quick question. What is the determining factor for what state? Is it where you pay income tax? or is where headquarters are?
some companies are multi state.
Thanks for commenting, Stuart. That's an interesting question, and like a lot of things in the legal world, the answer is that it depends! It can turn on the laws of the state where you work versus the state where your company is headquartered, it can turn on whether there is any local office in your state of residence versus pure remote work, it can turn on whether your employee handbook or any paperwork signed with the company work speaks to "choice of law" issues for employment disputes. If you want to discuss your particular situation, please give us a call at (216) 285-9991.
I work for new york city job and I have accrued annual leave, comp time and sick time. I should be able to get pay for it.
I agree you should, but does NY law allow it. I also work in NY and want an answer to this. NY labor law keeps dodging the topic
