Hi Sir. If the accused is absent on the day of Judgement, Under which provision should we file the absence petition. Please clarify the doubt. It's not 317 Crpc.

Sir, in every criminal case Judgement the accused definately needed to appear before the court on judgement. If he has any special permission from the appellate court that his attendance is dispensed from the appellate court, the accused can absent on Judgement. But that can be possible in summons cases only. Please read section 353 of CrPC. You will get full information Sir. Thq

Your cousin filed a petition for cancellation of NBW order issued against him and the same was allowed vide crlmp 354/23. That means he explained to the court why he could not appear in the last adjournment.

@@ravindranathadvocate625 And 2 days back one of the main accused called me and asking me to close the case and offering certain amount. How can we close this suit by good approach. And also I want to know why he is asking to come settlement to close the case after 6 years. Is the case is becoming very tough to him and is there is any chances with imprisonment to him??

1) Sir u can file 109(2) Civil Rules of Practice for advance of csse.
2) u cam file section 451 of CRPC for return of document in criminal cade. Order 13 rule 9 of CPC in civil cases for return of documents.
