    Just to get this corrected. The original deal in 1878 - The Sulu sultan leases Sabah to the British North Borneo Co., represented by Englishman Alfred Dent and German Gustavus Baron de Overbeck in a deed of pajak (“lease”) in which the company would pay 5,300 Mexican gold pieces a year to the Kingdom of Sulu. Instead it was converted to ringgit. This is one of the reasons why the rent ballooned to 14.9 billion dollars in todays money. I hope this helps you all see the truth.

    The Malaysian government has been secretly (they do not want this to be known to people of Malaysia for obvious reasons) recognizing the contract as evident by their payments from 1963 until 2013. They took the opportunity to cease payment citing the Tanduo incident without realizing the consequences. Now they are waking up from their nightmare.

      That's right. There was even come to a point that when frmr pres.FEM tried to talk to the former prime minister of Malaysia then but was rejected and insisted that Sabah is theirs. That brought to a point frmr pres.FEM assembled an elite tausug warrior soldiers and trained in Corregidor Is. under col. martelino, to take Sabah by force. But a traitor( u know who it is) mentioned to the Malaysian prime minister about the mission that's why it was aborted. The traitor was given a Malaysian citizenship for giving the said information. But that's the history then. Now the real issue is that Sabah is owned by the sultanate of sulu. It was given to the sultan by the sultan of Brunei as a gift for helping them against the pirates that tried to invade Brunei long time ago with documents now with heirs of the sultan. So Malaysia has no claim at all and for sure they will lose this case!

      Mr. English adopted a son, Abdul. Mr. English lease a land from Sultan. When Abdul debut, he was gifted by Mr. English the land he leased from Sultan. Mr. English told Abdul to pay the rent every year. Abdul love the land and started using all the resources there. But Sultan wants to stop the lease and get the land back. Abdul refused. Sultan sent his men to get the land but Abdul killed them. Now Abdul stopped the rent thinking the land is his because it was given by his dad. Now Sultan ask help from a police. The police was convinced that the land belongs to Sultan. And so the police said to Abdul, I am seizing your property as partial payment for your debts and compensation for stealing the resources of the land your father borrowed. Not only that, you destroyed the environment and you violated human rights in that land. As a penalty and compensation you are to pay Sultan $14.9b. To incur additional 10% if not paid within a year and the succeeding years and will stop until fully paid. Shocked Abdul panicked and blaming his father for giving him a problem. Nyay.

      The Malaysian government paying this for so long a time shows that the real owners of Sabah are the Sultans of Sulu. The problem arises that the Malaysian government don't wish to cede it are basically economical in nature. Ceding Sabah will reduce the income of Malaysia by 35% to 40% because of the Petronas facilities located there. People who comment here were not born yet during such time and do not hold any documents of claims. They saying that Malaysia owns Sabah should provide proof of claims. This is very clear in all phases in claims. Unfortunately, with all the consistent payments of Malaysia to the Sultans there are clear records of claims. So let us not muddle facts. For the record since 1970's the Philippines are in dispute of these islands and Philippines have had so many attempts to reclaim this Sabah through force. Now the Philippines used the legal way and Malaysia lost because they had NO documents to prove their claims. Most Malaysians may not even know that there are so many people who live in Sabah comes from the different part of the Philippines since before. And they go there freely without passports or otherwise and only use the permission from the Sultan of Sulu. Let the facts speaks for itself rather than say matters that many do not seem to understand.

      The Heirs of SULU just Wanted to involve the Philipines government regarding the dispute to COLLECT MORE MONEY FOR THEMSELVES. The heirs of sultan dont have the military power to push their rights. 5000 ringgit or 70,000 pesos they get from the rent is nothing compared to the billions of money generated by the malaysian government by getting its resources like oil. Sultan heirs want more money, so they tried to invade sabah.
      If the 14.9 billion dollars award to sultan Heirs by the arbitral ruling doesnt benefit the Filipino people and only exclusive to the heir of the sultan. . then its not worth the bloodshed. Let the sultan fight their own fight and not involve the entire Philippines government...!!

