    Been dealing with this for almost a year. I was hit in a parking lot by a girl going full speed and not paying attention. Her insurance company has already admitted she is at fault. My car was totaled. Life flipped upside down. I've been suffering from chronic back pain since the accident. I'm 28 years old and now it hurts to walk and sleep. I've been doing treatment with a chiropractor, physical therapy, and finally a spine and pain doctor who wound up burning off some of the nerves in my back.
    I've kept detailed records of the injury and my attorney is putting together the demand letter. I am so nervous for the outcome. This has cost me a year of my normal life and thousands in medical bills. I mean what is that claim worth? I'm not sure how it will go. I just hope my attorney will fight for me. Great information to the public. I had no idea about any of this. The only reason I got an attorney was because the insurance company kept putting me off. They responded immediately once I got an attorney involved. Funny how that works!

      You know, if you're dealing with a shady insurance company, lawyering up is the quickest way to get their attention, and let them know you mean business!
      When dealing with what your claim is worth, there's a ton of factors at play, but some include cost of treatment, loss of income, and pain and suffering. Your attorney should be able to guide you through this, as part of the demand process.

That's why, when there is a major loss or injury, we strongly recommend getting a great law firm (like mine) behind you, to make sure you don't get played by these guys!

      To be fair, there could be a number of things going on here. On one hand, maybe you're right, and your lawyer just isn't being aggressive enough on this. On the other hand, it's possible that your case may not be as strong as you think it is, available insurance coverage limits are hindering a full recovery, or a number of other factors.
      Unfortunately, in many cases, an outside attorney can't consult on an active case without direct cooperation from current counsel. So you're going to need to have a discussion with your attorney to try to ascertain what is really going on, and why that number is lower than you think it should be.
      It's also worth noting, that if you do leave your current attorney, you may be liable for attorneys fees on your case (often either directly billed or as a lien on your case), so that's a thing to consider. Check your contract with your lawyer (would likely be in some paperwork you signed at the beginning of your case), and see what the termination clause looks like.

      I have shopped around for lawyers 3 times in the past couple years, and I’ve learned that some firms are in a big hurry to sign up clients as long as you can give them just a couple documents to support your claim, but other firms ask MANY more questions and want MUCH more documentation to review before they decide whether to take you on as a client. Which type was your lawyer when you first signed up? I suspect that the difference is that the second type fights for every dollar, and needs to know that they can win in court before they risk losing out on a settlement by playing hardball.

      @@thomasconnors4338 I think this is a really spot-on take. We tend to be the latter: we only take on cases that we know we can win, and we are willing to fight for every dime. As a result, our intake process is pretty intense. We ask a ton of questions, and usually get the police reports before we officially sign up a client. There are firms out there that just try to sign clients up en masse, and will go through the motions of filing a claim, but not really fight for them, because they don't have strong evidence or a good case, so they just try to get something done and walk away.
      The book I linked in my previous reply has a ton of great questions to ask a lawyer before hiring them. Definitely worth a read.

    Very very good explained! My car got hit when I turn to my neighbor street and the guy drove straight to hit me on the turning lane that has a sign say right lane must turn right and yes I yield and didn’t see anything on my windshield but this car came from behind the other car and take off and hit me. I have a ticket that police officer said I failed to yield but I don’t know how I gonna do that I stop and looked at the windshield and seen nothing then the car came from behind and break the law straight to hit me in front, not T-Bone. Now I just wait for an insurance to help but insurance never ask me about what happened but just tell me to find the shop and get estimate cost to fix, if it too much it will be total loss but no shop around will take my car now because they are busy and my car is in tow yard that charge every day. In this case the insurance will pay me for towing and parking at the tow yard right? The adjuster only tell me to get the shop first and start from there and tell me that I have deductible but I’m not supposed to pay right? How I can do in this case?

      The short answer here is that what the insurance is required to cover by law varies from state to state. The first suggestion I'd make is to talk to the insurance company and figure out directly from them what, specifically, they are covering. If their answer doesn't sit well with you, find a local attorney that handles motor vehicle crash property damage cases, and see if there is anything you can do.

