Every arrested/seized Russian owned SuperYacht I have featured on this channel have had one thing in common, the owner has been under sanctions from either the UK, US, EU or other countries. However this 58 metre yacht is different, the owner has never been placed on any sanctions list, and yet his yacht has ben imprisoned in the capital of the UK for over two months. We look at why this has happened.

I'm a relatively recent subscriber, but wholeheartedly agree that the opening sequences here are above the beyond. And the light! I am sure that he checked out the light at different times and intentionally chose this time. The other thing I really liked was the foreshortened or close shot of the bow of Phi while he's saying how it is a relatively "small" super yacht. Extremely well done.

Putting aside the geopolitics for a moment (without minimising the tragedy one bit), that has to be one of the most stunningly beautiful vessels I have ever seen!

I love the color.....Toyota has been using something very similar on its Tacoma and tundra models, a cross between grey and sort of a lapis blue...and to give it a matte finish rather than the gloss would be even better! If my old Opel was not worth more with the original paint job in her, I would absolutely paint it this color.

I don't disagree with what you've said (and good analogy by the way). However I doubt the British government are that clever or have the common sense to see it that way...for them I think it was purely a photo op, having such a good looking expensive Russian yacht to hand!
No, there are Russians trying to escape Putin, they need to be helped just like Ukrainians need to be helped. Blanket sanctions potentially pushes them back into Putin’s grasp.
Ok, Russian here, albeit living outside of Russia for longer than a decade.
In Russia, once a business owner is at some level of said business volume, one cannot "skip" bribery and corruption on political level. Let me explain. If you are an owner of a few kiosks -- selling water, cigarettes, magazines, etc -- you'd probably come across fire dept checks, local policeman checks, and alike. All these checks can be "navigated around" by peanuts. Literally, a policeman that received, say, a notice about incorrect rubbish disposal from such a kiosk may close eyes after receiving chocolates for kids and bottle of cheap booze for himself. Obviously, more business volume, higher the demand. An owner of couple of shops would be "liable" to "help" local municipality head (you can guess what "help" means). As you can imagine, it goes all the way up. One of the steps is when governing authority start to benefit not occasionally by asking business to "repair that kindergarten", but to literally "cover up" certain grey schemas of business, providing law-enforcement protection. (See Magnitsky story). Not to mention that sometimes, when law enforcement sees a nicely run business it tries to take it under control and suck out all profits (google for DoDo Pizza case) by fabricating dubious allegations, ruining owners and forcing them to sell business for fluff cash.
Hence is my opinion -- Abramovich & Co are definitely not the role models.
The owner of Phi -- that should be relatively easy to check his business history.
How did London bankers accepted corrupt money, doing all PEP checks -- yet a third point.
It might be the case as well, that during the war times with clear offender, "ei incumbit probatio qui dicit, non qui negat" might be if not reversed, but at least "ownership made more difficult while clearing up". Please, keep in mind, that for majority of Russians, those who live outside of bigger cities, just what they see in news is "yeah, cool, another yacht of a reach oligarch is arrested". These news make life of millionaires difficult, but not suffering. And yet another question remains -- how such an oligarch passed all possible PEP checks and was able to land corrupt money in "collective west".
Russia is nowhere near unique in this. It's basically impossible to do business in much of the world without corruption. So anti-corruption laws either have huge gaps (like facilitation fees), or the authorities looks the other way until the want to harass/shakedown a business, or all the multinationals based in the country move their HQ and jobs and tax revenue that come with it.

