misdemeanor unlawful discharge? How about felony ADW?
One of my undergrad students had been looking at DC adjudication, and it is very likely that despite 10 to 20 years of criminal charges, that even ID'd and caught, these guys would get relative slaps on the wrist.
'There are a half dozen changeable offenses going on: Illegal possession firearm, illegal possession of ammunition, illegal possession of over ten round magazine, illegal carry without a licence, assault with a deadly weapon (that is five slam dunks right there) or quite possibly attempted murder, and as in the case with about half of weapons in DC possession of stolen property. There is also a good chance the serial numbers are obliterated which is also a crime.
DC has spent tens MILLIONS fighting against law abiding citizens, who even with a background check, training, waiting periods, DC was attempting to ban guns totally from. DC spent millions more trying to block carry for law abiding citizens with deep background checks and extensive training. It has tried to imprison a law abiding citizen for accidentally having a single already discharged shotgun shell in a desk drawer (not a crime anywhere else and not even a crime in 90% of Europe). Yet I sat on a jury where the trial stopped when the prosecutor agreed to NO JAIL, and a "papering" of a guy with four priors who was illegally carrying an illegal gun in DC with clear gang affiliation.
I mean, I feel bad for the cops, but COME ON, this is not a Joe Biden unlawful discharge (VP Joe Biden recommended firing off a shot in the air from a shotgun, something that is this "Unlawful discharge" crime in DC where he was a resident at the time) it is GUNFIGHT between gangs firing multiple rounds AT each other.
