- Police in Texas use governmental immunity to avoid repaying taxpayers for damaging their property. A new legal playbook may have been found in a landmark court win.
Vicki Baker, 78, has beaten cancer. Simply put, the retiree knows what it's like to plant your feet, stand tall and fight.
So, it's no surprise her name is connected to a landmark federal court win that ordered the City of McKinney to pay her nearly $60,000 for destroying most of her home while pursuing a wanted man.
Throughout the country, state and federal judges almost always side with the police and other agencies when they cite sovereign and governmental immunity claims for damages to property.
However, Baker and her attorneys used a novel legal approach to sidestep governmental immunity claims and the legal argument resonated with the U.S. Fifth Circuit Court of Appeals.
The Fifth Circuit found the City of McKinney, a governmental entity, must pay an innocent property owner whose property was damaged or destroyed by police.
The city is challenging the decision and is not commenting until the legal battle is over.

It’s just like big insurance. Your doctor orders a test or medication, because you need it. Insurer will pay out 3x as much making you try other testing, therapies, or medications, before they ultimately end up giving you what you needed in the first place (If you don’t give up, or die, which is their hope)!

Yeah, that happened to me.. Dr put me on Humira, insurance company said oh no, methotrexate.. Dr appeals 3 times and I’m finally approved, and it’s now 3 months after the diagnosis and I’ve had to switch meds 3 times?..
It's about future legal cases, the police have to fight this to shore up their immunity, it's unfair, but that's what the system is set up for.

It's too bad it has to take an attorney to fight the State just for a simple reimbursement of damages. About a year ago someone moved my wife's laptop that she had brought to work. As the person moved the laptop, it slipped out of their hands and crashed onto the floor and did about 200 dollars of damage. The person who dropped the laptop took responsibility and immediately said, "take it to a repair shop and send me the bill". And that's what took place. The computer was repaired and the person who dropped it, paid for it, and that was the end of it. That's all we're asking for is SOMEBODY {I don't care WHO} but somebody write this woman a check for at least the cost of repairs OR, let the woman bring in a contractor and get everything fixed, and send the City the bill. It's not that complicated.

This is what happens when there is ZERO accountability and qualified immunity for police . Even if she got any kind of settlement the police will still keep doing what they are doing because the taxpayers and city insurance are the ones who pay.

There are many jobs that do not require you to carry a gun, and don't even come close to the possibility of lethal force that require not only more extensive training and education than to be a cop, but also require continuing education credits, require a professional license or certification that must be periodically renewed, and require professional malpractice insurance. _Covid_ was top line-of-duty death for US police for third year running in 2022.

Our neighbors had that happened to them. And the swat team and detective's ended up having to pay nearly a hundred thousand dollars in damages done to the house. Cause the lead detective got the information wrong (Address) the neighbors are elderly people. The house ended up having to be torn down due to the damages done. The ceilings was destroyed after the swat team went in the attic and a few fell through the ceiling. The swat team and detective's was also court ordered to pay for the construction company to repair all the damages. The house looks way better than before.
It's a deplorable legal situation. If Swat, state or government officials wreck your home, then, of course, they should compensate you! The fact that they use this immunity to avoid compensation is detestable.
Agreed. It also ensures they will do it any time they want. I've met a lot of SWAT officers in my career and the small town ones are the worst and frankly shouldn't be doing that job as they view themselves as some kind of Delta Force operator and have much less training, oversight or guidance.

If a suspect was barricaded in a police officer's home (say the Chief) and the police officer knew that all damage would be on his dime, do you think their approach in getting the suspect would be different? 100%...!!!!
Some SWAT teams handle this situation by surrounding, isolating, cutting power and turning the water off at the meter on the street. They engage the suspect via phone or a bullhorn and talk him out. He isn't going anywhere and unless he starts shooting ouf of the house, he's not a danger.
This behavior by cops is out of control, lacks strategy, discipline and thought beyond a bunch of angry little phony tough guys playing commandos at the taxpayers expense.

If the police had violated someone’s civil rights, the city would be paying the victim millions from a lawsuit. Yet they can’t reimbursement this woman 70k from damages they committed. Disgusting.

Kind of the problem is though that an individual person can not really have sovereignty. By definition that's not what sovereignty is.
The appeal is the most disturbing part. More tax money spent toward not compensating a taxpayer who literally did no wrong. Don't be surprised when citizens dislike and distrust the cops there.

This would also be a huge win for others in the same situation as this lady. Too often cops totally disregard the fact that they’re destroying someone’s property trying to catch a suspect and then leave the property owner to deal with the damage. What she said at the end is the exact thing I said about the insurance company of someone I was in a wreck with. They were at fault, and my car was totaled and I had to have hand surgery. They only wanted to give me $1000! I said, pay me what I'm owed, or pay even more when we go to court. Now they are out $50k to just me and my lawyer, not including what they paid their lawyers.
I live in Texas and am appalled by the state's behavior in this situation. No matter the reason, when police/government encroaches on one's personal property, they have a duty to #1; do their best to limit damage, and #2 clean up any damage they cause. Legislators need to change this law, pronto. I'm sure if it was one of their homes they'd want the law changed too.
If it was be of theirs, it would be fixed the next day.