      @@dds4911 no, the territory belongs to the Philippines but the award according to arbitral ruling, the $14.9 billion with 10℅ interest per annum belongs to the "heir of the sultan" That is very specific. It is not our battle. Just pawns. The poor pays with blood. Also remember that the invasion of the Sultan troops is carefully planned for the very specific reason "to force malaysia". To " breach the contract" by not paying the rent since 2013.
      Therefore, for obvious reasons. They are after the money. the 5000 Ringgit turned into $14.9 billion very very quick. This is not our battle.

      @@DuterteBars That's wrong, the PH gov't should take all the $14.9 B because the legal rights were given to the PH gov't during the time of Pres. Macapagal in the '60s. But then again, the PH gov't should give parts of it to the 8 descendants of the Sultan of Sulu as mandated by the PH constitution.

    6:14 What do you think is the better move of Malaysia is to pay the 14 billion to the heirs of the royal family of the Sultanate of Sulu and surrender Sabah (North Borneo) and to be part of the sovereignity the Republic of the Philippines.
    Malaysia benefited so much over Sabah for the 5,000 Ringgit annually from 1961 to 2013. I think it's time for them to return what is not theirs in the first place

    What is strange is that while the oil industry of Sabah contributes 20% to the Malaysian GDP, only 5,300 ringgit is allocated as rental to the actual owners of Sabah -- the Sultanate of Sulu. The $14 billion partial compensation is obviously not enough.

      Only 5,300 ringgit but it was originally a 5,000 Mexican gold before. Malaysia is not just voiding the contract but even abusing several times for almost 6 decades without giving fair rentals to the Sultanate. Sad to say, PNoy administration didn't help the 200 Tausog warriors who tried to live and occupy Sabah in 2013. I guess, PNOy received compensation from those conflict.

    Not really language stuff but this is just too good not to share.
    Due to the Lahad Datu stand off in 2013 (i.e. when the forces of the Sultanate went to Sabah to reclaim it) Malaysia cease the payments for the lease of Sabah to the Heirs of the Sultanate of Sulu. Take note, their government itself was paying rent.
    In March, the French arbitration court favored the Heirs of the Sultanate of Sulu and ordered Malaysia to pay them a whopping billion USD in relation to the lease of Sabah.
    Malaysia ignored this.
    Just recently, Luxembourg ordered the seizure of two susidiaries of the Malaysian state owned Petronas worth $ 2 Billion as part of the execution of the arbitral award.
    Malaysia's parliament is in chaos because not only their global assets are at risk but also because they are about to lose Sabah. Jeff the french court ordered the malaysian government to pay 14 billion USD to the sultanate of sulu. malaysian court doesn't recognize it, so their assets such petronas got seized. if they will still not pay it, all of their assets will be seized to as part of execution. so yes, malaysian economy will collapse and the country will be bankrupted if they will still not follow the order

    The lease contract was for 5,300 Mexican gold per year. Malaysia converted the payment to ringgit. But the international court corrected that mistake by Malaysia and hence the reason for the astronomical bill ($15B) that Malaysia has to settle now.
    Malaysia better pay fast since the interest is 10% p.a.

Sulu Sultanate leased it to Baron Overbeck, then Overbeck transfered lease to Alfred Dent, then Dent transferred lease to British North Borneo, was then turned over to the British Crown (strongly objected by F.B. Harrison - US Gov. General in the Phil) then was included in the formed Independent State of Malaya Federation. It is still a Contract Lease from Sultanate of Sulu transferring hands

    Congratulations Malaysia! You opened the pandora box when you stopped paying rents to our Tausug brothers and sisters (i.e. Sultanate of Sulu). To make things worse for you, we just elected a compassionate and hands-on President that would represent the Kiram family to their claim. Why? Because the Kiram family are FILIPINOS and the duty of the President of the Republic of the Philippines is to make sure that every Filipino is protected from injustice. What you did to the Kiram family is injustice. You bunch of liars. You even sent your terrorists in our southern provinces.       I firmly believe....You speak the truth, Soft Lofi, about what's going on this crucial issue. In addition, Malaysia have not paid the Sultanate of Sulu clans of their rent since 2013. Meaning, if you are renting an apartment and have not paid the Landlord or the owner for 10 long years, it's time for you to vacate the property since then, or the owner will ask you to leave his or her property ASAP. All I can say is--The Sultanate of Sulu, under the Philippine Government, owns the property and the rightful owner of the Property, which in turn will be entitled that SABAH now should be given back to the Philippines. Welcome back, SABAH. You will be in good hands with with your rightful owner, the Philippines, under our new President Ferdinand "Bong-Bong" Marcos, Jr. and Vice President Inday Sara Duterte.

