built on exploiting the weaker position of women. Dear sisters you don’t need a relationship that adds no value in your life. What I have found is where one woman gives up her rights, she puts the dependant wife in a very awkward position. Where in many cases one wife ends up being seen as a burden, and the one who takes no or very little rights is put on a pedestal. One wife feels inadequate, whilst the other flaunts her money and almost becomes a halal 'sugar mummy' Defeats the purpose of being just. In the UK the only reason many women give up their financial rights in exchange of a second/third wife status, is Because they register themselves as single mothers, take their sustainance from the government by committing fraud. In this case is it still halal? I'm glad that someone in a leadership role has the courage to caution sisters against this in this day and age, because it is very much misused. I've come across many women who had become homeless with children after being used and divorced.
Basically, everyone should weigh out the pros and cons and also have an exit plan and a plan B if things go south before entering into any relationship, whether monogamous or polygamous because honestly even monogamous relationships are also becoming a complete disaster in the UK including Muslim monogamous marriages. This is mainly because hardly anyone seems to make any preparations before marriage and everyone has this false mythical belief that once a marriage begins that it will last forever and will always be filled with love and happiness. Secret marriages should not be allowed when the husband already has a wife. It is an act of betrayal to the first wife. To the first wife it is no different to him having an affair. The pain and mental anguish along with the physical repulsion felt when she finds her husband is secretly sleeping with another woman is worse than if she was widowed. She is unknowingly sharing a man who is being intimate with someone else. It is not what she signed up for neither did she agree to it. She is being deceived in the worst way. In Malik’s Muwatta I have heard that it is written that when Umar (radhi Allah anhu) heard of a man with a secret marriage in another place, he replied that if the man had been present he would have had him flogged. Please can the Sheikh find this Hadith.
I do agree with that sentiment. But, the situation not always been black and white. We will not know what situation may arise in the society that we can easily justify our judgement. But the one thing I realize, most of "Muslim", doesn't put God for everything they do. They will seek fatwa that benefit their selfishness, even though mufti that give that fatwa has their good reason for their judgement. If they understand Allah will always see what their heart seek, many of Muslims will take this Misyar in very careful manner, rather give opportunist an excuse to have several spouses and claim this is halal without thinking the repercussion of their first wife emotion. Allah will judge such men and may Allah reward the wives that have been hurt from this opportunist "Muslim".

Regarding 43:25 lets not forget that often it is the women who take advantage of the men. I know personally of stories where the wife stole large amounts of money from her husband even though he was already spending generously on her. Also stories where the woman entered into polygamy but did everything she could to undermine and ruin the marriage of the co-wife. Also stories of women who have secret boyfriends when they enter the marriage to the new husband. Or women who marry a divorced/widowed man with children but she ends up abusing his children. Etc, etc. BOTH men and women are not perfect. Let us stop pretending that all women are little angels who do no wrong.

Salam alakium...thank you for pointing this out. Mysiyar marriages have witnesses and other parts of a halal marriage but they are probably also done without the 1st wife knowing. So how is this allowed in Islam. As a revert to Islam honesty which is what the Prophet Mohammed pbuh was known for but a man can be dishonest to his first wife and marry a second without her knowledge. May Allah forgive me but I do not understand how this is acceptable.
@@annalohre1357 A woman is able to set conditions in the marriage contract which gives her the right to divorce if those conditions are not fulfilled. A common one is the right to divorce if the husband marries another wife.

Let us point out what the Qur'anic verses on polygamy actually say: "If you fear that you shall not be able to deal justly with the orphans, marry women of your choice, two or three, or four; but if you fear that you shall not be able to deal justly (with them) then only one." (Al-Nisa', 4:3) A subsequent verse states: "You are never able to be fair and just between women even if that were your ardent desire." (Al-Nisa', 4:129) In Misyar 1. Women are exploited financially, morally, socially and religiously. 2. Never be safe and secured for women, there is no safeguards 3. Some men are polygamous by nature, Misyar is for them, where no cost is incurred; as women are freely available 4. Men who agree with Misyar can never be a ‘decent’ husband, on the contrary they are male prostitutes (I apologise)? They bear least respect for women 5. Such marriage can never form a family, the long term consequences will be disastrous not only for the woman but to the entire society 6. Misyar grossly overlooks the wisdom behind holy marriage and Maqasid Al shariah. 7. In my opinion such marriage cannot be HALAL. A malpractice cannot be halal simply because majority “scholars” regard it as halal. If majority says 2+2 is 5, it cannot be justified. The reason behind the notion ‘halal’ is not satisfactory. Moreover, it is against Quranic concept of justice and equality. 8. If a woman at her fifties, unfortunately has no husband, can sabr. A man is advised to fast, why a woman at fifty cannot be patient enough from abstinence? A powerful woman at her fifties can ‘buy’ a full time husband, rather than part time haggards.