This happened to my home 2 years ago in Colorado, but the city actually paid/fixed it for us. Granted, the police just broke down our fence to get to a potentially armed guy hiding in our backyard. Nothing crazy like this woman had to go through. It did take about half a year for them to get it fixed. But still..I took it for granted. I thought all state governments would help with any damages police have to make to private property.

I experienced a similar situation when the cops sidestepped my rights by using a drug dog that “hit” on my car to give them probable cause to search the car. After they gained access to my vehicle, they trashed it before realizing that I had nothing illegal in the vehicle. Surprise surprise. 🙄
My buddy had an immaculately restored 1953 Chevy pickup that some cop decided was too nice.
Had the drug dog come in and make a hit.

Rare door interior panels - cut up.
Drugs found = zero.
They left him on the side of the road with all his parts laying on the ground and a warning that he had 30 minutes to pick it all up or he'd be towed.
I hope this appeal blows up in their face so bad it ends up in the supreme court and gets their governmental immunity revoked.

Insurance is a racket. We pay ridiculously high premiums and when we try to file a claim, they try to find some excuse to weasel out of paying.

When the bad guys run into homes the police should stop chasing them and leave. The cops handled this wrong; McKinney SWAT are notoriously unprofessional and typical of small town SWAT - filled with wannabe commandos who fantasize that they are some kind of delta force operators. The numbef of tear gas rounds fired and the damage done to the house where they had a suspect contained completely proves this.

I am battling a city of 5000, west of the metroplex about a hundred miles. It's all about the power and who's in control. I'm not remodeling, I'm REPAIRING. My childhood home after my father passed. I have construction on both sides of the house and they put a stop work order on me. they say it's in the floodplain. Everything thing I do, they block it. I have been looking for a lawyer for months and all I am hearing, is you can't file against the city because of qualified immunity. Who holds the city accountable, the answer is no one.

I’ve wondered about places like this, and if RVs or campers could be allowed to park there year round with sewer/septic, water, and electrical hookups. If there is already a house on this property that was later deemed to be in a flood plain (typically because some mega developer nearby over terraformed the land, or simply due to climate change) then that means that the town is probably getting money from him in the form of water bills, trash pick up, and possibly sewer.
So both the town and state are making money off this guy inheriting this property.

I wonder if there’s some kind of grandfather clause since the house was already established., and those in charge simply aren’t aware of it. Texas taxes you annually on the property, so they should have a record of the square footage. Remodeling should be no different than repairing. For example, damaged interior wall… …you’re not going to find wallpaper that matches, so you may as well texture and paint. Since it’s in a flood plain, you’re not really adding any additional value to it by making it appear modern. Adding a garage or other type of addition, then yeah, you probably will have a problem since you are clearly “building” on the property.

This happened to me a few years ago as a ex military. The damages were extremely outrageous, same here not a dime not even an apology from this animals.

The Lawyer is %100 brilliant. They did a taking for the public benefit and in return need to compensate for those damages. If they can't afford to pay the damages they need to think of smarter less damaging ways of doing the job.
McKinney is a wealthy city. Their High School football team plays in a $70-million dollar stadium. There is a TPC golf course there. Why they don't just pay for the damages is beyond my understanding. Instead, they are going to pay at least as much to fight this out in court.

Plus, if Ms. Baker wins, she may be awarded her attorney’s fees on top of everything else.

I find it hard to believe that this happens in America in this day and age. I would expect this in Africa where I live and certain parts of Asia but not the USA. The police in America are an absolute disgrace. we pay taxes to the govt.. the govt represents us.. we pay for law enforcement.. our taxes should pay to cleanup messes our govt makes.. seems quite simple to me

sadly our government has grown to be a corporation. the gov has cam a long way, we the people have very little representation. the gov makes the rules, and decisions now a days and the people have almost no say in it. even protest and petitions don't effect change in our governments decisions. its a mess and never what our government was intended to be

If she wins in the US Court of Appeals against the police department, it will set a precedent in how law enforcement conducts itself in raids.
There is no reason for law enforcement to destroy a person's property/belongings. The bad guy isn't behind the window blinds, under the coffee table, in the fridge, etc.
I pray that she wins as this is a major game changer for home owners.

If law enforcement knew they' be liable at least in part for destroying someone's home, I assure you they would think twice before destroying it, because it's just like all these high speed pursuits they let go on for 50 miles because they are discouraged from damaging their patrol vehicles. Hit them where it hurts and they won't hit you where it hurts as often.

There's 2 problems here. Of course, obviously the main issue is the police. However it's also a problem that insurance denies the claims for situations like this. Now I can MAYBE see a denial if the policy holder is a criminal and the damage done is a result of themselves being apprehended. However in a situation like this it should be considered in the same category as vandalism.
It is indeed vandalism! But why should you have insurance companies rates increase and the property owners having to pay the deductible?? If there were accountability for their actions they would not be so aggressive and quick to VANDALIZE citizens homes!

I can't imagine the intent of the Supreme Court was that government entities could willfully destroy private property with no recourse. Sure, it has reduced some lawsuits but at what cost. Life. Liberty. Privacy. Fair compensation. This law is way overdue for a review.
Using eminent domain was a very smart move from the attorney. This fits the situation perfectly.

I remember one time a buddy and me got pulled over in his customized car. Cops searched, found nothing and tore his car apart in the process breaking multiple pieces. When it was done they just say "ok well have a nice day". 😠