      I'm a Filipino and very happy to know that Sabah is legally owned by Sulu, and part of Philippines archipelago.

    Well if you really a land graber you will do everything. This is very simple Sabah is already in the possesion of the sultanate of Solu since 16th century and just leased on late 18th century by british owned company, now Malaysia was just established on 1968. This means that the agreement already exists before Malaysia was established. Therefore it belongs to the Philipines. Whose to blame are the british they turn over the land not to the owner..

British Acting Consul-General in Labuan, Mr. Treacher: "The Sultan of Brunei's territory extends, at the utmost, only to the West side of Malludu Bay, though formerly the Brunei kingdom extended as far as Cape Kaniungan, on the east coast, in latitude 1degree north.
      The remaining territory mentioned in the grants is actually under Sulu rule, and occupied by Sulu Chiefs, and it was only because the districts were mentioned in the original American grants that they are again included, and Mr. Overbeck will now have to make a separate agreement with the Sultan of Sulu for them".

Pressed fürther by Count de Bylandt with respect to the request for a Royal Charter by Dent and Overbeck and as to Britain's intentions concerning north-east Borneo, the
      British Foreign Secretary,
      Lord Salisbury, replied that his Government respected the rights of the Sultans of Sulu and Brunei and did not intend to do anything in derogation of those rights.
      Lord Salisbury added:
      "Probably, even if our response to Messrs. Dent and Overbeck was favourable, Her Majesty's Government would not go fürther than was justified by the precedents of Sir James Brooke at Sarawak, or of those
      chartered commercial companies which in former times it had been the policy of this country to establish in various parts of the world without any aim of territorial acquisition.
      CLEAR STATEMENT IS MADE IN UNAMBIGUOUS TERMS:
      "The object of Her Majesty's Government was not to set up any dominion, or to enter upon controversy with respect to territorial
      claims, but simply, if we saw an opportunity, to promote the development of the resources of the country under discussion"~
      THERE WAS NO INTENT TO TAKE CONTROL OR RULE OVER LANDS ONLY TO DEVELOP LAND!
      FUTHERE MORE:
      In any event, the Netherlands Governrnent was not unduly concerned by the BNBC company's activities in North Borneo since, as the Dutch Colonial Minister noted in reply to an enquiry raised by the Parliament in 1880, this was "simply a question of the establishment of a private Company"(By the British). Moreover, the Minister felt that the Dutch interests had not been affected by the grants given by Brunei and Sulu
      (grants to develop the land not to buy or control or rule over them!)
      THE BNBC OWN CHARTER STATES AS FOLLOWING:
      The BNBC's Charter stipulated a policy of respect of the local customs and internal
      affairs. Historical studies of the BNBC's administration confirm that the Residents were carefùl not to interfere in the life of the indigenous populations. Notably, judicial administration over the natives was exercised by their own chiefs and headmen and carried out by the village courts in accordance with local customs. Similarly, the collection of taxes was carried out by local chiefs and other native collectors. In any event, even if the BNBC had wanted to carry out a different strategy, it lacked both the staff and the financial resources
      to administer properly such a vast and diverse expanse of land5'.
      - the charter states the judicial administration of civilians was in the hands of the local rulers not the BNBC, only the real rulers have right to decide judicial matters and did not delegate them to the BNBC (the BNBC was there to develop land not to rule and make judgments)

    Because of former PM Najib's mistake of not paying the 1878 lease aggrement since 2013 to the heirs of the Sultan of Sulu, the debt of Malaysia (interest) to the heirs of Sultan of Sulu is now reaching billions and soon if Malaysia still refuse to pay more of its international assets will be seized.     This is a commercial transaction and not a state function, a lease contract between the sultanate of sulu and the British company. The Sultanate of sulu did not give up its rights, it has and it still belongs to the heirs of the sultanate of sulu and they have been trying to reclaim sabah since the 1960s when sabah was included in the territorial boundaries of Malaysia in 1963 when Malaysia gained its independence. There was an existing contract, it was honored by both parties since the beginning and it was continued on until it was breached in 2013. The evidences are very solid and clear. The annual 5300 ringgit rent from the original 5000 Mexican gold was an unjustifiable amount for renting how many hundreds if not thousands of square kilometers of land that was why the back pay when computed ballooned to USD14.9B because the value of sabah appreciated over time, this was also taken into consideration.

