shivam singh , Drawer ne partly payment agar clear kardi hai within the 15 days given by the holder, toh holder has no right to file the case, also if payment is not paid case is filed against drawer and imprisonment upto 2 years and he/she has to pay double amount.

Definition of payee covered u/s 7, holder u/s 8 and holder in due course u/s 9 of The N.I. Act,1881. You said that(time 8:14) holder or payee can file a court case u/s 138 . But section 142 of the N.I
Act says payee or holder in due course can file a case u/s 138. As per section 142 of the N.I.Act I think that the holder is not competent to file a case u/s 138 against the drawer. Kindly clear the ambiguity.

Dear Sir, I have 2 questions for U ... 1. In case Holder within 30 days legal notice nahi detha hai & represent the instrument again then his rights will be intact or not? 2. If drawer agar cheque ko 2 different ink pens i.e black & blue se likhta hai to kya woh dishonor ho saktha hai?

Q. A drawer of cheque after having issued the cheque , informs the drawee not to present the cheque as well as inform the bank to stop the payment . Does it constitute an offence under the act?