But no one does background checks, no checks if the woman specially is vunerable or not. Many organisations specially in the charity sector exploit women. Many of these organisations don't even have safeguarding policies in place. I work with many women who have been married and divorced within weeks, ending up in homeless shelters, Pregnant or with existing kids. A man in our own community is to day has 16 nikkahs performed, no imam enquires his background. He preys on vunerable women. Why can we not have a governing body that performs nikkahs. One that runs complete background checks. Why can't nikkahs be registered on a national data base so serial nikkah seekers can be flagged up. We are so fixated on how multiple wives are permissable or how misyar is allowed, no one is interested in fixing the broken system of how nikkahs are performed and recorded

As you said that most of misyar marriages don't go for a long and women are specially the more sufferers which sense quite true I have another important question about here and it about children which born as result of misyar. Would they be entitled to inheritance laws or can such condition be put under misyar that children born out of such marriage contract wouldn't be entitled for inheritance. Regards
I always love listening to YQ. But it’s hard to completely avoid gender biases. Besides mentioning the increase in empowered women, he should also mention the fact that boys / men are being left behind educationally. There’s a lot of literature around this, but in my country if you look at public university enrolment, 70% is female. So please ask what’s happening to the men. Waiting for men to support us is no longer a viable option for women.
The mahr is the res, that is, a requirement of a commercial contract. Nikah is a commercial contract. Mahr is not to protect the woman financially. How can it , if it could be an iron ring or a bag of dates? This wrong idea is why there are ridiculous mahr asked, and the youth can not get married
Mutah marriage was common for years until the second caliph made it haram. It has every right like regular marriage except it was temporary. The woman appoint the time and mahr and the man accept it. Now we have made misyar marriage which is all about $3X, as an alternative to mutah marriage. The Quran is clear. It literally has a verse for mutah marriage. I don't know why some people make it so complicated.

Thats why women will propose a misyar nikah themselves, its a lifesaver for divorced and widowed women, who no body wants. That in itself tells you there is nothing wrong with it, it has no time limit like a muttah, and a talaq is required to get out of it. Muftis try to avoid the subject so as to not promote it, so that more women are in a nikah that is not concealed, which means they will get their rights. But them turning a blind eye will not solve the problem, because there WILL BE a direct correlation between women left on the shelves, and misyar marriage.

It is permissible a man to marry his doll if he is happy. since marriage is more beneficial than celibacy. I am a shia and I don't see any difference between Muta and prostitution period. It will be absolutely foolish to think marriage is about sexual contentment. Those people who get themselves into these kind of marriages are just fooling themselves, and those scholars who are giving fetwa that it is ok will be responsible in the day of judgment for giving immoral/low life human beings and excuse to engage in their lustful wishes. The argument is that Muta is a solution for some people who are not able to get married but at the same time have strong sexual desires. I would say just go take a cold shower and pray/read quran, engage in community work get yourself busy and you will not have the time/energy to have that kind of desire. What are we? An animal that we don't have control over our desires?!

Mut’a is in Quran, the prophet allowed it and the first caliph allow it. It was the second caliph who forbade it. Only those who have intellect ask who is umar the second caliph to ban something Allah and the prophet allowed. Lol most people go astray like always.

Asalam alaikom. With respect what was said here about Catholic marriage is not correct though many Catholics themselves make the same mistake. The Sacrament of marriage and the marriage itself happens between the bride and groom themselves. The Priest is there solely as a witness fir the official Catholic Church although he conducts the ceremony. This is clearly explained in the Cathechism of the Roman Catholic Church.