    All due respect to your atty.guest, you can never invalidate the rights of the sultanate of sulu in entering a lease agreement with the british company where the lease amount of 5k mexican dollars originated. Second, the recent ruling of the arbitral court solidified the authenticity of this lease agreement as a result of the heirs propietary claim. Well Malaysia should watch out once the Philippine govt will pusrue its sovereign claim over Sabah since in the 1960s the siltanate has ceeded its rights to the republic of the Philippines.

    Malaysia abandoned his case and its in default. Whatever defects of jurisdiction should have been raised by Malaysia at the earliest opportunity and by its silence, was in default. It cannot even stay the arbitration order because it has abandoned its case. The argument that infringed Malaysian sovereignty is misplaced because that is originally a private contract of lease between parties that can be legally enforced without infringing countries sovereignty. The decision is correct.

    'Lease in perpetuity until the sun or moon do not rise until end of time" is the contract to be able to use Sabah. Perpetual Lease ≠ Grant or Cede. Malaysia can only claim permanent lease as long as they pay however, Pajakkan Forever is no longer Forever since Malaysia breached the Perpetual Lease in 2013. Any Lease of Contract broken means that the property should be duly returned in favor of the owner, The Sultan of Brunei. Malaysia keeps on twisting this definition to justify a squatting renter since 2013 claim the property for herself
    Going back to the French Case, they have awarded the $14.9 Billion award, the French court agreed with the Merit of the Word "Pajakkan" as a Lease and since you have broken the condition of Lease since 1939 North Borneo Macaskie decision, The French Court decided that any Organic gains of the Property (This is exclusive of the Sabah Land Claim itself) amounts to $14.9 Billion from 1939 to this day incurring 10% penalty for not paying in good faith

    This is plain and simple problem between a tenant and landowner. Tenant stops paying rent, landowner push to claim what it is owed to them. That's why the arbitral court sided with them coz they have all the evidence(contracts, receipt etc).     The doctor Oh Ei Sun is correct that the calim is "ilogical" because on the first place there is no need for any claim since SABAH always belonged to the Sultanate of Sulu. It was never given, sold, or granted to Malaysia. So technically, it doesn't belong to Malaysia.

    Even the guest speakers of this show were hesitant of their thoughts, no one of the guests are very sure of their saying. Guilt is the KEY. The warriors of Sultan of SULU way back in 1658 had given their lives and had killed during the rebellion fight of Sultan of Brunie versus the REBELS.. those Tausug fought and being killed to restore the Kingdom of Brunie and that must be bloody during that time. YOu Malaysia should give what is due for heirs of Sultan of SULU, dont you know you have prospered and improved your lives using the resources that are not yours? Return back the property to the rightful owners, so much their lives (SULU's Sultan Descendants) since year 1658 till now were still struggling for hardship, and it is about time you have to give what is for them. What have you done is totally HARAM, as if the food you have earned from that property is HARAM, worst than eating pork.. I am Moslem also, so I know what it feels thing is robbed from the rightful owner, give back to Tausug what is due for them.

      According to the Bruneian records...The Sulus never came to aid the Sultan in the said war. So the possession of Sulu to Sabah was actually void. You need to check the writings of Brunei's history. So Sulu's claim on Sabah is actually HARAM.

      I am not Malaysian and I dont know much about Malaysian history. As a Bruneian I did study Brunei history back in the secondary school about 40 yrs ago. The one I studied somehow is different from yours.
      Back to my earlier question is whether Brunei promised to give the whole of Sabah or the eastern part only?
      In WW2, Japan conquered Sabah but retaken by allied forces then handed over to British govt. Where were 'sulu warriors'?

    Please be reminded that the lease not sale was 5300 Mexican gold pcs not ringgit. The sultanate has all legal rights and proof of ownership and likewise proof of yearly lease w/c stopped in 2013, indeed a blessing in disguise. Malaysia has to abide by the arbitration rule.