"Low-level" corruption does not massively exist in "collective West" (example of a kiosk owner). Yes, I heard about some cases, literally, but it is incomparable to overall acceptance by just ordinary public.
Mid-level (say, a chain of shops, or some minor industry) to upper-level (industry, but not as large as VW or Siemens in Germany) -- practically non-existent. A mayor of a city would not dare asking for a bribe so that such a company can continue working.
Anyway, even when corruption exists in examples above -- these cases almost never lead to ruining lives, imprisoning either side, etc en masse, like it happens in Russia. See (lucky) example of Dodo Pizza.
There are for sure, examples of companies like Siemens or Enron, and this is even more difficult.
@@Dennis-vh8tz As much as theres corruption in all countries, name others that kill political opponents & journalists while they're in foreign countries, by using radiological & chemical weapons, like Novichok & Polodium. The west has its problems with corruption, but its not systemic & its not legal, in Russia, it is.

One detail is that Rolls Royce can no longer sell engines or spares to the shipyard, because it's owned by a Russian. Much like their air fleet, those gin palaces will soon be aground on a reef of vodka bottles. Or at the bottom once the Ukrainians copy Drake, singeing the King of Spain's beard by sending fireships into Cadiz harbour. Either way, going nowhere.
Yeah it really is, outside and inside are just great (tastefull interior and obviously excellent fit and finish)

I don't feel the arrest is justified, nor do I believe the bridge was broken.
However there may be more to the story than we know.
This could end up in a costly lawsuit if nothing wrong has been done by the owner.
Neither party cares about legal cost . It's all standard games
You have a flag of convenience that doesn't match a corporate veil. That by itself is reasonable suspicion that suspicion that doesn't reach probable cause. You also have a group of people that the owner is associated with who are playing games to conceal ownership and avoid International consequences. That also would be grounds for reasonable suspicion but not probable cause if taken by itself. The combination of the 2 gets you well into probable cause to probable cause and probably to a per preponderance of the evidence. If the alleged owner is telling the truth he should get it back after a court case and that investigation investigation should work against the probable cause/reasonable suspicion in the future.
Exactly what I was thinking. I believe there are reasons unbeknown to us. I doubt he got up one morning and just decided to arrest it. At the very least it’s a large “they”
You can't sue the State, anywhere. Whether the bridge was broken or not, it was illegal to help them in any shape or form, read the main header posting I made on the subject. I'm one of the panel supporting that website, in passing: it lists the entirety of active legislation in the UK.

I tend to agree with the PR stunt claim.
Arresting and seizing vessels without proper legal claim just delegitimizes the rightful arrests and the process as a whole. It just gives the people who want to criticize those issuing the sanctions a peg to hang their hat on.
If the government has enough evidence to suggest a person has done something wrong, add them to the sanctions list. If they don't, leave them alone. The rule of law still applies here.
The rule of law _ought_ to apply, but it appears to be dead and gone in the UK.
Because a person is named owner don't mean that person is the owner and it's hardly a publicity if no one has reported on it during past two month's.

This Tory government (and many other governments of either Cons or Lab in days gone by) have proved themselves to be dishonest and underhand (and even corrupt in some cases) on many issues and levels before now so the arrest of a vessel for simply being owned by a Russian gentleman does not surprise me in the slightest. Who knows their reasoning but I doubt it makes any sense to most reasonable people.
This yacht has been sanctioned , not because of financial links to Bloodymire Adolf Putrid, but to potential money laundering, for which every high st bank or financial institution is accountable. Just watch the next time you're questioned about "the purpose" of a large deposit or withdrawal - without a legitimate source or dedtination you'll be "sanctioned" by the NCA too

