      Only if used during trial as evidence of guilt. Like if prosecuting attorney says something like "during interrogation you refused to answer questions without a lawyer present. Why would you need a lawyer if you're not guilty?" At least that's how I understand it.

      @@03ai_ey it’s a pretty simple answer to that question. Why didn’t I answer questions without a lawyer if I’m not guilty? Because it’s my constitutional right, and because you never trust a cop.

      @@peterblack_ I think that you misinterpreted what I said or vice versa... I'm having difficulties parsing out if you're arguing. I was saying it keeps the jury's opinion from being influenced by the asking if the question in the first place. Also if someone didn't happen to have a good answer come to mind for whatever reason, your use of your rights won't end up as evidence of your guilt. Cops are allowed to lie to you and ask whatever they want in an interrogation, that's their free speech, but your answer to that cannot be brought up in court to help prove your guilt.

    • @peterblack_
      @peterblack_ Рік тому +1

      I guess you'd have to argue how coercive it is, but I'm not immediately finding anything. The cops can't pretend to be your lawyer, but they are allowed to lie. From my understanding, they're at least allowed to imply it. Like, "you're not under arrest. I don't think you need a lawyer if you didn't do anything." Which is given as advice to not believe, so my takeaway is they can do anything other than pose as counsel or deny counsel after a reasonable request for a lawyer.
      And cops wonder why people don't want to talk to them, anymore...

When I was growing up, school superindentant got busted for embezzling something like $1M (which is a LOT for such a small town). My former DARE officer got busted for burglarizing the local video store. There are so many patrol officers, they just spend their time harassing anyone they don't like (I was someone they didn't like). They lock up children for extended periods of time for petty crimes (I was one of those children). And yeah, town is racist as hell. All the factories pay shit, and the county lets them just dump shit in the ground. It's small-town hell-world.

    In a lot of these interrogation reactions, chat (and the comment section) will spam “lawyer!” Ideally yeah, you should always ask for a lawyer during questioning, but sometimes in reality it’s not so cut-and-dry.
    Back in the day I had some legal trouble over some dumb shit that I did, and when I got scooped up by the police and sat in front of the detective, I knew perfectly well that I could request a lawyer, and that it would probably help lessen the overall punishment on the other end. At the same time, I HAD to work the next day, or risk losing my job (or at the very least, end up coming up short on paying my rent which was already behind…), blah blah blah basically there was a very real chance that if I didn’t make it out by the following day for work, I could end up homeless very soon.
    So I knew that I could request a lawyer be present for my questioning… but I also knew that it would drag out the whole process for wayyy longer. On the other hand, I could just go along with the questioning, basically confess to what I was being accused of, be charged, spend the night in jail, be arraigned in the morning, likely be released O/R (aka get out without having to pay any bail) since it was a first offense and I didn’t have a record, go home, shower, and get to work on time the following afternoon. Get paid, pay rent, go to court a few weeks later and deal with whatever repercussions came my way.
    So that’s what I did.
    I was in a crushing cycle of poverty (which had put me into a position where I felt like my only option was to resort to stealing; the crime I was arrested for was stealing by the way)… and so despite having basic legal rights - and _knowing_ them - I was precluded from being able to assert those rights because of my shitty circumstances. D:

      This sums up the ENTIRE cycle of poverty and crime so well. Not getting a lawyer because you can’t afford a day off of work, let alone the crime being committed because of poverty in the first place. God forbid you were to end up houseless because you need an address and working phone to get government assistance too. The cycle is so obvious and crushing, especially when you mix racial discrimination into most cases.. idk how people can still deny this.

He's not a murderer because he has anti-social personality disorder, his supposed personality disorder and his upbringing led him to be that person. Nature and nurture both play a role.
    People who don't feel empathy can still understand compassion. They just can't place themselves in other people's shoes, but they know the concept of it, they objectively know right from wrong, and can learn to predict the outcome of their actions before acting out on any malicious intent.

      @@itsmeayat0-045don't tell him where you're going to university, if he does reveal anything to your parents chances are he's going to prison for distributing CP, assuming you're talking about pictures.
      If he shares stuff with your parents just tell them it's AI generated and he was threatening you, and you thought it would save them from shame to keep it hidden.
      Might not work but it's worth a try.
      Maybe see if you can get your parents to move with the excuse of being closer to the university?
      Explain what AI generated images are first and maybe you can just tell them this guy has been blackmailing you with AI generated images for the whole time and get them to protect you.
      If none of that works, try to slowly fade out of his life. Rarely reply to messages, try to make him bored.
      When you leave the house try not to go out without a friend with you.
      From my experience with stalkers, the feeling of being watched or followed can be very real.
      Stay safe. Good luck.
      Wish I could offer better advice but just rely on the fact that your family probably doesn't understand AI that well and you can use it as an excuse for anything they would attack you for.

