The original deal in 1878 - The Sulu sultan leases Sabah to the British North Borneo Co., represented by Englishman Alfred Dent and German Gustavus Baron de Overbeck in a deed of pajak (“lease”) in which the company would pay 5,300 Mexican gold pieces a year to the Kingdom of Sulu. Instead it was converted to ringgit. This is one of the reasons why the rent ballooned to 14.9 billion dollars in todays money. I hope this helps you all see the truth.

The Malaysian government paying this for so long a time shows that the real owners of Sabah are the Sultans of Sulu. The problem arises that the Malaysian government don't wish to cede it are basically economical in nature. Ceding Sabah will reduce the income of Malaysia by 35% to 40% because of the Petronas facilities located there. Due to the Lahad Datu stand off in 2013 (i.e. when the forces of the Sultanate went to Sabah to reclaim it) Malaysia cease the payments for the lease of Sabah to the Heirs of the Sultanate of Sulu. In March, the French arbitration court favored the Heirs of the Sultanate of Sulu and ordered Malaysia to pay them a whopping billion USD in relation to the lease of Sabah. Malaysia ignored this. Just recently, Luxembourg ordered the seizure of two susidiaries of the Malaysian state owned Petronas worth $ 2 Billion as part of the execution of the arbitral award. Malaysia's parliament is in chaos because not only their global assets are at risk but also because they are about to lose Sabah. The lease contract was for 5,300 Mexican gold per year. Malaysia converted the payment to ringgit. But the international court corrected that mistake by Malaysia and hence the reason for the astronomical bill ($15B) that Malaysia has to settle now. This is a commercial transaction and not a state function, a lease contract between the sultanate of sulu and the British company. The Sultanate of sulu did not give up its rights, it has and it still belongs to the heirs of the sultanate of sulu and they have been trying to reclaim sabah since the 1960s when sabah was included in the territorial boundaries of Malaysia in 1963 when Malaysia gained its independence. There was an existing contract, it was honored by both parties since the beginning and it was continued on until it was breached in 2013. The evidences are very solid and clear. The annual 5300 ringgit rent from the original 5000 Mexican gold was an unjustifiable amount for renting how many hundreds if not thousands of square kilometers of land that was why the back pay when computed ballooned to USD14.9B because the value of sabah appreciated over time, this was also taken into consideration.

Annual rent was 5,000 mexican gold per original contract. It was never Malaysian Ringgit. The arbitral ruling also considered the income forgone starting from the date of default whuch is 2013.

Malaysia abandoned his case and its in default. Whatever defects of jurisdiction should have been raised by Malaysia at the earliest opportunity and by its silence, was in default. It cannot even stay the arbitration order because it has abandoned its case. The argument that infringed Malaysian sovereignty is misplaced because that is originally a private contract of lease between parties that can be legally enforced without infringing countries sovereignty. 'Lease in perpetuity until the sun or moon do not rise until end of time" is the contract to be able to use Sabah. Perpetual Lease ≠ Grant or Cede. Malaysia can only claim permanent lease as long as they pay however, Pajakkan Forever is no longer Forever since Malaysia breached the Perpetual Lease in 2013. I think Brunei should also intervine and help the Philippines enforce the claims, because they are the orginal owner of the land, after gifting the land to the Sultan of Sulu as sign of friendship, helping them quelling the rebellion in 1663.
This is plain and simple problem between a tenant and landowner. Tenant stops paying rent, landowner push to claim what it is owed to them. That's why the arbitral court sided with them coz they have all the evidence(contracts, receipt etc). According to the Bruneian records...The Sulus never came to aid the Sultan in the said war. So the possession of Sulu to Sabah was actually void. You need to check the writings of Brunei's history. So Sulu's claim on Sabah is actually HARAM.

Please be reminded that the lease not sale was 5300 Mexican gold pcs not ringgit. The sultanate has all legal rights and proof of ownership and likewise proof of yearly lease w/c stopped in 2013, indeed a blessing in disguise. Malaysia has to abide by the arbitration rule.

The fact that Malaysia acknowledge that they are paying rent means an acceptance that Sabah is not their property. A virtual contract is form as offer, acceptance and consideration is provided by Malaysia and Sultan of Sulo.