Hi, my comment is unrelated to this vessel, but would welcome your thoughts on a reasonably new Princess Y 85 catch fire in torquay marina a couple of days ago, I have owned yachts in the past and am aware of fire hazards on board, but it would appear to be unusual given the age and the build quality of princess yachts in general.
It seems it had just been rewired with a flashing nameplate next to 2000 gallons of diesel. They think the nameplate shorted, set fire to the fuel, and up she went. The owner's a Boycie type.
Fun Fact: The owner made the 499GT decision based on costs as building Phi and her support yacht Phi Phantom cost him less then a comparable larger yacht.
Quoting from the Royal Huisman blog post "Are two boats better value than one?":
“First of all, building the mothership below 500gt was very important because compliance levels and build costs are much lower when you don’t have to meet all the standards that come into play at 500gt. And this extends to annual operational costs, which are also much lower below 500gt.”
As such, PHI has been built to be 499gt, which offers significantly more value than a 500gt-plus yacht. “The educated figure that I’ve heard is a 25 to 30 per cent increase in build costs for 500gt compliance compared to sub- 500gt compliance, and double the length is at least double the build cost in terms of labour and materials,” adds Booth.
“When you consider it would be potentially a 25 per cent higher build cost to have all of that utility on PHI rather than on a support vessel, there’s no way that our support ship has cost us 25 per cent of the value of PHI, not even close. So we essentially have the utility of a 90m [295ft] yacht at a significantly lower build cost than building a 90m yacht.”

I do not believe any of the people you mentioned began opposed to the war. They only made public statements after they were sanctioned. Abramovich is a perfect example of someone who hopped on the anti-war train very late. I'm not buying that he, or any of them, care about Ukraine.

Considering the risk associated with coming out against the current Russian regime... I think there is 'some' merit to them speaking out.
What I don't understand is how we hear many ogliarchs are againts Putin yet they cant collectively get together and just delete the issue... so to speak.

With the FoC, UNCLOS requires a “genuine link” between the owner and the registry. Having the ‘brass plaque’ as a genuine link seems disingenuous at best
The "genuine link" can be as simple has having a business based in your FoC state. Trivial to setup and staffed by nominee directors.

Great info & videography! Not only enjoying learning about the yachts, but enjoy vicariously travelling to see many of them! And no, if the beneficial owner is not on the sanctions list, it should not remain arrested. They either need to release it or update the sanctions list via supporting evidence.
I feel I'm not getting the whole story. If the owner is not on a sanctionslist, on what grounds is the boat being arrested? And if there are no other grounds, has the owner taken action to free the boat? If he hasn't taken any action, why not? Surely a boat cannot be arrested for no reason, only based on the nationality of the owner. So I'm thinking something else might be at hand, otherwise I see no reason to arrest it. At least not in a lawful society. Whether we like it or not, justice has to be blind without any exeptions. We have our own rules to stick to and should not be guided by the atrocities of the other.
This is all about west being thieves nothing more, money laundering is an excuse if that was the case they be investigated at there home country.. not for a foreign nation that has zero info on nature of his business or his taxes.. most of these owners of these super yachts own corporations or shares in big corporations.. it’s a joke really, but they can’t arrest Biden’s for laundering money in Ukraine or pisslosi for insider trading.. all hypocrites and lying thieves
I'm sure the SY owner has his legal team on it, you are right we in the west are governed by the rule of law and the law must prevail. Unless it can be proven the owner owes his wealth to the President of Russia and that such wealth could be stashed for the future of the Russian President then it will be hard to keep this yacht under seizure. The seizure of yachts makes good copy for the media and a feel good factor for politicians.

No they can't. You cannot sue the Crown (a technical term meaning the Government). It is explicitly illegal.

Thanks for the update. Everything you explained about registrations makes sense to me. As you said the majority of the yachts I have seen are registered in the Caymans. Just like here in the US, if you buy a boat and intend to keep it in US, odds are you are registering it in Florida, simply because the taxes are cheaper.

The mechanical Certification to bring the ridge back into operational permissions is a public record. The Inspector and the workers are certified and licensed. I would love to see what they logged as occurring.

Yeah I have a big problem with this if indeed the bridge was for some reason said to be broken when it actually wasn't. I have no problem with Russian Superyachts being impounded, but the political interfering with public infrastructure is very dystopian (see the Hong Kong MTR conveniently being 'broken' on the day of the largest anti-CCP protest in Hong Kong's history). No thanks.

You want to cruise your pleasure boat around the world, yet the insurance you can get in your country won't cover you if you do so you get the boat registered in a country that it will insure you for global use.

