    Drivers Ed 101: Never listen to someone waving you on, and if you do, you're still liable for any accident that occurs. Seriously people, don't assume that another driver has checked that it's 100% safe for you to go

      Literally. I hate people who wave me to go ahead when there is clearly traffic still coming that could hit me. YOU'RE NOT HELPING ANYONE! Only holding up the traffic in your own lane.

      You'd think as adults, we would have learned by now that you cannot depend on anyone but yourself. If someone is waiving me on, I don't go until I see that it is safe to proceed before I take advantage of the opportunity being offered. It is human nature to be selfish and self centered. To expect that a random passerby will spend even a second helping make your life easier, is incredibly naive.

      Yes, they should put 'full case' or something on the title because in the past they didn't show the resolution so a lot of people don't bother watching them. I've only watched it 2 days later because it keeps popping up on my suggestions.

      Also, if he was significantly speeding, the insurance companies would have determined that, since they want to raise the rates of whoever's at fault, or drop them if possible. He probably switched lanes, and passed at a typical speed, which to her would seem fast compared to the stopped truck.

    I never go when someone waves for me, unless I check to make sure it’s entirely clear. This happens all the time, other drivers aren’t looking out for you that’s your job

    I'm always really careful when the front car is stopped in a double lane and waving me on when there's another lane of traffic that looks empty but is hard to tell. Very dangerous situation and I hate it. I feel awkward because the guy waving is like you're good and you don't go, but I don't know what else to do.

      Absolutely because they might be waving you on but they have no responsibility. I caused an accident and totalled my car in exactly this situation. I should not have been driving I was upset about my Dad's death and distracted. Man waved me on to cross a few lanes of traffic I went ahead and got T-boned. I was lucky no-one was hurt including me.

      I have to agree. I once saw a court case where this happened....where the plaintiff was suing the truck driver. The judge ruled that since the truck driver was the only person who had a view of all traffic behind him, he adopted the role of 'traffic cop' and was negligent in causing an accident. Ever since, I make damn sure to never wave directions to any vehicle in front of me.

      Thats just common sense. That truck isn't responsible because he waved her out. She is responsible for making sure an intersection is clear before going through it. Ill never understand why people trust random strangers like that

      But she is the owner of the car and hence the Plaintiff, therefore shouldn't have been asked to sit down. The man was merely her eye witness. This is the first time I've seen JJ tell a Plaintiff to sit down.

      @@camdaman813 Yes she loaned the car to him but he is not the owner of the car, therefore he cannot sue for damages to the car that does not belong to him. He can only testify on behalf of the owner on what happened, because he was there and saw it happen. Hence, he is merely an eye witness for the owner of the car. Do you still need anymore clarification?

      @@camdaman813 You are the one who does not understand a thing and you keep letting your ego get in the way. This case is not about the driver or any injuries he might have sustained during the crash. If it was, then I would agree with you that he was the right person to stand as the victim of the crash. This case is about damage to the car, therefore only the owner (not the driver) of the car can sue for damages to it. The driver, not being the plaintiff, can only be called upon as a witness for the plaintiff. Learn to put your ego aside sometimes and just accept that you are wrong and being corrected. That's all I will be saying on this. You are free to ramble on.

    Other drivers will wave you out of the way. They are NOT an authority figure. They don't care what happens to you as long as they get where they want to go. Always judge for yourself.

    I had a front seat passenger waving me on yesterday. The PASSENGER! I was waiting to turn right in front of their vehicle going straight ahead.
    I shook my head and waved back for them to continue through and the driver got confused when the passenger grabbed her arm and waved me through again.
    So, me sitting there shaking my head, pointing at the driver to move on and the bloke behind me starts hitting the horn then PULLS OUT and overtakes me ... just as the other driver decides to drive on after all.
    RESULT: Bloke behind me charged, Driver of other vehicle charged, passenger charged after abusing the police, and peak hour turned crazy as this accident blocked a railway crossing intersection.
    Bottom line? Learn the road rules and stick to them. Easy 🤷‍♀️

    Never ever ever blindly go just because someone waves you out. You are responsible to be able to see if the road is clear. I've seen this happen so many times.

