    My husband has warrant arrest we married in Texas and we fly back to phillippines now he is in his country and he face of charge I was so worried because our son 3yrs old are with him and he want me to petition back to Texas does it's complicated and what he should do with this he supposed to detain our son will leave to his parents, 😭 somebody give me some knowledge about what to do

    Could you guys help someone who was convicted with possession of cannabis 1oz or less so he doesn’t have to leave the USA to wait for the waiver to be approved? This guy is married with an American citizen for 9 years and has 2 kids with her.

    Permanent resident who has never left the county and has one parent us citizen. After 10 years are up Could an i90 renewal be denied for a 2grams marijuana (with withhold of adjudication) charge and a marijuana dui charge (reduced to reckless driving with adjudication and probation)? Both charges are from one single incident/arrest.

      In our experience, the I-90 is typically not denied in such circumstances. However, we strongly encourage you to seek consultation with a trusted immigration attorney before taking any action in your case, including filing an I-90, to get specific information and advice about your particular circumstances.

    It’s been 10 years since I was arrested for possession of a controlled substance. I’m still being denied citizenship for some crumbs of a substance I had on me. How long is long enough to show good moral character. USCIS deceives applicants when they don’t include possession of controlled substances as a crime that will NEVER grant citizenship. They told me I had to wait 5 yrs for the good moral character period and even after 10 yrs they still deny me. I’ve not had so much as a parking ticket in that time. I pay my taxes, been married for 7 yrs and have two daughters. But for some mistake I made 10 yrs ago they continue to deny me. It’s scandalous. Drunk driving is ok, but god forbid you have a substance that keeps you fully aware and awake because that’s really bad. Pfft! How long is long enough to show good moral character? 20 yrs? 50 yrs? Forget it

      So sorry to hear that you’re dealing with this. The legal good moral character period for naturalization is five years. However, USCIS does have the discretion to look back beyond that amount of time for certain things. In our experience, filing a lawsuit to transfer the case to federal court can be a good strategy for getting a more reasonable application adjudication.       My brother was charged with sales of a controlled substance over 10 years ago in california. And was held in texas by immigration he is a permanent resident. Can he fight the case?