Tax evasion may be completely legal but I think the rest of us broke-ass fools would be quite happy to register our cars in other countries if it meant we could avoid the taxes.

I was amazed to find out Nord had not only a submarine on board but a military class/type hovercraft and an amphibious landing vessel! We are rarely privy to the details of these secretive Super Yachts... imagine what sits within the hulls of other large yachts.
@@Tekenduis98 I do not believe that Nord has either of the last two you mentioned. It has a Submarine for recreational purposes there is no mystery about that. Many yachts have submarines.

@@kokomo9764 NORD definitely has a small custom landing craft to land it's luxury Range Rovers, of which it apparently carries 3, not BMP's :).
Dan it is a beautiful opening that is for a beautiful ship. Since he's not on the list it should be released many ships around the world are registered in countries of convenience to avoid taxes including large corporations he should not be punished for that, governments can't have it both ways for people they like or don't like.

Its criminal to just arrest this boatl! How many Uk billionaires own boats that are registered elsewhere? How many UK citizens live in Monaco to avoid taxes.
Nonsense. The UK's not invaded anyone illegally in recent times. Iraq 1, restoration of law after Saddam invaded Kuwait and (technically) Saudi. Iraq 2, Saddam renegued on his truce terms. Afghanistan, UN-sanctioned pursuant on a treaty made with Pakistan in 1997.

Are you sure that the registered owner is actually the owner? Seems like the British government might have information that it isn't. Maybe you should do a story on yachts not arrested but owned by Russians not on the list. How many are there? Where are they located?

If there's one thing that I hope comes out of all this as a secondary effect of the Russia-Ukraine war it would be making it much harder (ideally impossible) for the super rich to hide assets offshore. The whole system is incredibly dirty and it's a shame that it has taken a war for things to get even slightly clamped down upon.

@@pistonburner6448 Two of the largest telecommunication companies in the world AT&T and Verizon their CEO's make $25M and $20M respectively and most of which is in equity and not cash. Phi cost about $45M and about $4-5M to run each year. I am not sure a small time telecom CEO in the Urals can afford that large of a yacht, both in initial purchase costs and ongoing yearly costs with his "salary" alone? It would appear that he is another on-paper owner only and most likely isn't the real benefactor as he couldn't afford it. 🤦♂️🤷♂️
Agreed. We have to distinguish between the registered owner and the beneficial owner. The U.K. Government may have information about this difference that they do not wish to disclose. I believe the same applies to Fiji where the U.S. government did not want to disclose in open court what they knew as it could jeopardize their sources of intelligence.

What a beautiful yacht. Query this: Why do so many Russian "business" people have so much crazy cash to spend on Super Yachts...Interesting. As a side note...most people that work hard to earn money rarely squander their profits in such a manner.
Corruption. If you don't actually work for your money, it doesn't have any meaningful value, so squandering on useless shiny bobbles makes no difference.
How much time do these Russians get to actually spend on their yachts? Not a real comparison I know, but we hired a small sailing vessel with a skipper for one day in the Med. and the skipper said the owner used it herself for one week per year! Also known people who work as masters or chefs on the big vessels and live on them all year, while the owners visit for a month p.a. max..

The Cayman Islands is a dependent territory of the United Kingdom. Although the local legislature and courts are independent from the United Kingdom, the British Government deals with all international relations on behalf of the Territory.

My thoughts are that although the UK has really gone forward with supplying arms to Ukraine and also applying sanctions. These are not as sexy as arresting or seizing superyachts. So this Russian owned boat fell foul of our politicians looking for a high profile and glamorous photo op. Most superyachts would not be in the UK, it’s all about PR and face with our stupid politicians.

You are required to pay any debts and ongoing maintenance. The trust gets the money from the participating individual. Lots of lawyers fees involved for contracts but can make a ton of money.