    The defendants POV is pretty clear.
    She wanted to turn left
    The yellow truck needed to turn right but couldn't until the defendant made her left
    However, the plaintiff, behind the yellow truck, goes around the yellow truck, either because he thought
    the truck was waving him around, or because he was impatient
    Either way, he went around and had the right to do so
    Defedant made an honest mistake but is at fault.

    I think the defendant is telling the truth, he was probably behind the truck, however he still has right of way . Just because a person lets you in doesnt mean the rest of the road users will. That truck driver wouldn't be checking for hazards as he isnt performing the turn. Unfortunate situation, poor thing just got unlucky.

    When I was learning to drive, I came to a stop sign. I stopped and waved to the pedestrians to cross.
    My instructor yelled at me “who the hell made you a traffic cop? Anything happens to them, that’s on you.” Lesson well-learned.

      Many many years ago, when I was 13 in fact, so yeah....a long time ago 😂.... I wasn't with her at the time, but my friend was running a bit late to school. Instead of going under the pedestrian subway, she decided to cross the main road. Not sensible, two double lanes of traffic either way, with cars going fast on their way to work. But being 13, she didn't want to be late to school. She waited looking quickly left and right to see if there was a gap to dash through, and a driver smiled, slowed a little deliberately to allow her to cross, and waved her over to say "here ya go". She smiled back and ran across, just as a driver behind him, seeing him slowing down, decided to put his foot down and overtake him as he had every right to do. The second car hit my friend so hard she was flipped up in the air backwards and landed on the front of another car, SEVEN CARS BACK! Every car in between and either side was splattered with her blood, hair, teeth and shattered bone fragments. She survived...but only through the skills of the doctors who worked on her for the next four months. The first two months she was in a coma, but they still had to operate to open up her chest and skull to deal with massive internal bleeding. She had to have almost full sets of false teeth. Her waist length blonde hair was shaved off, mostly to get to her brain, but also it was so badly matted with congealed blood, gravel and bits of tarmac embedded through her flesh. Luckily, being 13 and only small anyway, her smashed bones healed themselves pretty quickly and thoroughly, but she needed physiotherapy for well over a year to help keep the healing intact and supported by muscles etc. She also had to have numerous facial surgeries right through her teens to reduce scarring and make her face symmetrical again.
      Luckily for you, you got lucky with your driving instructor! I can't imagine what her accident did to those drivers that day. The road was cordoned off for about a week afterwards, as they were still finding parts of her schoolbag, teeth, and broken glass in the surrounding roadside. That accident affected an enormous amount of people, from those who were on the school side of the road and saw it happen, to the teachers, her friends and family, the drivers, passengers, police, paramedics and reporters at the scene, even random drivers days later being delayed on the way to work via a temporary road diversion.
      Your instructor taught you well. 😘

Now I will never feel awkward for not allowing drivers to pressure me to hurry up and cross the road after they "kindly" slowed down to let me pass, I will continue to wait until I see no cars or they're extremely far away before I cross the road.

      @@abbiereynolds8016 Yeah! Awkwardness is the least of your worries! It's kind when drivers do slow down for pedestrians to cross obviously, a natural kind instinct, but of course their kind gesture can make the driver behind angry and put their foot down. They said my friend was lucky she was so young and small, because it's only that reason she flipped over so far in a kind of stretchy way. if she'd been a bit older with more formed bones, she'd have broken probably beyond repair. Always find a safe place to cross...even if it means walking further down the road a little way to get to it. You might hate the extra steps you need to take to get to a safe crossing, but that's better than never being able to walk again. 😘😘😘

    I’ve had people wave me out, but I still stop and crawl looking to see if the coast is really clear.
    I haven’t even finished watching and it’s 💯 percent her fault.
    Doesn’t matter how fast he was going, since he had the right of way. Period!

