  • Silvester Hayes, a 27-year-old father, found himself in a shocking and distressing situation when Dallas police pulled him over while he was driving to get food for his children in October 2021. Body camera footage from the incident reveals a case of mistaken identity, as officers confused Hayes with a wanted domestic violence suspect due to the similar spellings of their first names. Despite Hayes' attempts to clarify the situation, the encounter quickly escalated into a violent arrest, leaving him traumatized and facing unwarranted consequences.
    Subscribe for more Law&Crime: bit.ly/LawAndC...
In the aftermath of the incident, Hayes has taken legal action against the Dallas Police Department, filing a lawsuit that alleges two counts of excessive force and one count of unlawful arrest. He is seeking a jury trial, punitive damages, and attorney's fees to hold the officers accountable for their actions and to seek justice for the physical and emotional trauma he endured. The Law&Crime Network's Sierra Gillespie provides a detailed analysis of the disturbing video footage, shedding light on the troubling circumstances surrounding Hayes' arrest and the importance of addressing issues of police misconduct. The problem is these cops are trained to go into self preservation mode for their safety. If they think you are a threat to them, they’re gonna drag you out of the car cuff you and charge you with resisting. They are dead wrong here. However, the best thing to do is cooperate, and stay calm. If they made a mistake calmly, explain to them they have made a mistake. Once they run you through the system, they will realize it and as long as you stayed calm and didn’t get aggressive, they will likely let you go.

I question whether this stop was "legit". You notice how the cop said "failure to signal within 100 feet" instead of "failure to signal"? That is a common, nit-picky tactic to justify stopping who they want. I've seen a bait car that got pulled over for not signalling within 200 feet (his state's law), and after he got all the bodycam footage and his footage and got out and measured, it turned out he started signalling at 230 feet. But the cop used the "200" feet thing to pull him over originally --- even though was actually signaling for the turn. Do you know your state's law for the distance to signal (honestly, I don't and I've been driving 30+ years)? Have you ever accurately measured whether you are in compliance each time you turn? These laws are designed to trap ordinary citizens or anyone the cops deem "suspicious". Will it hold up in court? Probably. But "legit"???

I like all the comments that say, if you just comply, it wouldn't have gone that way. Bull, he was innocent he had no reason to even step out of his vehicle. They yanked him out without having any valid reason. They found one after he was cuffed. And now an innocent man has his life ruined. He has 4 kids just going to get breakfast. Cops need more empathy. The day it stops being, "it's us vs. them" and they realize, oh I can't do whatever I want; people have civil rights. We messed up, and we have to let him go. NOW, not later. That's why people hate police. They have no empathy and think they're better than the rest of us.