Latest news as on 6th November 2024. Paris Supreme Court rejected Sulu's appeal to overturn previous Paris Court of Appeal decision which set aside and annulled Paris Court ruling awarding Sulu US$14.92B compensation. Since Supreme Court is the highest court, the decision is final and Malaysia won.
How can somebody invalidate the claim of the Sultanate of Sulu for SABAH, they acquire the land by sweat, tears, and blood, and somebody will say that Maylasia must find a way to invalidate the Sultanate of Sulu's claims. The British-made translation of the original document is to blame. Whoever created that translation made this conflict. The original document, written in the native language, clearly states that Sabah was only leased. The English translation made by the British changed this to "ceded". Both initially understood the agreement as a mere lease. When the Philippines & Malaysia became independent states, the Philippines applied the original document, while Malaysia applied the English translation of the document. So its literally an "Original document vs a Translated document" scenario. Also, according to one of the guest in the video, Atty Roger said that the best way for Malaysia to win this case is to invalidate the existing treaty used now by the Philippines. This means he knows that Malaysia will ultimately lose in court, & the only way to deflect that is to make-up some "historical" documents that do not exist. What a strange way to say they lost.

The case is very simple: Malaysia stopped paying their rent of 5,300 Mexican dollars as stated in the contract. Once Malaysia, breached the agreement, the court assumed that the property goes back to the owners ( Sultan if Sulu). Why $15 billion award to the Sultan of Sulu? Because that’s the money the Sultan of Sulu should have made from the time Malaysia stopped paying rent.
Correction: $15B awarded because of convertion of 5,000 Mexican gold bullion a year. But this was reduced later on to 5,000 Malaysian ringgit when Sabah was annexed by the Federation of Malaysia. Gold stays in value but ringgit is affected by inflation. So the difference of value between the modes of payment considering inflation plus the rent stopped from 2013 til today

The original deal in 1878 - The Sulu sultan leases Sabah to the British North Borneo Co., represented by Englishman Alfred Dent and German Gustavus Baron de Overbeck in a deed of pajak (“lease”) in which the company would pay 5,300 Mexican gold pieces a year to the Kingdom of Sulu. Instead it was converted to ringgit. This is one of the reasons why the rent ballooned to 14.9 billion dollars in todays money. I hope this helps you all see the truth.

The Malaysian government has been secretly (they do not want this to be known to people of Malaysia for obvious reasons) recognizing the contract as evident by their payments from 1963 until 2013. Not only that, you destroyed the environment and you violated human rights in that land. As a penalty and compensation you are to pay Sultan $14.9b. To incur additional 10% if not paid within a year and the succeeding years and will stop until fully paid. Shocked Abdul panicked and blaming his father for giving him a problem. Nyay.
The Malaysian government paying this for so long a time shows that the real owners of Sabah are the Sultans of Sulu. The problem arises that the Malaysian government don't wish to cede it are basically economical in nature. Ceding Sabah will reduce the income of Malaysia by 35% to 40% because of the Petronas facilities located there. People who comment here were not born yet during such time and do not hold any documents of claims. They saying that Malaysia owns Sabah should provide proof of claims. This is very clear in all phases in claims. Unfortunately, with all the consistent payments of Malaysia to the Sultans there are clear records of claims. So let us not muddle facts. For the record since 1970's the Philippines are in dispute of these islands and Philippines have had so many attempts to reclaim this Sabah through force. Now the Philippines used the legal way and Malaysia lost because they had NO documents to prove their claims. Most Malaysians may not even know that there are so many people who live in Sabah comes from the different part of the Philippines since before. And they go there freely without passports or otherwise and only use the permission from the Sultan of Sulu. The annual 5300 ringgit rent from the original 5000 Mexican gold was an unjustifiable amount for renting how many hundreds if not thousands of square kilometers of land that was why the back pay when computed ballooned to USD14.9B because the value of sabah appreciated over time, this was also taken into consideration.

