    We filed for bankruptcy and trustee is saying our 2 front home 3room apartments (not rented now) be exempt from homestead act.

    Awesome content appreciate the one question I have I can't seem to find out is. If only one person files for bankruptcy and your married both jointly on the mortgage how does that effect your spouse?

      GREAT question. From my understanding you can file a bankruptcy independently and it would only affect the debt in your name. However you would need to disclose your spouses income for Chapter 7 qualification and to calculate your repayment plan if you do a Chapter 13.

    I know this is 2 years later and I do apologize, but I have to know something. What if my house is paid for completely paid for and it was give to me and it was put in a laugh state. Deed would that affect bankruptcy? In any way? Form of fashion or would I lose? My home

    If I sale my home after I file bankruptcy and my equity is 275000 will I lose my equity ? If yes, how long do I have to wait before I can sale without losing my equity?

      Hey Aztec, it most likely depends on your state's homestead exemption. For instance, in Texas, you should be able to file Chapter 7 and protect all of your home equity.     I’m under a bankruptcy, I do not have homeowners insurance, can I be foreclosure under a chapter 13

    So my question is how long can you stay in your home after all debts including mortgage have been discharged? It’s hard for me to fathom that you can stay in the home indefinitely as there is still a mortgage lien on it correct?

      You mortgage debt can only be wiped in a bankruptcy if you give up the property making it an unsecured debt. If you keep the property the mortgage would still be a secured debt "secured" by the property. If you don't pay on it you may lose it in a foreclosure