    If we were not injured in accident, can we still get compensated for filing a non injury claim? I did so many years ago and was giving $500 by other insurance company, is there a term for this ? Thank you

      The most common claims after a car crash are property damage and personal injury; however, sometimes you might run into things like rental re-imbursement or loss-of-use claims. Honestly it depends on what your state requires of insurance companies, and what the policies held entail.

    How about if both were found at fault but there insurance are sending me a subjugation letter for payment of his damages what should

      That's a tough question to answer without knowing all the facts, but I can offer you some generalized tips here:
      Generally speaking, it's usually wise to respond to a subrogation letter. If you don't reply, the alleged debt could end up in a lawsuit and/or collections.
      Also, if both parties were equally at fault, there probably shouldn't really be a claim there in the first place. It all really comes down to how your state handles comparative fault.
      The best thing I can tell you to do is to reach out to your own insurance company about this, and tell them about the subrogation letter. They'll be able to advise you on how to handle it. You may also want to reach out to a local personal injury lawyer, especially if you were injured as well.     I have a question over a car accident . I was t bone while driving on the far right lane. Its was a 7 lane road with 3 on my side and 3 on the other side and one in the middle lane for cars to get in and out of driveway.
    On my side of the raid there was traffic on my left two lane and my lane was clear to the light. I was drive about 30 in a 40. It seem like the jeep just went threw the cars on lane left of me. I didn't see enough space gap that would let me know the car was passing across.
    We both have the same insurance and my adjuster want me to give a statement to the other parties adjuster. Should i do it?

      Long story short, it depends. Generally speaking, I advise people to avoid them whenever possible, but sometimes it's required, especially by your own insurance. See if you can provide a written statement instead. If they insist on a recorded statement, consult your lawyer.     Quick question , I slipped and fell at Sam’s club 17 weeks pregnant went straight to the er after to check on baby, everything is fine just my body is super sore and I had to miss work. Walmart called me Monday to settle for 1500

      @@mosieliza817 if you didn't get medical treatment or have injuries, then your damages are usually minimal (and it's a good thing if you didn't have to suffer any serious permanent injuries) BUT it's always a good idea to get checked out by a doctor just in case since some injuries are not obvious right away.
      Look at how much work you missed or any other losses you experienced and compare it to the 1500. It may be adequate compensation in your case, I don't know. But on the other hand, since the insurance company made an offer on its own, you may have a chance to negotiate for something more - with or without an attorney. Without high damages, you may be better off handling it on your own, but I always recommend getting a free consultation with a lawyer located in the area where the incident happened. They may have some insight into what to expect and how to get the best outcome. Or they may tell you that $1500 is way too low and that it would be wise to hire a lawyer

    Hi, my boyfriend recently got into a car accident. He was driving behind 2 cars on a hwy in a construction zone with a safe distance from the car in front of him (approx. 7-8ft) . The hwy was reduced down to single lane. The first car hit their break suddenly and the car behind ( or in front of my boyfriend) was a little too late to realize so she hit her break very hard ultimately not giving enough reaction time to stop. He ended up rear ending her. His car was severely damaged with a bent hood, broken bumper, damage to radiator support , potential damage to radiater and his headlights. Now he is unable to work unless the car is fixed, he is worried it will most likely end up getting totaled. He said he hit his knee on the car trying to stop in time, but told our insurance comapny its not a big deal as of yet , but will reach out if it gets worse. As his car was the last car, he was deemed as ‘at-fault’ and nothing was covered not even a tow as he was only paying 3rd party insurance. Do u think it was fair deal as he didn’t get full insurance? He told the insurance comapny that he doesn’t consider it as his fault as the driver in front pressed the breaks so abruptly that it didn’t give him enough to stop in time. And the driver in front agreed to this on scene as well. But the insurance company wont listen. He spoke to the adjuster and they refused to provide any help.

      The unfortunate truth of the matter is that because he was unable to brake in time, he's most likely at fault for the accident with him and the second vehicle (and if that impact caused a secondary impact on the first car, he may be partially responsible for those damages). A tailing car in a multi-car pileup is responsible for making sure they have enough distance between them and the car in front to be able to react in time when these things happen. There can be exceptions that could apply to this, which can vary by municipality, but they are typically pretty rare.
      Insurance companies typically won't pay up if you are at fault. I don't know if "fair" is the right word to use here, but it is reasonable within the system we have today.

