I'm assuming by "Special Effect," the agreement with Tyburn Pictures may include both prosthetic makeup appliances and visual effects. But the agreement would've been made in the early 90s, so CGI faces may not have been conceived of at that moment in time. If the agreement rules out any methods of recreation, then it might just be sensible to seek out another British actor, an unknown in high profile media, that bares a striking resemblance and can Recreate the voice. Surely there has to be at least one actor that could look the part. Nobody is deep faking John Belushi or Chevy Chase for that "Saturday Night" movie coming out next month.
This isn't deep fake technology. It's basically the same motion capture with 3D models used in The Polar Express, Avatar, and Pirates of the Caribbean: Dead Man's Chest. Deep fake tech didn't come around until 2018 and 2019 when it started to get used by youtube channels showing off its capabilities with face replacements in Solo: A Star Wars Story and footage of Bill Hader with Arnold's face when he does an impression on Conan O'Brien.
As much i have less respect for disney but seriously why I mean they sue after eight year this movie released i get people's now just want to take advantage to boycott disney

A) There should be some kind of statute of limitations on claiming Cushing's likeness. 2) That limit should extend well before his use in Rogue One as he also appeared in The Clone Wars. &) There ought to be (if there isn't already) a "You snooze/ you lose" clause on using likenesses akin to TM law where if you don't protect your interest immediately you forfeit the chance to sue. But then again... it's Disney. I hope Tyburn wins.
Disney asked the right people. Technically they didn't have to ask anyone. They asked the holders of Peter's estate as a courtesy. As Tarkin is a Star Wars character and Cushing allowed Lucasfilm the rights to his image in that role they could have got away without that. Do you think Clark Gable's family get a bean from all those Gone With The Wind posters put out since he died?

From what I googled (take that for what you will) Lucas's Industrial Light and Magic company obtained a copy of a mold of Cushings head/face that he did for another movie (not related to Star Wars) and that is what they used as a basis to create him for Rogue One - so there was no implied approval there under the Star Wars contract. I do think Disney did their due diligence in asking the family (they actually paid them for it), but checking the company that was representing him when he passed if there was any contract in place would have been a good idea (I get secrecy about it was probably a big deal and they were trying to keep things quite). Them getting that alleged contract in the last year of his life is a bit sus for sure - I'm guessing they were tipped off to the idea when the estate/family got paid for their approval so the company put something in place just for this occasion. And now, the family/estate is also deceased - so there is no one left to argue a counter point from the aspect of approval. The court denied the request from Disney to dismiss the suit - so it is going to go to a hearing/trial unless they settle before - the demand looks like it was in the $650K range. that's what I could find on it.
MIke, and if we are to get any future Clone characters, Disney better get an agreement with Temuera Morrison soon because his likeness and voice are one thousand of Clones.
I'm far from being one to defend Disney, but this is a serious reach. This feels petty. Give them a token pittance in exchange for them to shut up and go away.

Unless I’m mistaken, it seems that the animated Clone Wars series version of his likeness is safe. So Tarkin might possibly show up in future animated content like whatever comes after Bad Batch. Still won’t be his live action likeness. But at least it’s a half win for future Star Wars content

It sounds like the lawsuit is only regarding Tarkin in live-action, so I think it's safe to assume we might still see the character in animated form.
Yeah we have seen his character in animation a few times in the bad batch and clone wars but this is for the live action
