    So, should I cancel my N-400 based marriage application? my I-751 is still pending and i'm 2 months away from living in the US for 5 years

    A foreign immigrant got a 10 year green card through marriage, after few months of the 10 years greencard, the US citizen Petitioner (husband) started threatening his wife, that he will withdraw the i-130 petition, please what can the wife do? And can the i-130 approved withdrawal affects the 10 years greencard given to the wife?

      If the wife properly received the green card (and the marriage was entered into in good faith), then the US citizen husband can no longer withdraw the I-130. In fact, there's not much that the husband can do at this point, and the husband will continue to be responsible under the affidavit of support requirements until those requirements end.

    If I’m divorced, do I have to provide my ex wife information on Section 5?

      Part 5 of form N-400 asks how many times you've been married, but does not ask for your ex-spouse's information.

    Hey it’s funny because at the local USCIS office supervisor said that they will red flag husband N specifically he said they won’t be able to apply for the citizenship! This happened about a year ago! Spouse actually has an incorrect category on the green card and that green card has error made by USCIS and spouse divorces quickly thinking that they have LPR when it was actually suppose to be CR1- Conditional Resident Card! How does that work?

      Great question! Yes, when a conditional resident accidentally receives a 10-year green card then they still need to apply to remove conditions. I always check for this when I submit somebody's citizenship application because I've seen it happen.

      @@DarianLaw yes but when I went to local USCIS supervisor he said husband won’t be able to get citizenship they have red flagged him in the system so how does that work?

      @@DarianLawalso one of my friend his ex-wife came here on CR1 visa but USCIS issued an error LPR N ex-wife thinks she has the correct green card but it’s not! There are 3 documents and places that clearly shows CR1 n not on the physical green card! How does I-751 come to play in this scenario?

      @@RoshniPatel-e1s That person needed to file an I-751 before 2 years of residency, even if the card says 10 years.

      @@DarianLaw that’s not going to happen because they are going by the 10 year LPR green card thinking it’s correct but it’s not!