The women should bring down their expectations because I live in Germany and a marriage cost between 30 to 50 thousounds Euro, so how someone effords such a disaster financial Events. Ya Sheikh Yasir, in the Catholic Church a priest doesn't deliver the sacrement of marriage to the couple. The couple gives it to each other. The priest is there to witness it.
I think Shaykh Yasir is somewhat biased when he says "Motah" as allowed in Shia Islam is not comparable or totally different to Misyar. They might differ but certainly they are comparable. The basic argument to justify Misyar is similar and the relaxation of one or partial obligation in permanent marriage are the same. I'm trying to understand, but I am really struggling with the you saying that this type of marriage is loveless and fruitless. I don't understand why you would marry someone you don't love, regardless of the agreement or circumstances. It's not necessarily an arranged marriage, so why would the assumption be that it's loveless? I know for a fact that intimacy is equally important for men and women. If intimacy is not coming from both partners, then it does not exist in the relationship. I find this to be a very sexist take. Especially, since the only reason we think sex is more important to men, is because socially and culturally, men have the freedom to express their interest in sex and women are stigmatized for it.

Since the husband never gave divorce nor the wife so it means that their marriage is still valid because without divorce marriage can never become invalid. But it does not mean that couples should stay like this. If the husband did not give dowry then he is sinful but that also does not mean that his marriage is invalid.

Exactly. Those sheikhs know how these outdated marriage practices reflect on islam. Men receive sex and convenience. Women receive no inheritance, no child custody, no property rights, polygamous relationships, fatherless children and social stigmas of the arrangement. Jazaak Allah khayr shaykh for another great explanation. A few points though that might also be beneficial, and please correct any misstatement:
1. A woman entering a misyar marriage typically isn't the husband's first wife
2. A misyar marriage tends to be kept private
3. I believe the majority of women entering misyar marriages these days are either divorced or widowed, in which case they don't marry with the permission of their wali
Perhaps some combination of the above is why they tend to end in divorce. I'm no scholar but I would consider making it obligatory for a previously married woman to have a wali if entering a misyar marriage, as well as making it public, to minimize the potential negative outcomes. Exceptions should always be made for life or death situations like you mentioned.
4. The Hanafi opinion is that a wali isn't a requirement for a previously unmarried woman to get married. I don't agree with it, just putting it out there.
I also have a couple of questions if you could please address them in a future episode:
1. What is your opinion regarding men taking second wives without informing their first wife (assuming they married someone who was halal for them, with the wali's permission and the public was informed in the area where the second wife lives)?
2. What qualifies as "informing the public" about a marriage? For example, do all of the husband's immediate family (parents, siblings, current wife or wives, current children) need to know?

Here in the UK a lot of married men want a second wife but they dont want to pay anything for the second wife they try to convince her to do misyar and just visit her when they feel the need 💩its a sad condition for the ummah and the women suffer the most especially the single mothers who accept this kind of arrangement
It's called having your cake and eating it, having said that if the sister is astute enough to stipulate her requirements within the Misyar contract, then that's a different affair.
Sadly there are brothers out there committing zina or muta, at least with Misyar they are able to navigate the pitfalls of the temptations of this dunya by fullfilling their requirements in a halal way, or non haram way.
Sometimes the husband's natural drive is much higher then his wife's, in this instance he is able to not hurt either wife, if the 2nd wife is not deceived from the outset, and fully on board with the situation.

Usually these Nikkah contracts aren't the norm, however they are there for spouses whom both wish to utilise them if their individual situation requires it.
Maybe the women wants that e.g. she has her own house, children are grown etc and she doesn’t want to look after a man 24/7. So it benefits her.

Some of the worst liberties are taken with women converts, who often don’t have a committed wali or Muslim family to keep the husband/prospective husband in check. So the men get their legal residency status and/or citizenship without many obligations like having to pay any substantial mahr, pay for a wedding, etc.
In one case I know well, there was a situation opposite to that of the first kind of ‘urfi marriage described in this lecture: the two got married in civil court with only a justice of the peace, after which the husband refused to go through with the Islamic nikah, although he had previously agreed to it. She refused to consummate the marriage until consulting with a qualified mufti in the nation’s capital who assured her that her marriage was absolutely valid as-is on the basis that her rights as a wife were legally protected by the state. Later on there were questions as to why the marriage was not done properly and the woman had no proof of the mufti’s approval. Very awkward… and incidentally the marriage was rife with verbal and psychological abuse and manipulation throughout.

