@shruti agar partly payment ke hai drawer ne tab bhi cheque dishonour mana jayegaa but jab holder case file karegaa to amount kitna milegaa balance ka double or jitna total cheque ka amount partly payment se pehle tha uska double
shivam singh , Drawer ne partly payment agar clear kardi hai within the 15 days given by the holder, toh holder has no right to file the case, also if payment is not paid case is filed against drawer and imprisonment upto 2 years and he/she has to pay double amount.
Very nice sir . I m here for penalties of dishonour NI and not for this concept because I already study it myself but i have so many mistakes regarding these provision which thankfully I corrected because of ur vedio.
Thank u so much sir , for this amazing series over this tough subject . u made it so simple and easy , most imp is that u completed and covered almost sections .

@gulnaaz agar partly payment ke hai drawer ne tab bhi cheque dishonour mana jayegaa but jab holder case file karegaa to amount kitna milegaa balance ka double or jitna total cheque ka amount partly payment se pehle tha uska double
Definition of payee covered u/s 7, holder u/s 8 and holder in due course u/s 9 of The N.I. Act,1881. You said that(time 8:14) holder or payee can file a court case u/s 138 . But section 142 of the N.I Act says payee or holder in due course can file a case u/s 138. As per section 142 of the N.I.Act I think that the holder is not competent to file a case u/s 138 against the drawer. Kindly clear the ambiguity.

Dear Sir, I have 2 questions for U ... 1. In case Holder within 30 days legal notice nahi detha hai & represent the instrument again then his rights will be intact or not? 2. If drawer agar cheque ko 2 different ink pens i.e black & blue se likhta hai to kya woh dishonor ho saktha hai?
Thankyou so so much sir ! I really had a hard time trying to understand these sections , you explained them so beautifully and with such an ease , sach bolra hu sir , agar aap abhi mere saamne hote to aapke pair pakar leta mai ❤️❤️🔥🔥
Q. A drawer of cheque after having issued the cheque , informs the drawee not to present the cheque as well as inform the bank to stop the payment . Does it constitute an offence under the act? Plz reply with you advise sir ....
Sir what is the difference between "if the cheque is delivered for collection through an account" under sec 142 sub sec 2 clause a and " if the cheque is presented for payment by the payee otherwise through an account" under sec 142 sub sec 2 clause b
sir, respondent issued a cheque to petitioner by according to their agreement. and in bank petitioner finds that cheque is dishonoured due to insufficient funds. and also respondent does not reply to the notice of petitioner given by the court to give due amount. here accused is liable under sec 138 of ni act, offence is completed. but if accused has given payment to petitioner with its applicable interests filing the case by petitioner ,,then also petitioner wants to persue the case even after getting the whole amount, but still petitioner wants to persue the case. my question is whether the court has power to dismiss the case,,because accused has given all amount with its applicable interests to petitioner. also, how we can defence the accused..? how case can be dismissed?