    There’s an important delineation that should be made when talking about ASPD and psychopathy. Psychopathy refers to a person with ASPD who does not feel empathy. Therefore, all psychopaths have ASPD, but not all people with ASPD are psychopaths. In fact, it is only a small percentage of people with ASPD who are psychopaths. Thus, the chatter who said that they have ASPD and do feel empathy could very well be truthful - that would just mean that they are not a psychopath.

    sometimes hasan has to understand although 9/10 chat is being complete morons, some chatters have something worthwhile to say. 1:21:04 having antisocial personality disorder (aka, as hassan points out, psychopathy) does not mean that person will murder someone. plenty of people live thier lives with this disorder and do not seriously harm or kill anyone. ASPD presents with irritability, impulsivity, deceitfulness, and may be quicker to aggression, along with a lack of empathy and regard for consequences. this results in a higher amount of arrests related to destruction of property, harassment, or even in some cases assault. not every person with ASPD is the same. sure, some people with ASPD are violent. chatter was only pointing out the way they always go “THE CRAZY MURDERER HAS ASPD” and ASPD gets blamed rather than the individual. y’know.. the murderer. love this quote from my textbook ~ it is important to remember individuals with mental illness are not automatically dangerous, and dangerous individuals are not automatically mentally ill”

      From Mark Fisher's Capitalist Realism:
      "The current ruling ontology denies any possibility of a social causation of mental illness. The chemico-biologization of mental illness is of course strictly commensurate with its depoliticization. Considering mental illness an individual chemico-biological problem has enormous benefits for capitalism. First, it reinforces Capital's drive towards atomistic
      individualization (you are sick because of your brain chemistry). Second, it provides an enormously lucrative market in which multinational pharmaceutical companies can peddle their
      pharmaceuticals (we can cure you with our SSRIs). It goes without saying that all mental illnesses are neurologically instantiated, but this says nothing about their causation. If it is
      true, for instance, that depression is constituted by low serotonin levels, what still needs to be explained is why particular individuals have low levels of serotonin. This requires a social
      and political explanation; and the task of repoliticizing mental illness is an urgent one if the left wants to challenge capitalist realism."

      Yeah type B personality disorders (narcissism, antisocial, borderline) are widely misunderstood and have a terrible reputation. "Psychopathy" isn't even a thing anymore and our understanding and diagnostics have evolved since then. A problem is that research is often done on extreme cases which back then were violent criminals... and nowadays you only hear about extremes on social media too. The stigma that comes along with these diagnosis really sucks, I've had friends that were harassed over it... :/ On one side it's important to be open about it to change things but there's a lot of bad stuff that comes from it

    I live in Australia and know of a similar case to leigh Anne's "suicide". This guy went missing for like 6 years before his skeleton was found. He has been shot in the back of the head with a rifle (about the same size as the one in Leigh Anne's case) and the empty bullet casing had been unloaded before being stashed, in a rockface, 10 meters from where the skeleton was found. The concluded that he probably shot himself, unloaded the casing, stashed the gun and crawled 10 meters away before dying. the case was never actually closed as a 'suicide' because of "unusual circumstances". There's backstory and such to the story but just that is unbelievable to me.

Meaning people diagnosed with ASPD are NOT automatically sociopaths or psychopaths, but (clinically diagnosed) psychopaths and sociopaths are automatically also diagnosed with ASPD on an extreme end of the spectrum.
    There has been pretty positive results of early intervention and therapy helping kids and young people with ASPD with learning empathy. But unfortunately ASPD statistics will never be completely accurate, because when you do get to that extreme end of the spectrum, those people refuse to believe there’s anything wrong with them and they would never let themselves be psychoanalysed 🙃

    1:20:54 no this chatter is right. Antisocial Personality Disorder in a clinical sense is not a 1:1 (or even close) to the colloquial understanding of a “sociopath”. APD is honestly one of those bullshit Foucault ass disorders that exist more as a tool of the state than anything. I almost got diagnosed with it bc I told my counselor I stole a juice from my college library’s cafe and didnt feel bad about it. At it’s core all antisocial personality disorder means is that you don’t prescribe to the morality of the state. So if you don’t have any moral qualms about petty shoplifting, graffiti, skating in skate-free zones, or you get into fights at school, skip school etc, that’s _more_ than enough to be diagnosed. There are a ton of people with antisocial diagnoses that are no different than any of your “troubled youth” rebellious friends as kids. No doubt Brace Belden would’ve qualified for a diagnosis in his teens and I wouldn’t be surprised if he still does. It’s impossible to really get into in a youtube comment but chatter was right for once. The whole pop-psych industry around “the dark triad” etc is all bullshit fear mongering. It gives consumers something to have fun being afraid of at the expense of real people’s humanity. What we understand as sociopathy/psychopathy probably should have it’s own diagnostic criteria tbh. But right now the term is so useless it can’t differentiate from your anarchist friend that protests police brutality and does graffiti and a serial rapist.

      @noThankyou-g5c Рік тому +2

      and before somebody tells me what the exact definition on APD is. I know… thats why I said it’s way too complex to get into in a youtube comment. The reality is, _in practice_ all APD really means is that the person diagnosed with it doesn’t have moral objections with breaking societal rules - and interpreting what societal rules are serious enough to warrant that diagnosis are totally up to the clinicians discretion. If you tell your psychiatrist you don’t think it’s wrong to like… write graffiti that is enough for them to diagnose you.

    • @noThankyou-g5c
      @noThankyou-g5c Рік тому +3

      1:24:17 one of the reasons antisocial personality disorder is so overrepresented in prison is specifically because by the definitional nature of the disorder: committing a crime without remorse means you fit the criteria for APD. If you sold weed and dont feel bad about doing so. You can get diagnosed. The disorder is fundamentally inseparable from the ideology of the state which prescribes it.

    • @smears6039
      @smears6039 Рік тому

      I thought it was more of a lack of empathy thing, and the crimes are somewhat a result of that. Like if one has no empathy for other people, they would not feel bad about robbing or whatever it is. That being the case, APD persons can still feel love, form strong relationships, and value human life, they just do it in a different, more conscious way than neuro typical people.