      @@BurgerLaw I understand, we agree he was somewhat at fault here but were hoping it wouldn’t be his fault entirely. We argued why would anyone stop their car abruptly on a highway but thats how the system works i guess. He’s paying for the damages to car he hit through insurance.

    If my insurer has worked out a settlement for my totaled vehicle from an accident (I wasnt at fault)
    Am i supposed to be further negotiating anything else w/ other parties Adjusters since they call in regards to damages comp & rental needs? Would hate to 'double dip'

      It sounds like your insurance company has your property damages handled. If you weren't injured, you're probably set. You may want to reach out to your insurance company to double check. Beyond that, if you were injured, then you would need to deal with the opposing insurance company, and possibly get a lawyer involved.

      @@watchthis.5094 Unfortunately, we're hitting a point where I can't provide specific advice, due to my limited knowledge of your case and other variables. There are a number of factors at play here, so don't consider this proper legal advice. If they're offering to pay for it, I don't see a problem; however, there could be factors preventing that with your insurance company's settlement agreement.
      TL;DR, it's probably fine to ask, but I can't guarantee it.

    My mother got into an accident 2 years ago in Covid it was a Uber accident while she was a passenger so it’s 100% not her fault, that’s already guaranteed. but we partnered with one of of her patients who was actually a lawyer (our biggest mistake) 2 years later we still haven’t had any real updates.
    We had gotten a 54k$ settlement but that’s horrible considering she is disabled now with a walker. How do we escalate our settlement payout / reserve in a decent timeline (within just another year) and motivate our lawyer to get what we think we are worth!

      @@geekeswillis569 Ok, good. So the settlement is still in play.
      The best advice I have for you is that justice can take some time. I don't have actual data in my firm for this, but it seems like our average car crash case takes about 18-24mo. Sure, we'll settle some within 6 months, but we have some that drag out for years. And there could be any number of factors why.
      I'd probably suggest that you might want to have a frank discussion with your lawyer to get a better understanding of where your case is sitting--current offers on the table, projected timeline, factors that are causing the case to drag on, etc.--that might at least get you a clearer picture of what is going on, and allow you to strategize and plan for the immediate future.
      As for litigation loans, personally, I'm not a fan. While not all loans are like this, they tend to have high interest and low regulations, which leads to a bad situation as a consumer. I generally advise against them, but I do have clients that use them as a last resort. Do the best you can to cut costs, find ways to make money if you can (even if it means doing something like Uber, Instacart, etc), and do the best you can to get by. It's tough, sure; but it's an investment in your future.

    I was in an accident where I was at a red light, and the person ran into me and my wife, we werent initially injured but she is pregnant and we went to hospital to check on the baby to make sure everything was okay, she has recently missed work due to being in pain, is there any type of settlement for this?

      It's not uncommon for symptoms of injuries to pop up within a few days of the crash, especially with regards to head, neck, and back injuries. She does need to be seen for her injuries as soon as possible after they pop up. With that said, if it's minor, you might want to save the lawyer's fees and try to settle it yourself. Get some compensation for medical bills, lost wages, maybe a bit for pain and suffering.       Yikes, that's horrible. I hope you're not dealing with daily pain now. Do you have counsel representing you in your case? The rules are a little different for government entities and vary from state to state. I don't usually practice in New York but we are happy to take your call at 314-542-2222 and answer your questions. I don't know that I will be able to give you a straightforward answer for what kind of settlement you can expect, but I can get you marching in the right direction.
      The settlement depends on the total medical costs and future medical treatment (such as if your doctor recommended you for an additional future surgery or ongoing physical therapy) and other damages, the insurance coverage the fire department is carrying (which should be considerably higher than a typical passenger vehicle), whether any other parties share liability, and how hard the defendants fight you. If you have an experienced attorney, you probably have a chance of receiving a great settlement but I don't know enough to give you a specific number.

