Hi Im beeing sue for selling a "suppose" copy of a patented product that some company give me years ago for a job. I used this but it left some more.. I dont know what to do, Am I guilty?, how can defend by myself. I dont havee money for an attoney service.😢

Hello there, i want to say that your video was very informative as well helpful, however i have a question on the situation when an individual HAS infringed on a copyright. If you have been subject to copyright infringement and you respond back indicating that you didn't know you infringed on that item and you will remove and destroy the item/items do they have a right to ask for proof of you destroying the item as well for you to ship them the items if they haven't been destroy. Moreover, do they have a right to ask for sales proof and documents? if you can help with this information that would be greatly appreciated

Hi, I have a question: I made a negative video review about a product in which I shared info about the company I thought to be true and factual at the time. Later, they sent me a cease and desist letter via email pointing out several specific points in my video that they claimed were not true. Though I disagreed with some of the points, I took the video down out of fear of getting sued. My question is this: would it be okay to make a new review video omitting ANY specific company names and just covering the type of product in general? (As a random unrelated example, rather than saying "I don't recommend Nerf guns because of XYZ" I would keep it general to "I don't recommend toy guns with foam darts because of X" ...I wouldn't be naming their specific company or product name and I would not mention the specific points they had put in their letter anyway. Can a company tell you to cease and desist, if you're not even directly referring to them, but just a general product type? I feel so frustrated because I feel very passionately about my thoughts on this product, as a past user. I want to warn others to reconsider before they invest in this expensive product and potentially become harmed, but I'm afraid to speak out and feel like I'm silenced. If you're unable to answer this via a comment, how could I reach out to you to learn more? Thank you for your time!
As I mentioned in the video, cease and desist letters are not legal filings or lawsuits but are written requests for specific actions. For example, suppose you did a product review (meaning you purchased the product as a consumer, had a negative experience, and created a video giving your honest review of the product). In that case, you have the right to do so regardless of whether the company agreed with your statement. If your review was honest and based on your personal experience, there was no need to take the video down. However, if your negative comments were not genuine or honest, based on your personal experience with the product, or filled with non-factual statements, the company has a legitimate reason to request the video be taken down. For review videos, just like a review on google or yelp, you can talk about your experience with the product and your opinions based on the experience regardless of whether the review is positive or negative. If you want to modify the review to address the specifics of the cease and desist letter you received, that is fine. Based on what you shared in your comment, my opinion is that the company did not like your review and wanted to scare you into taking it down. Based on what you've written, I cannot determine any legitimate basis for why you should have removed your review.