What I have found is where one woman gives up her rights, she puts the dependant wife in a very awkward position. Where in many cases one wife ends up being seen as a burden, and the one who takes no or very little rights is put on a pedestal. One wife feels inadequate, whilst the other flaunts her money and almost becomes a halal 'sugar mummy' Defeats the purpose of being just.
In the UK the only reason many women give up their financial rights in exchange of a second/third wife status, is Because they register themselves as single mothers, take their sustainance from the government by committing fraud. In this case is it still halal?
I'm glad that someone in a leadership role has the courage to caution sisters against this in this day and age, because it is very much misused. I've come across many women who had become homeless with children after being used and divorced.
Basically, everyone should weigh out the pros and cons and also have an exit plan and a plan B if things go south before entering into any relationship, whether monogamous or polygamous because honestly even monogamous relationships are also becoming a complete disaster in the UK including Muslim monogamous marriages. This is mainly because hardly anyone seems to make any preparations before marriage and everyone has this false mythical belief that once a marriage begins that it will last forever and will always be filled with love and happiness. Unfortunately, that's rarely the case anymore.

Secret marriages should not be allowed when the husband already has a wife. It is an act of betrayal to the first wife.
To the first wife it is no different to him having an affair.
The pain and mental anguish along with the physical repulsion felt when she finds her husband is secretly sleeping with another woman is worse than if she was widowed.
She is unknowingly sharing a man who is being intimate with someone else. It is not what she signed up for neither did she agree to it. She is being deceived in the worst way.
In Malik’s Muwatta I have heard that it is written that when Umar (radhi Allah anhu) heard of a man with a secret marriage in another place, he replied that if the man had been present he would have had him flogged. Please can the Sheikh find this Hadith.
I do agree with that sentiment. But, the situation not always been black and white. We will not know what situation may arise in the society that we can easily justify our judgement. But the one thing I realize, most of "Muslim", doesn't put God for everything they do. They will seek fatwa that benefit their selfishness, even though mufti that give that fatwa has their good reason for their judgement. If they understand Allah will always see what their heart seek, many of Muslims will take this Misyar in very careful manner, rather give opportunist an excuse to have several spouses and claim this is halal without thinking the repercussion of their first wife emotion. Regarding 43:25 lets not forget that often it is the women who take advantage of the men. I know personally of stories where the wife stole large amounts of money from her husband even though he was already spending generously on her. Also stories where the woman entered into polygamy but did everything she could to undermine and ruin the marriage of the co-wife. Also stories of women who have secret boyfriends when they enter the marriage to the new husband. Or women who marry a divorced/widowed man with children but she ends up abusing his children. So how is this allowed in Islam. As a revert to Islam honesty which is what the Prophet Mohammed pbuh was known for but a man can be dishonest to his first wife and marry a second without her knowledge. Let us point out what the Qur'anic verses on polygamy actually say: "If you fear that you shall not be able to deal justly with the orphans, marry women of your choice, two or three, or four; but if you fear that you shall not be able to deal justly (with them) then only one." (Al-Nisa', 4:3)
A subsequent verse states: "You are never able to be fair and just between women even if that were your ardent desire." (Al-Nisa', 4:129)
In Misyar
1. Women are exploited financially, morally, socially and religiously.
2. Never be safe and secured for women, there is no safeguards
3. Some men are polygamous by nature, Misyar is for them, where no cost is incurred; as women are freely available
4. Men who agree with Misyar can never be a ‘decent’ husband, on the contrary they are male prostitutes (I apologise)? They bear least respect for women
5. Such marriage can never form a family, the long term consequences will be disastrous not only for the woman but to the entire society
6. Misyar grossly overlooks the wisdom behind holy marriage and Maqasid Al shariah.
7. In my opinion such marriage cannot be HALAL. A malpractice cannot be halal simply because majority “scholars” regard it as halal. If majority says 2+2 is 5, it cannot be justified. The reason behind the notion ‘halal’ is not satisfactory. Moreover, it is against Quranic concept of justice and equality.
8. If a woman at her fifties, unfortunately has no husband, can sabr. A man is advised to fast, why a woman at fifty cannot be patient enough from abstinence? A powerful woman at her fifties can ‘buy’ a full time husband, rather than part time haggards.

