    Hi, I have an OTH discharge, i was granted medical care (service connected PTSD) but no compensation due to my discharge. My video conference appeal is scheduled for next month. Would the judge even have the power to grant compensation?

    I was told by a VSO that we shouldn't get a representative, but use the ones provided it needed. He mentioned that the VA judges do not like having the lawyers there. This confuses me and don't know what to believe. I was service connected for insomia and I am waiting (for 2-3 years now) for the judge hearing for a sleep apena supplemental. I am still waiting, but want to be prepared.

      Hi Jim, I would wholeheartedly disagree that the judges don't like having lawyers there. I've done hundreds of hearings at the Board and the judges often thank me personally for laying things out so clearly for them. I supposed it would depend on how "lawyery" the lawyer is being. We handle things very informally here and just make sure the judge has what they need to grant your case. I always talk about the fact that it's my job to make the VA's job easy to give the veteran what they need.

    Hi-Can you explain why you need to advance on a docket if you are having the hearing?

      Advanced on the docket means your case is put in the "expedited" lane. That means those get seen before cases that are not in that lane. If you're waiting on a hearing, you would be moved before cases not advanced on the docket that are also waiting for a hearing. Hope that makes sense.

    Can you give a timeline for a decision after a CAVC remand back to the board. VA. Gov says "your appeal is being reviewed by a veterans law judge, you will receive a decision soon" my husbands appeal has been on going since 2013.

      Unfortunately the timelines are changing all the time so it's hard to say. Right now I'd ballpark about 6 months or so but that could change. Sorry I couldn't be of more help and that you've been dealing with this for that long!

      @Veterans Law Group and thank you for responding! We were told since it was a CAVC remand it would be "expedited" but we know the BVA doesn't get in a hurry.

      @@mrsdreamweaver8677 I often tell people the BVA doesn't share the same definition of expedite as the rest of us :) That said, when your case goes back to the BVA from the CAVC it would get faster attention than a case just reaching the BVA from an appeal from the VA. So you're in a better position than those.

      @Veterans Law Group they sure don't share the same definition lol. VA. Gov says it's with a judge decision soon. So fingers crossed it isn't much longer 🤞

    Is there a general time line that a judge will render a decision after the hearing is completed? I had a hearing on September 13th 2021 and have not received a verdict yet. I’m just wondering if I have to wait another 8 years since my claim was opened back in 2014.

      BVA decisions after a hearing right now seem to be taking 9-12 months in our experience.

    Whay is the current time frame from request to get in front of a judge for BVA as of now.

      It's ever changing and depends on if your case is in legacy or new appeals. New appeals seems to be taking about 2 years right now. Legacy I have cases waiting 4-5 years.

      I'm 68 and on Section 8 with Extreme Financial Hardship and will soon be Scheduled for the Virtual Hearing with representation. Will that Speed up the Decision?