I strongly do not agree with this seizure/arrest. There is no legal justification for it that has been made public. I am, for the seizure/ arrest of those owners' vessels that are under sanctions but not if they do not. I believe in what is lawful and not about those that overstep their bounds. If their their is grounds to sanction this vessels owner then make the case in a legal and lawful way.

As someone else pointed out, it would seem logical that a billionaire yacht owner would have a ready cadre of solicitors well informed by a ready cadre of barristers who have set the table for rigorous legal challenges... and yet nothing to report?
London is chock full of legal hotshots who have been handling any and all legal needs for wealthy Russians for decades and it seems to me that any number of them would be happy to take up a case of demonstrably illegal seizure... big stage, big money, big profile... so far big zero. I doubt there is anything simple about this case and look forward to hearing more as this unfolds.

Large superyachts are mostly used in the Med and in the Caribeans (including EU islands...billionaires don't anchor in Haiti, they do it in St Barth, France !).

Currently sat in a restaurant opposite this yacht. Its still spotless in amazing condition. Some lights on inside. Maybe 2 people on board. Vessel looked to have been washed down recently as no residual snow on the vessel. This has to be one of the best looking yachts I have seen. Took some photos for posterity

My state has property tax on cars so people register them at their vacation condos. That's not technically legal but similar.
@@Skarry yup, I used to live in WA. state with high sales taxes of 8-10% and we shopped across border in OR with no taxes. I heard WA. State Patrol would camp out by freeway on ramp during rush out traffic to catch cars with OR plates but drivers with WA address. Guess regardless of income, no one love to pay taxes.
That is one reason Switzerland gets away with a low income tax rate of 20%: NOTHING is tax deductible.
They don't have property taxes either, if you own a property they assess for how much you could rent it out and add that amount to your income.

There may be other reasons why it has been arrested that are not public, but taking advantage of the tax laws as they exist now is not illegal. It may be immoral but we all do it to a certain extent (duty free, maximizing business deductions, company cars, etc).

Beautiful footage. There is no logical reason as to why this gorgeous yacht remains in Canary Wharf when her owner isnt sanctioned by anybody. I suspect our givernment are acting like pirates and wish to extort money in the form of taxes from the owner. It is highly suspicious that the locks and bridges were broken preventing the vessel from leaving and then after the seizure, they were fixed. Russophobia is wrong.
To be honest with you I see no reason why a boat cannot be registered in a tax neutral country and fly under the ensign of a different country where the vessel spends most of its time. Its like a bank account - some people have bank accounts in tax neutral countries like Switzerland and they live elsewhere - it doesnt make them a criminal.
I would be interested to know how many superyachts are owned by British residents are registered in the Cayman Islands and which ensign they sail under.

Welcome to the world of ships, and yachts. Flags of convenience have existed for many, many decades. My professional career in shipping started in the early 1970s and flags of convenience were long established when I started.
Flags of convenience offered not only tax shelters, but it was a game changer when it came to regulatory compliance. US flag vessels must comply with US Coast Guard regulations, which tend to be more restrictive than those of say Libera or Panama. I remember early in my career having a ship's officer's cabin carpeted with a commercial grade synthetic carpet. A USCG officer that was onboard for an unrelated inspection issue an 835, essentially a ticket, requiring the carpet be removed and replaced with a wool carpet. US flag, USCG rules. At the time the fire regulations required that carpet smolder and burn at a certain rate. At the time the only compliant fiber was wool.
We had US flag ships that were retrofitted with Inert Gas Systems in Japan. Unbeknownst to our engineers JIS, IEEE, ABS and the USCG all had different requirements for cabling when it came to fire. A foreign flag tanker, built in Japan to JIS standards and classed by ABS could discharge cargo in the US. But, a US flag tanker, fitted with JIS cabling, approved by ABS, was non-compliant. The cabling had to be to IEEE standards and UL approved.
Much has changed since those days to make rule compliance more uniform. But, there are still rule compliance issues where registry with a flag of convenience offers benefits.
As for ownership, I spent my career working for major oil companies. I always found it curious who the actual owners of the ships we operated were. Some of the ships were owned by the parent company. Others were bareboat chartered from banks, churches and individuals. I gave up asking who the individuals were.
An interesting point in all these sanctioned yachts, why isn't Russia screaming bloody murder? It seems these yacht owners have been skirting Russian taxes by registering their yachts with flags of convenience. They are are also hiding their wealth and avoiding taxes through the use of offshore companies. News reports are saying Russia is hurting financially from the war. Shouldn't the owners of these yachts be paying their fare share to mother Russia?

