    I just read a family member IME report. I couldn't believe that the IME doctor noted that he viewed a video of them. He wrote things he alledged he saw in the insurance co video. My question is are IME doctors an Expert Surveillance Analyst too? Well they can't even write an analylis of a CAT scan, X Ray, MRI unless they are a specialist in Radiology. I think they are violating claimants and some attorneys let them get away with it.

      Only a judge can decide whether you are out of compliance with your work restrictions not the ime doctor

    Employers hire investigators to place a tracking device on your car while it is in a public space (such as a grocery store). They can now map your activity. Once your car leaves your home they will get an alert and have an investigator nearby notified who will start to video you and your errands. They also will place a camera on a pole (usually from a cellphone tower far away) that zooms into your home. They monitor your social media accounts non-stop (I have none). How do I know? I've been through the process. I worked counterintelligence for the Air Force and they were easy to spot. My employer even contracted off duty sheriff deputies for their fishing expedition. They were not proficient at all with their "skills". Their parallel surveillance was amateur hour. I passed the info along to my attorney and we filed a motion for discovery. The employer intel gathering we got from discovery was massive. Fortunately, I had a good attorney and I still won a L&I Pension. It turns out their actions actually aggravated my PTSD conditions and made it worse. The judge saw through it and ruled in my favor.

      You might have been following the investigator and not necessarily followed by the investigator> How? simple a small and covert GPS device on your vehicle?

      Yes, look for light standards that may have a blue, brown or white photo sensor on the top. Some of these have been replaced with sensors in the same case but also include day night board cameras which use PCL technology. Look in any Big Box hardware store for item ELC4536 with 3 prong locking. These include the photocell circuits but can be modified to power covert board cameras with lenses pointing out the small hole. The power for the camera and IR leds comes from the same power used for the photocell. It is in milliamps and not detectable remotely by the utility company. A boom truck can come by and in less than 30 seconds remove and replace the photo cell with covert camera for 24/7/365 observation. No need for vans or cars to be in the area.

    You said surveillance is perfectly legal. Well I read if the insurance co spys and video records you without your consent outside in your yard, garage, property or inside your home without a warrant that it is not legal where one exercises his/her Fourth Amendment Rights. Maybe the reason why they win so much is because claimants don't know their protected rights are being violated. There's a saying that you have no rights if you don't know you have them.

      Perhaps you need to widen the scope of how things are done in the field? It is not necessarily the actual video recording details ( Who, What, Where) but HOW do they know you are 50 miles away celebrating and dancing at a birthday party when you NEVER drove there and were Never followed there? Many people use phones, cellphones internet communication to communicate. Hhhm interesting? Do you ever "talk" to anyone? Insurance companies are not required to tell you HOW they know what you are doing ( during discovery in a court case). Many investigators do not take notes, so how would they "remember"? Do they have an "independent recollection" of those activities ? Doubtful. Ask this question WHO has the most money in any court case? A famous law professor told me this: " Crimestoppers - There is the Golden Rule of the Bible, and the Golden Rule of Law: "She who has the Gold makes the rules". This is ALL you need to know about the law.

      So sorry. I do not envy anyone who does this job. Yes it can be quite hazardous. If the injured worker is not represented, he or she may not know what to expect, fear the worst, and take violent action. I don't know of any lawyer that would tell his or her client to shoot anyone!

      @JoeMillerLaw , it happens more often than you think it does. People get tired of the b.s lies from impairment rating doctors who are not for the injured worker and someone actually shot that doctor

      @@jaytackett6545 I"m certainly no expert in criminal law, but I'm not sure that would hold up as self-defense unless the person actually physically threatened you with lethal harm. That being said, I certainly don't envy anyone in the position of doing surveillance. I have no doubt they are shot at all the time, precisely for the reason you say. I certainly do not blame you for feeling that way. It's an intrusion into your private life and the life of your family.

    I was terminated after becoming injured at work. I've never received any monies from temp wc etc. and opposing counsel for the insurance co. is dragging his feet. I need money to survive so am forced to work light duty jobs.

    I’ve had people going through garbage on multiple occasions. I’ve placed deliveries from door dash that would make detours and unspecified stops enroute to my home. I’ve had deliveries damaged. I’ve had food with hair in it. I’ve had people follow me to physical therapy. I lost my car. I’ve had people all around me all of a sudden with the same cars. I’ve had vagrants randomly walk up to me and ask me where was a workers comp office. Weird considering that person is homeless. I’ve had people call me phone looking for the emergency room wound care. I don’t work in hospital. But ironically I was getting phone calls looking for the ER department at a hospital I received surgery for my workplace injury. After my first surgery in 2018 the place where I was receiving treatment at had a data breach. I’ve received the N word texts to my phone. I’ve received hatefull voicemails in a fake African accent mocking my ongoing disability process. They’ve place baby pampers boxes across the street from my home. They’ve constantly disturbed my home thougout the day and night with loud noises from doors slamming to horns honking to pop clutches to using my house as the point of acceleration weather it be truck cars or motorcycles. I’ve had people walking on my property. They’re dogs on my property. People walking dogs by my window and dogs start barking. My AC unit all of sudden broke all the way down where it wasn’t even working. Right when the George Floyd stuff was going on. I’ve had only fans request sent to my phone. Burial insurance sent to my phone. Conceal carry weapons emails sent. Beacon NY /Dutchess County

      You may be overthinking everything? How are people going to get PAID for these alleged activities? Most investigators are lazy! They just want more and more BILLABLE hours. If they can use their brain and cunning instead of wasting time and chasing ghosts they will.

