Absolutely, but the owner and the cops running up the bill is part of the punishment. The judge will probably put his own markup on it, too. The owner is going, "That looks like a $200 ding there," while Officer Helpful says to him, "You know, that looks more like a $500 ding to me! I'll get it isn't fixable and he needs to just replace it for two-grand!" It's like when your dad assesses damage to something you wrecked as a kid and converts it to how many lawns you're going to mow and how many gardens you're going to weed (for your house and the neighbors). 100% it's going to be assessed at 5 times the going rate, at least.

Look, I’d be the first one to back the blue, but arresting that guy for the flamingo prank is just ridiculous. He’s a young college kid that made a stupid decision while on a trip to Vegas. Use your discretion wisely. Just give them a ticket and let these guys go. Yes it was a dumb decision, yes it was immature, but arresting them was an over exaggerated action for such a harmless prank. As an officer, I would not have made the same decision to arrest those 2. Seems a little too harsh for such a petty crime.

The mens + Actus rea for each scenario is drastically different from one another. The key word in this case is discretion. Discretion varies depending on the case. For a harmless prank caused by a dare between a group of college kids involving a flamingo from a hotel, it’s a bit harsh to arrest them.

There is significantly less malicious intent behind being dared to take a flamingo as a prank. You may perceive these crimes as identical, but that’s not the case when you look at the law. It all goes back to actus and mens rea. Intent/mentality during the crime is extremely important when judging how guilty or liable said person is. The officers are within their duties to arrest them, but it was completely unnecessary. They should’ve used their discretion to ticket them and let them go. I guarantee those charges were dropped in court for a multitude of reasons. Sending them to jail serves no beneficial purpose and is just a major waste of time for everyone involved. Neither of the suspects was a minor. One was 24 and the other at least 30. During this "college prank," they significantly damaged the flamingo. The injury to the owners was the same no matter if the thieves' intent was to sell the flamingo or not. Also, in my comparison, I never stated that the lawnmower was in a shed. Where I live, they often are stored under a deck or left sitting on the side of one's house. In both cases, the theft is intentional and deprives the owner use of their property.
One thing you don’t do in Las Vegas steal things off the strip and not them all smart thing to do. Did you see the other episode where the other guy that was drunk? He had five beers partying all the time the cops are doing a good job.
