    Atty. good morning po. Atty. nagpirma po ng extrajudicial settlement of estate with waiver of rights mga kapatid ko dahil sa bahay po namin, at magpirma po at kumpleto narin po mga requirements at nagpirma rin po ako for acceptance, at nakanotarized narin po mga documents at na published narin po sa newspaper for 3 weeks. Bali ang hindi nalang po babayaran now yung estate tax at transfer fee pero yung amilyar po bayad po siya. Now po pina subdivide po namin yung farm namin, pero d po nila sinunod yung napagkasunduan namin na sukat para sa pa loti gusto po nila ipalaki mga sukat ng loti nila pero d po ako nag pumayag sa gusto nila na ipalaki ng sukat ng loti nila, now po sabi ng kapatid ko na pag d daw po ako pumayag sa gusto nila palaki loti nila, d ko daw po makukuha yung bahay na pinagawa ko at da daw po sila aalis sa bahay na pinagawa ko, at siya rin po humahawak sa documents ko at titulo dahil siya rin po attorney in fact ko, now po kinukuha po po yung documents at titulo ayaw po niya ibigay sa akin, gusto ko na rin po pa cancel yung hawak niya Special Power of Attorney ( SPA ), at now po hindi pa po natapos yung pag subdivide sa farm namin. Atty. ano po ang ma advice po ninyo sa akin? at puwedi po ba ako magpagawa sa attorney d2 sa US ng revocation of Special Power of Attorney ( SPA )

      Yes. Pwedeng gawin sa USA ang revocation ng ginawa mong SPA. Maaring mong ipanotaryo sa USA notary public ang revocation dahil ang Pilipinas at USA ay signatories ng Apostille Treaty Convention na kinikilala ang legal na dokomento na notarized ng authorized or accredited notary public ng bawat bansa. Ang/or maari ninyong ipa notaryo ang Revocation sa pinakamalapit na Philippine Consultate kung saan kayo residence sa USA.
      Magkaganoon pa man pag hindi kayo nag kakasundo sa hatian based on pro-rata or equal sharing formula ng sang-ayon sa batas, ang sino man sa inyong magkakapatid na tagapagmana ay maaring mag file ng Petition sa Korte for Judicial Settlement and Partition of the Estate. Makipag ugnayan kayo sa lawyer for further assistance.

      Kung titled na ang inyong lupa na nakapangalan na sa inyo, at may nag aangkin at nagpapakita rin ng mga dokomento na basihan sa kanilang pangaangkin, ay maari kayong mag file ng Petition sa Korte for Quieting of Title and removal of doubt with damages. Sa processing ito ay hinihingi ninyo sa korte na alisin ang ano mang pag aalinlangan ng inyong pag mamay-ari sa inyong titulo. However, mas makakabuti rin na mag pa relocation/verification survey kayo sa gedeotic engineer upang malalan kung sino o mayroong overlapping at conflicting boundary lines sa mga karatid na mga lote. At kung base sa nasabing relocation survey at sa inyong titulo ay wala kayong nasakop na lote ay huwag ninyong papasokin ang sino man ng walang pahinitulot sa inyo. Mag lagay kayo ng "No Trespassing" sign upang magkaroon kayong babala at basihan na pag file ng kaakibat na kaso sa sino mang naghihimasok sa inyong property. Makipag nayan kayo sa lawyer for further legal assistance.

    O.k.po.
    We had properties left by our parents so we have to settle our Estate taxes.
    But, due to the big amounts, all heirs preferredvto sell all our inherited properties.And, as part of our sale transaction, we require our buyers to pay all taxes inckufing estate taxes, capital gainsctax, doc.stamos tax , notarial fees etc.
    Is there any problem with such dealings since our buyers agree to our sale contract.
    Anyway, we bringbto rock bottom our sake price to cover our Estate taxes, capital gains tax.
    May I get your opinion on this, Atty.
    Our buyers pay the Estate taxes and capital gains tax ahead of time and akso pay thectransferctaxes and other miscellaneous taxes.
    Thank you po, Atty sa information na maibibigay ninyo.
    Again, wala po jasi kami sa Pinas do we prefer to sell than own.

      There's nothing illegal of that terms and conditions of the sale of the inherited property, based on a CASH AND NET BASIS, if you have a buyer who is willing to shoulder all the taxes, fees, leg and liaison works , commission if any, expenses and documentation sale and in the settlement of estate. Just be sure that you have a separate and written contract on the above matters with the buyer.

      Kung nasakop na digitalization program ang concerned Registered of Deeds, particularly sa Metro Manila, ang itsura ng certified true copy ay para ring photo copy ng original owner's Transfer certificate of title pero ang nasa pinakamataas ng heading nito ay naka print na " LAND REGISTRATION AUTHORITY CCV FORM" at ilalim nito ay naka lagay print na "UNOFFICIAL COPY IN NOT IN NOT IN BLUE COLOR".

      Salamat po, now k lng po kc nalaman na hindi daw yun ang original copy ng title ng lot hawak k 😭 abroad po kc ako iba nag ayos ng docs k now asked k pinaayos k ako p sinisisi bkit daw dko alam kng nasaan ang original title eh yun lng po kc binigay sakin im thinking yun na kya tinago k pero hindi pala yun, may nagsabi po bka daw dko p nkuha sa ROD tama po ba? Puntahan k sa ROD? Thank you

    Atty good pm, can i pay only the state tax of lot assigned to our parents. There is Subdivision or partition plan for each heirs , Our grandfather title owner was died 1998 hirap makipag settlement sa iba kasi na heirs. Puede ba yong sa parents ko lang partition lot bayaran state tax? Maraming salamat po

      If your are referring to Estate Tax(no state tax) ay kailangan mo na nag magkaroon ng Partition ang mga heirs. Kung mga heirs ay hindi nagkakasundo sa partition para mabayaran ang estate tax, ang sino man sa mga heirs ay maaring bayaran muna sa kabuang estate tax and subject to reimbursement if the intention is to avail of the Estate Tax Amnesty Extension Act upang maka iwas sa penalty at interest charges, dahil hindi pa naman kakailanganin ang EJS sa pag babayad ng estate tax. However, if the above option is not an option, then ang sino man. sa mga heirs ay mag file ng Petition sa Korte for Judicial Settlement and Partition of the Estate para ang bawat heirs ay mag karoon ng specific area na maging basihan ng pag compute ng estate tax at documentary stamp tax. Makipag ugnanayan kayo sa lawyer for further assistance.