But no one does background checks, no checks if the woman specially is vunerable or not. Many organisations specially in the charity sector exploit women. Many of these organisations don't even have safeguarding policies in place. I work with many women who have been married and divorced within weeks, ending up in homeless shelters, Pregnant or with existing kids. A man in our own community is to day has 16 nikkahs performed, no imam enquires his background. He preys on vunerable women. Why can we not have a governing body that performs nikkahs. One that runs complete background checks. Why can't nikkahs be registered on a national data base so serial nikkah seekers can be flagged up. We are so fixated on how multiple wives are permissable or how misyar is allowed, no one is interested in fixing the broken system of how nikkahs are performed and recorded

I always love listening to YQ. But it’s hard to completely avoid gender biases. Besides mentioning the increase in empowered women, he should also mention the fact that boys / men are being left behind educationally. There’s a lot of literature around this, but in my country if you look at public university enrolment, 70% is female. So please ask what’s happening to the men. Waiting for men to support us is no longer a viable option for women.

The mahr is the res, that is, a requirement of a commercial contract. Nikah is a commercial contract. Mahr is not to protect the woman financially. How can it , if it could be an iron ring or a bag of dates? This wrong idea is why there are ridiculous mahr asked, and the youth can not get married
Mutah marriage was common for years until the second caliph made it haram. It has every right like regular marriage except it was temporary. The woman appoint the time and mahr and the man accept it.

Muftis try to avoid the subject so as to not promote it, so that more women are in a nikah that is not concealed, which means they will get their rights. But them turning a blind eye will not solve the problem, because there WILL BE a direct correlation between women left on the shelves, and misyar marriage.

I am a shia and I don't see any difference between Muta and prostitution period. It will be absolutely foolish to think marriage is about sexual contentment. Those people who get themselves into these kind of marriages are just fooling themselves, and those scholars who are giving fetwa that it is ok will be responsible in the day of judgment for giving immoral/low life human beings and excuse to engage in their lustful wishes. The argument is that Muta is a solution for some people who are not able to get married but at the same time have strong sexual desires. I would say just go take a cold shower and pray/read quran, engage in community work get yourself busy and you will not have the time/energy to have that kind of desire. What are we? The Sacrament of marriage and the marriage itself happens between the bride and groom themselves. The Priest is there solely as a witness fir the official Catholic Church although he conducts the ceremony. This is clearly explained in the Cathechism of the Roman Catholic Church.

I think Shaykh Yasir is somewhat biased when he says "Motah" as allowed in Shia Islam is not comparable or totally different to Misyar. They might differ but certainly they are comparable. The basic argument to justify Misyar is similar and the relaxation of one or partial obligation in permanent marriage are the same. Secondly, it seems "Motah" was abrogated, not in the life time of prophet Mohammad (PBUH), but it was abrogated during the time of second khalif. allah o alam.
Not everything has happened during the Prophet’s time , if the Sahaba witnessed then who are we to say they were wrong . The premise here is if the women is okay with it , why is it hard to see the situation from her angle and not what the expectations are . Misyar marriage , the premise can be many , some may marry for sex , others for other purposes . But Mut,ah is purely for sex , so that is why the two systems have similarities but they are not the same

I don't understand why you would marry someone you don't love, regardless of the agreement or circumstances. It's not necessarily an arranged marriage, so why would the assumption be that it's loveless?
I know for a fact that intimacy is equally important for men and women. If intimacy is not coming from both partners, then it does not exist in the relationship. I find this to be a very sexist take. Especially, since the only reason we think sex is more important to men, is because socially and culturally, men have the freedom to express their interest in sex and women are stigmatized for it.

Since the husband never gave divorce nor the wife so it means that their marriage is still valid because without divorce marriage can never become invalid. But it does not mean that couples should stay like this. If the husband did not give dowry then he is sinful but that also does not mean that his marriage is invalid.