    Thats exactly how my first accident happened. A dump truck waved out at old lady and I t-boned her.
    Her husband showed up and kept insisting i was at fault, until the police showed up & set him straight.
    Never pull out from a side road if someone waves you out and you can't make sure all lanes are clear.

      I got in an accident doing exactly this a few years ago. I was one making left. The cars in both direction stopped and both waved me out. But someone came obscured from behind car on left and we hit on front corners. I was determined at fault. I thought it was single lane in each direction. Apparently there were 2 lanes in that direction for a portion of road and we were right were that was ending. There was no paint on ground and multiple accidents there so they've since painted road. But i got concussion and now my insurance is much higher

    It's odd the defendant said she did not pay $200 towards, but it's good for the plaintiff she made that claim, or they'd have taken $200 off the judgment as already having been paid out.
    And you can't get another functional Mazda 626 for $1250 after fees, registration, and taxes. The plaintiff is going to spend a lot more to replace the car, than to keep driving it.

      In the UK we tend to flash someone if we intend to let them out. Officially, flashing the lights is a warning of your presence, so if ever anything bad came of it we could always say we were warning of our presence.
      If you're trying to enter a two lane road and only one lane has let you through, it's up to you to make sure you got access to the other lane also, not the person letting you in.

    In Insurance Claims, we call this a "sucker hole"...She got caught in the sucker hole. You can't depend on another driver to tell you to go.

    Never ever trust someone waving at you that it’s safe to go! I have natural instinct about driving that most don’t have. We were going to visit our son & family, the light turned green & even though my husband said to go because the light was green; I hesitated. If I had driven past the light, a woman driving at an illegal speed & trying to go through the light would have hit me on the driver’s side & killed me. I have no doubts that the Lord was protecting me! The people behind me weren’t too pleased, but when they saw what happened; I imagine they thought I did a good job! You can’t trust red lights or yield signs, because people are distracted & have no business driving!! Everyone be very careful, because that few seconds of waiting paid off. Don’t risk your life!

    One the man had the right of way..and 2 unless she saw the guy stop behind the truck which she obviously didn't as they collided then she needed to wait and be sure that it was clear for her to turn. The truck driver may have stopped for her hut doesn't mean all other vehicles will especially if they have the right of way. Depend on your own judgement not someone else's when driving..

    What is interesting is that the defendant admitted to giving $250 already. This means that the judgment would have been $1050 -- however, the defendant said that the reason she gave the $250 had nothing to do with the car accident. I imagine this is precisely why JJ (who didn't believe this anyway) still opted to give the plaintiff the full value of the car at $1250. Had the defendant admitted she gave her the money expressly for the damage, I believe the plaintiff would have received only $1050 from JJ.

    She doesnt get it. You can drive in any lane you want. You can change lanes any time you want. People entering traffic have NO rights! If you follow directions from another driver, such as waving you through, WHATEVER HAPPENS IS ON YOU! DONT listen to other drivers waving you through.

    I was feeling a little sympathy for the defendant, thinking it might have been possible that the driver got mad that the truck made him stop, so he pulled around him and floored it, tires squealing. Then I heard she paid $200 "because she's going through a rough time financially," and I know that isn't what happened at all.

    What am I missing here? The defendant claims the truck driver waved her on. How could she have seen that if she was on Juniper street? The passenger side side of the truck is what faces her. That has to be a ludicrous claim on behalf of the defendant.

    I think the Plaintiff was impatient and went around the truck that had given the Defendant the "go ahead". However, when the Defendant made the turn, she should have done so cautiously, just in case someone like the Plaintiff decides to go around the stopped truck in front of him. I get the Defendant's argument, but she still was the one who had the duty to wait until ALL obstacles were cleared before proceeding.

    Wow I should have taken the last guy that did that to me to judge Judy because the same exact thing happened to me this guy who worked in a dealership pulled out in front of me because he couldn’t see me in the next lane over cause another car was blocking his view and he thought he was in the safe to go but in Florida it’s a no fault state here. So we both got 50/50 for it

    Defendant has a very weak defense. Wouldn't be surprised if the truck driver was waving because she was in its blind spot