    Hi! Hope you are well and thank you for the amazing video Burg! My new car got damaged during a bad hail. Progressive adjuster offered 3k while my Tesla body shop did an 26k estimate. My question is: what do I need to do to get the $26k check?

      Wow! Insurance companies love to not pay out, but that one's impressive!
      We don't really handle the property side of claims--just the personal injury, so I'm going to stop short of giving you legal advice here. With that said, a lot of our clients face similar issues, so here's some generic suggestions I would give them:
      1) Do NOT accept any check from them until they meet a level of compensation that you are happy with.
      2) Make sure they are aware of the Kelly Blue Book value of the car (prior to the hail damage)
      3) If possible, a second (or third) estimate from a another shop can help prove the extent of the damage.
      4) Make sure you've submitted good photographic evidence of the storm damage.
      After all of that, if they are still a mile away from the actual cost of the damages, it might be worth finding a good local lawyer that handles property damage claims.

    So I got in a accident I was at a red light and a guy was looking on his phone to pickup his phone and he looked up and we were stoped and he hit and Totaled our car and he hit where us my son was in the car and he was where the truck hit he was fine but we both got checked out and it’s been 3 months now and and progressive the incurrence company and they paid us the money for the car the car was worth 21 grand and they gave us 17 grand and they haven’t paid hospital bills yet and I got a call from the hospital saying that there was “unpaid bills” and progressive was supposed to pay so I’m unhappy with them and I need you help

    My health bills were run through my health insurance. The accident was the other guy’s fault and has a policy with $30K max for bodily injury. Do I share with his insurance company what my insurance paid and my copay’s? Or do I share with them only the bills before my health insurance paid? My health insurance subrogation dept said by law they can only rake 50% of the $30K and my copay’s are are $5K.

I am not sure if you provided a medical authorization to the other drivers insurance or not but if so they might have already requested your itemized medical bills and/or your health insurance might have already advised them of their subrogation lien. Therefore, the insurance company would know both the billed amount and the amounts paid. Without further details on the case and current status, I cannot fully answer your question.       How did it go with your insurance claim? I'm in a similar situation where my health insurance has paid out my bills and I had a small copay. My doctors never gave me "bills". The doctors only billed my health insurance, so those are the only itemized bills I have of the entire accident and it shows the original amount and the amount that they paid out to the doctor. Now I'm trying to figure out what I show to the auto insurance adjuster from the at fault drivers insurance company. I was thinking of blacking out what the insurance company paid since legally in my state I am allowed to get the full amount of the billed medical. I do have to pay my health insurance company back for what they paid, but legally I get the full amount and pay my health insurance back their portion.

      @@khloe38 I’m trying to remember, looking at notes…the other guys car insurance paid my BCBS $15,000 directly and they paid me $13,065 (so ended up shy $1935 of the $30,000 total). I think BCBS disclosed to auto insurance what the copays were? I know I paid ortho doctor, physical therapy, ambulance, RX’s and in the end the copay/coinsurance for the hospital (ER, surgery, not quite 24 hours there total), was around $3000 and I got the hospital to cut that in half by saying it was a hardship, and I think the auto insurance provided a statement to help with that…because on the other side, property damage they generously gave me $6000 for my old car, but it wasn’t enough to get another car with.

      You know, that's not really in my wheelhouse, but I've done my fair share of marketing, so I do have a couple of tips you could use.
      1) Network. Given what you do, I'd suggest getting friendly with tow truck drivers. Maybe offer them a soda/water/coffee when they drop of at your shop. That way, when they have a hookup ask them if they know of a good shop, they'll remember you.
      2) Invest in a good website, and invest in SEO. One of the easiest ways to get discovered these days, including by people trying to find a fast solution from the side of a highway, is via google. If you can make it to the first page of google, the business will come!

    My hospital bills were 59k$. Her fault 100%. Broke my back.. her insurance max is 25k.. with attorney cost of 33% does that mean at very most i could possibly get is 66% of 25k? Because she doesnt have any assets besides her home... my attorneys havent seemed anxious at all for my case and its been a year since the accident.. got an attorney few weeks after wreck when i could walk again.. but even explaining to them how i cant do anything i used to be able to and everything hurts al the time... havent gotten anything from the lawyers, no paperwork or anything..