@eSysman SuperYachts • I wouldn't assume that the yacht has been arrested merely because it has a Russian owner. It's very possible that the international task force looking into the Russian oligarchs are uncovering other financial crimes. For example, Russian oligarchs are not the only people who launder money. I would wait to see the arrest warrant (or whatever it's called in the United Kingdom) to verify the reason for the arrest.

I believe, if a government can do what they want to a (Russian)civilian, they can do what they want to any civilian visiting their continent. Having said that, I don’t believe each and every citizen in Russia is responsible for a government’s leader’s action! As far as flag registration, we all minimise government taxes because they continually bleed us of our hard earned money.
The Russians are doing a lot more to the Ukrainian civilians right now. You wanna know my thoughts..... she is the most gorgeous stylized motor yacht externally to hit the water in nearly a decade. The focus during the design brief looks to have been her external lines and overall balance. Like a Palmer Johnson she is void of the sun deck. It's no coincidence she has similar lines to PJ. I believe the intention of RH is to attract would be PJ buyers. Not many owners building a new yacht this size appreciate loosing volume and an entire deck to purely visual styling esthetics. The same is true sacrificing interior volume for more deck space to compensate for the loss of the sun deck. Under the fiberglass skin with its beautiful chrome detailing she is an ordinary yacht. Regardless she is absolutely gorgeous!

To me in this specific case it is a hard call if this ship should be arrested. I shall assume that there are some much deeper reasons why it has been arrested that have not been made public. But if the owner is as clean as you said and can not CLEARLY and CONVINCINGLY be proved to NOT have Putin ties, I would think it would be a nice gesture of England paid for his lost costs, refueled it on the governments credit card, then have to write a formal letter explaining why they did what they did then let him go. BUT if in fact there is even a shred of evidence that he is tied to Putin or his actions in Ukraine then in my view they have done the right thing. Problem is it has to be perfectly clear one way or the other

About 9-10% of yachts globally above 24 meters in length are owned by Russians.

Tricky to decide; Russian commercial vessels are sanctioned by the West, regardless if they are controlled by the Kremlin or not.
I would say that there is a VERY low chance that some Russian without connections could become rich enough to own a SuperYacht, so I would go with reverse burden of proof in this case: Prove you are innocent, or face the music.

Boats in wartime! I am currently sitting on a 1926 wooden tug commandeered in WWII. It appears to me (little more than opinion) that when in business, in today's Russia, you don't succeed to the point of buying that yacht, without sleeping with the enemy.
There are many Yacht's or large ships around the world not owned by russian's in bed with putin, BTY, I insult by calling him Poutine, earned their money by hard work alone.

The reason for arresting that yacht is absolutely a crime in of itself. Just because someone is a citizen of a country committing atrocities is not his fault.
You don't understand how the Russian oligarch system works. The ONLY way that you have access to funds like that is to be on board with the Putin regime. It's very similar to the classic Mafia structure where individuals are delegating control over certain areas directed from the top.
There are plenty of articles and videos describing how the structure functions from years before the Ukraine invasion started in 2014.

The legal owner needs to launch court action to challenge the arrest. It is wholly legal for a company in one country to register a yacht in another country. This sounds like a petty politician abusing the public trust and acting unlawfully if the beneficial owner is not legally sanctioned.