Malaysia abandoned his case and its in default. Whatever defects of jurisdiction should have been raised by Malaysia at the earliest opportunity and by its silence, was in default. It cannot even stay the arbitration order because it has abandoned its case. The argument that infringed Malaysian sovereignty is misplaced because that is originally a private contract of lease between parties that can be legally enforced without infringing countries sovereignty. The decision is correct.

'Lease in perpetuity until the sun or moon do not rise until end of time" is the contract to be able to use Sabah. Perpetual Lease ≠ Grant or Cede. Malaysia can only claim permanent lease as long as they pay however, Pajakkan Forever is no longer Forever since Malaysia breached the Perpetual Lease in 2013. Any Lease of Contract broken means that the property should be duly returned in favor of the owner, The Sultan of Brunei. Going back to the French Case, they have awarded the $14.9 Billion award, the French court agreed with the Merit of the Word "Pajakkan" as a Lease and since you have broken the condition of Lease since 1939 North Borneo Macaskie decision, The French Court decided that any Organic gains of the Property (This is exclusive of the Sabah Land Claim itself) amounts to $14.9 Billion from 1939 to this day incurring 10% penalty for not paying in good faith

The original document, written in the native language, clearly states that Sabah was only leased. The English translation made by the British changed this to "ceded". Both initially understood the agreement as a mere lease. When the Philippines & Malaysia became independent states, the Philippines applied the original document, while Malaysia applied the English translation of the document. So its literally an "Original document vs a Translated document" scenario.
Also, according to one of the guest in the video, Atty Roger said that the best way for Malaysia to win this case is to invalidate the existing treaty used now by the Philippines. This means he knows that Malaysia will ultimately lose in court, & the only way to deflect that is to make-up some "historical" documents that do not exist. What a strange way to say they lost.

Sabah is Philippines 🇵🇭Sabah is own by Brunei and later given to Philippines Sultan Of Sulu as a gift. Later rented by oil company and Malaysia to the Sultan of Sulu to exploit the natural resources of Sabah.
My ancestor was a tax collector for the Bruneian Sultanate, until the British North Company leased the area. So the claim that Sulu owned whole of Sabah is wrong!!!

Not the whole Sabah but only the East Coast Part of Sabah which was offered by the Bruneian. Before the Bruneian made an agreement with the British Conpany later. But the offer was denied by those Sulu. So this means Sulu don't owned any part or the whole Sabah. Please be accurate.

Calling the arbitral ruling illogical but then seeking legal advice both internal and external. The Philippines' claim over Sabah goes way back to the time of then President Diosdado Macapagal and the current President Marcos Jr will not just "let it drop" like what you are suggesting.

The Sulu Sultanate leased Sabah to Austrian Baron Overbeck then transferred to British Prospector Alfred Dent then to British North Borneo and then to British Crown (Vehemently protested by then US Governor General to the Philippines- F.B. Harrison) And then finally with total disregard to the owner Sulu Sultanate the British included Sabah in the newly formed Malaya Federation in1963

I am a sabahan indigenous and im not interested to become a pilak..remember sabah is not just the land, its the people. Pilipin can make noise all they want but at the end of the day if u want to take over our land, blood will be spilled.

If Sabahans wish to follow Malaysia you are welcome to move to a legit Malaysian territory or a Sabah territory not part of the disputed lands. Just do a graceful exit, anyhow its not the whole Sabah claimed here only a part of it although its a large chunk.

Since Malaysia has stopped the lease payment since 2013, the lease agreement should be terminated and the heirs of sulu sultan regain back their land.
Time to give it back to the righful owners. You have benefited for such a long time.
The case is very simple:
Malaysia stopped paying their rent of 5,300 Mexican dollars as stated in the contract.
Once Malaysia, breached the agreement, the court assumed that the property goes back to the owners ( Sultan if Sulu).
Why $15 billion award to the Sultan of Sulu?
Because that’s the money the Sultan of Sulu should have made from the time Malaysia stopped paying rent.
Correction: $15B awarded because of convertion of 5,000 Mexican gold bullion a year. But this was reduced later on to 5,000 Malaysian ringgit when Sabah was annexed by the Federation of Malaysia. Gold stays in value but ringgit is affected by inflation. So the difference of value between the modes of payment considering inflation plus the rent stopped from 2013 til today