      You have a very unfortunate case. You're most likely not going to walk away anything unless you have underinsured motorists coverage because your medical bills exceeds her liability coverage

    My bills totaled 50,000. I was making 40,000 a year it has been 2 years I had back surgery. The adjuster first offer was 40,000. I got reversed by a 18 wheeler they were at 100 percent fault. How much can I ask for thank you

      @@BurgerLaw thank you my lawyer just a counter offer on my end for 250,000 on my wife 127.500. The 18 wheeler was at 100% at fault. What would be a good figure to estimate my take is it fair to say that i may get 100000 all together thanks

      Again, a lot of factors at play here. When evaluating settlement offers, factor in costs such as attorney fees (often a percentage of the total settlement) and outstanding medical liens. That should get you an estimate of what you're really looking at to take home.

    Hey Burg, I was in an accident recently and the other party's insurance has accepted 100% liability. I am in an at-fault state. I haven't been to the Dr yet, but my neck is still feeling stiff.
    They just wrote my car off as a total loss today, and I'm prepared that they are going to lowball me. I also lost my job over this. This was 2 weeks ago and they didn't mention anything about a car rental, I called them and mentioned it and just finally got one. I'm just so overwhelmed by all this. Should I get an attorney?

      @@comments.cuestionsandconcerns To be honest, very few lawyers deal in auto accident property damage, largely because you usually don't need a lawyer for those claims.
      Now, laws vary from state to state, and if we were talking Missouri or Illinois, that would be one thing, but I'm not on the bar in Texas. (Note: I am unfamiliar with this firm, but it sounds like solid advice in the guide, so I don't mind sharing it.       ​@@BurgerLaw i'm realizing that the adjusters get there marching orders from the companies lawyers. how does a lay person even have a chance negotiating when i have to actually go against a lawyer? if i'm not able to hire a lawyer to speak for me in just a property damage claim are their other groups or organizations that specialize in taking on the insurance companies lawyers that i can hire?

      So sorry to hear you are in a difficult situation. Insurance companies can be cunning and vicious. I would advise you to get a free consultation with a lawyer who deals with your kind of claim in your state. They could let you know what they think about what you are entitled to and what you need to do to get it, possibly get a lawyer. Then you won't have to speak to the insurance company anymore!

      Honestly, not a bad tip! It's always good to negotiate from above your goal. The only word of caution I have here is to be careful to not throw out comically big numbers, which could happen if you have high medical damages.
      Ultimately, the goal is to fully and fairly compensate for medical, lost wages, pain and suffering, etc.
      We typically look at what we believe is our goal settlement, then shoot quite a bit higher--but not astronomically so--to give us enough wiggle room to negotiate down to our goal.

    I have a question. My ex girlfriend got into an accident in her new boyfriend's car last year. She was insured on my insurance as a driver but none of the cars on my policy were in the accident. But now there is somehow a claim on my policy for an accident involving a car that wasn't even insured on my policy. So my question is how did they file the claim against Me when none of my insured vehicles were in the accident. It wasn't driver insurance. Just vehicle liability.

      You know, there are still a lot of forces at play when we talk about the physics of a car crash. Even if there was minimal visible damage on the car, that doesn't necessarily mean that there was no force that acted on the car.
      Sudden forces causing rapid acceleration or deceleration of a vehicle can apply severe force on your neck and spinal column, which can cause whiplash, bulging discs, soft tissue injuries, and more. We have a number of videos and shorts on this topic on our channel, and they are definitely worth a watch.
      My best suggestion to you, is to get yourself checked out as soon as possible. If you have any sort of condition such as whiplash, you'll want to report that to insurance. It's also worth noting that if it's severe enough to necessitate serious medical attention, you're probably going to want to consider lawyering up; I've got a feeling they'll try to use the lack of visible damage to the car as justification to try and deny your claim.

      Well, fortunately, it doesn't matter if your cop understands how whiplash works. Whiplash often occurs when there is minimal damage to the vehicle.