      You almost described what is happening to me. I guess they are trying to intimidate us. Ive been trhough this situacion for a year, same than you, the most were homeless and smelling marijuana. I wonder if is cheaper to pay peaople who follow you instead the medical treatment😂. At this point, i think theyve spent on me more in people harrassing me than my medical treatment 😂

      And a side foot note. I have over 50 pictures and videos of unwanted traffic and outlandish noise that’s sits around this home. Again if your going through workers comp and are in an unfriendly area the community will do everything they can to get inside your business. I have the videos and pictures to prove it.

    Questions that's happened to me but is legal to put me a GPS in my car? And what apply to that?

      It depends on what state you are in. In VA, a private investigator is allowed to put a tracking device on a vehicle, but only with the owner of the vehicle's consent. Otherwise, it's illegal.

      @@christopherjones7167 I am not admitted in those States, and since workers compensation law is different in every state, I cannot really speak to your question. I can just tell you that in some states, such as North Carolina, where i AM admitted, there is something called a Form 90 that either the adjuster or defense attorney will occasionally send out to the injured worker or his attorney. The Form 90 is often sent when the injured worker is receiving workers compensation checks and it is a simple form whereby the injured worker is bound, under the law, to disclose any income he may be earning at any job by way of that form. Any attempt to hide or be deceptive about your income while receiving worker's compensation money would likely be sanctioned by the Commission, result in a dismissal of the claim, and also subject the injured worker to CRIMINAL prosecution. So even though I'm not admitted in PA or DE, I cannot imagine that it would not land you and your claim in a world of hurt--or even in JAIL-- if it was discovered that you were earning money while receiving your comp checks, and lied about it, or attempted to conceal it. I recommend that you talk to a competent worker's comp lawyer in your state.

      I’d think the company would be. You could have refused to do that based off doctors orders tho. Talk to your comp representative and managers.

      I'm sorry that happened to you.
      If someone is in this position where they have restrictions and your employer is unwilling to accommodate them or unable to accommodate them, you should stop working and demand temporary disability benefits. If the insurance company fights you on that then you need to file for a hearing ASAP. They cannot make you work above your restrictions.

      You need to go out on TDD possibly. You should seek legal advice a workers comp lawyer and remind your work place you believe you shouldn’t Be at full active duty . If you don’t look into it and get legal advice you could be doing yourself a disservice and hurt your case / situation at work . Good luck

    Workman comp is a joke on you,they well hurt you more, over,over, lawyers want help you or lieing ombudsman, if you get hurt bad,workman comp protects your employer from being sued and screws you .

      @@crimestoppers1877 Thank you for the comment. After 6 years, the insurance company wants to bribe me for 2 hearing aids, and I did not accept it. So far, I have changed three lawyers, because all those lawyers are on the same front with the insurance company. They just drag the case so that I drop this case. All these lawyers, despite my strong insistence and emphasis, do not let the insurance company come to the final trial (the last lawyer even interrogated me for 2 hours). Please let me know if you have a solution. 🙏🙏🙏

      Yes, but it is a VERY bad "joke" which costs lives for the benefit of the few who control this circus. Approximately 5% of the W/C premium dollar actually goes to pay the mandatory indemnity benefit! Five pennies to the injured worker and 95 cents to the rest of the party. When you walk into the typical applicant attorney office do you see office help crying or lawyers upset about the literal hell your are experiencing. IMHO most attorneys have a door that is like a turnstile at a circus event. Each click of that turnstile is one more benefit lien check, someday in the future. Insurance companies have TOTAL control to accept deny delay or dribble out a few bucks whenever they please. It is ALWAYS THEIR MONEY! So why pay a "dirtbag" ( their term) or scofflaw ( their term) or "lazy bum" ( their word) when they can keep it?

    I going for surgery need 2 artificial disc put in and a IME cut my benefits in half so I have a hearing to restore that How do I know if they have a video of me walking my dog getting groceries in or whatever else. Do they have to tell you before the hearing I don’t want to be surprise tell me what you got and I explain myself I wouldn’t let them cut my neck open and rearrange my body if I wasn’t in pain and if I brought groceries and so be it no one else is going to get my groceries in

      I always have to preface that i do not know what state you are in, so i really cannot address the specific answer unless your case is pending in VA or NC. All i can tell you is that in VA, pursuant to discovery that your attorney would send to the defendants, they don't have to tell you about any surveillance until after they take your deposition. This is so they can preserve your testimony vs. any "gotcha" videos of you. I always tell my clients to just ASSUME that you are constantly under surveillance while the case is pending, ESPECIALLY if there's a hearing coming up, and not to lift or carry anything that is beyond the physical restrictions set by your treating doctor. For instance, if your restrictions are no lifting more than 5lbs, and you are videoed carrying in a 12-pack of Coke and a bunch of other heavy stuff, the defense can show that to your doctor, and there goes your credibility and potentially, your doctor's support of your claim and your physical restrictions.

    Can u still be under surveillance after u settled a signed a Comp and released on a worker comp case?

      So I have never seen it, and if you are not in VA or NC, I cannot really say because i dont' know your State comp Laws. But in VA and NC we advise our clients as follows: Signing the comp release or paperwork means NOTHING. Until the Settlement Award Order is APPROVED AND ENTERED by the Workers' Comp Commission, PLUS 30 days pass, you are technically not out of the woods yet. Technically, at any time until those 30 days pass after the Award is Entered, the defense could move to VACATE or CANCEL the entire settlement. For instance, if you settled based on the basis of you not being able to work and someone who has surveilled you called the claims adjuster and told him or her that the investigator saw you working your new job. If this took place before the 30 days were up, the defense could move to vacate on that basis. We actually tell folks, even after the 30 days, if you haven't yet received your check, wait until you deposit it in the bank and it's cleared before you start a new job. Just to be sure. Hope that helps.

    I have a knee injury,but my Doctor said I can go to the gym.I don’t do any leg workout just bench.Oan I haven’t had my surgery yet
