Sentencing guidelines always take into consideration whether the defendant(s) take responsibility for the crimes and show genuine remorse. In the Shah case she admitted to the atrocious crimes she committed and also showed remorse. In addition, it’s my understanding that she will have to pay restitution to her victims. This couple have continued to deny any wrongdoing or responsibility in what they did & to this day are still claiming that they were victims as well. That’s why their sentences weren’t reduced. People who willingly plead guilt are usually offered plea deals for lesser charges and reduced sentences because it avoids the time, cost, and emotional trauma by witnesses and victims that testifying in court causes. If I remember correctly, their crimes didn’t hurt or affect any victims. It was basically crimes committed against lending companies and banks for falsifying income, etc. Which is ironic because banks, lenders & the like get away with F’ing over consumers on a daily basis. Jen Shah’s crimes screwed over a lot of older retirees who ended up losing life savings. Her sentence deserves to be much longer even with time off for admitting guilt. I don’t believe in giving reduced sentences or time off for ‘good behavior’ admitting guilt, or testifying against a co- defendant. All the individuals involved in these con jobs are very wealthy and have the means to hire top notch teams of defense attorneys. These attorneys may seem like slime balls to many of us but they are usually extremely successful because of their superior knowledge of not just the law but specifically, criminal defense law. In addition, most of them were state prosecutors for many years prior to going over to the other side. They may believe that their client is guilty but as their attorney they’re required to do just about anything possible (within the confines of the law) to give them the best defense possible. If that means pointing out technicalities, using archaic laws from 1905, or case law rulings that effectively prevent the prosecution from being able to use evidence, then that’s exactly what they will do. And that’s what makes a great criminal defense attorney. Their clients are required to give huge deposits and replenish them as work is done in their behalf, so their attorneys are definitely motivated to work hard at defending them, guilty or not.