    The fact that Malaysia acknowledge that they are paying rent means an acceptance that Sabah is not their property. A virtual contract is form as offer, acceptance and consideration is provided by Malaysia and Sultan of Sulo.

    Latest news as on 6th November 2024. Paris Supreme Court rejected Sulu's appeal to overturn previous Paris Court of Appeal decision which set aside and annulled Paris Court ruling awarding Sulu US$14.92B compensation. Since Supreme Court is the highest court, the decision is final and Malaysia won.

      @Rai Key, FYI Brunei is much much older than Malaysia. Malaysia was only formed due to British presence and also land grabbing from Indonesian, Brunei and Philippine territory. Malaysia wasn't even supposed to be a country. Half of it should be part of Brunei and the other half should be Indonesian (not including Sabah since it is part of the Philippines).

    The British-made translation of the original document is to blame. Whoever created that translation made this conflict. The original document, written in the native language, clearly states that Sabah was only leased. The English translation made by the British changed this to "ceded". Both initially understood the agreement as a mere lease. When the Philippines & Malaysia became independent states, the Philippines applied the original document, while Malaysia applied the English translation of the document. So its literally an "Original document vs a Translated document" scenario.
    Also, according to one of the guest in the video, Atty Roger said that the best way for Malaysia to win this case is to invalidate the existing treaty used now by the Philippines. This means he knows that Malaysia will ultimately lose in court, & the only way to deflect that is to make-up some "historical" documents that do not exist. What a strange way to say they lost.

    Sabah is Philippines 🇵🇭Sabah is own by Brunei and later given to Philippines Sultan Of Sulu as a gift. Later rented by oil company and Malaysia to the Sultan of Sulu to exploit the natural resources of Sabah.

      My ancestor was a tax collector for the Bruneian Sultanate, until the British North Company leased the area. So the claim that Sulu owned whole of Sabah is wrong!!!

      Not the whole Sabah but only the East Coast Part of Sabah which was offered by the Bruneian. Before the Bruneian made an agreement with the British Conpany later. But the offer was denied by those Sulu. So this means Sulu don't owned any part or the whole Sabah. Please be accurate.

    Calling the arbitral ruling illogical but then seeking legal advice both internal and external. The Philippines' claim over Sabah goes way back to the time of then President Diosdado Macapagal and the current President Marcos Jr will not just "let it drop" like what you are suggesting.

The Sulu Sultanate leased Sabah to Austrian Baron Overbeck then transferred to British Prospector Alfred Dent then to British North Borneo and then to British Crown (Vehemently protested by then US Governor General to the Philippines- F.B. Harrison) And then finally with total disregard to the owner Sulu Sultanate the British included Sabah in the newly formed Malaya Federation in1963

    Oh c'mon the State of Malaysia was created in September 16, 1963. The dealing was penned between The Sultanate of Sulu and British Company hundreds of years prior. You do your research.

      I am a sabahan indigenous and im not interested to become a pilak..remember sabah is not just the land, its the people. Pilipin can make noise all they want but at the end of the day if u want to take over our land, blood will be spilled.

If Sabahans wish to follow Malaysia you are welcome to move to a legit Malaysian territory or a Sabah territory not part of the disputed lands. Just do a graceful exit, anyhow its not the whole Sabah claimed here only a part of it although its a large chunk.

    Since Malaysia has stopped the lease payment since 2013, the lease agreement should be terminated and the heirs of sulu sultan regain back their land.

    The case is very simple:
    Malaysia stopped paying their rent of 5,300 Mexican dollars as stated in the contract.
    Once Malaysia, breached the agreement, the court assumed that the property goes back to the owners ( Sultan if Sulu).
    Why $15 billion award to the Sultan of Sulu?
    Because that’s the money the Sultan of Sulu should have made from the time Malaysia stopped paying rent.

      Correction: $15B awarded because of convertion of 5,000 Mexican gold bullion a year. But this was reduced later on to 5,000 Malaysian ringgit when Sabah was annexed by the Federation of Malaysia. Gold stays in value but ringgit is affected by inflation. So the difference of value between the modes of payment considering inflation plus the rent stopped from 2013 til today
