I think this was the right decision, both legally and morally. I mean, considering the history between American Indians and the government, the least we can do is do what we promised them we would.

As a Native American of Oklahoma, if the crime happened on our land then it is our problem. What it really is about, it the Federal government respecting that we are a sovereign nation and have our own laws and policies.

Mmm, it seems to be more about telling the State of Oklahoma that *it* has no jurisdiction, but the Federal Government does. The Fed being the original treaty signatory.

@@SansNeural That is correct and is how it is supposed to be given that tribes are supposed to be considered their own nation-state with their own government, etc.
      As it should be.
I'm of the opinion that neither the state nor federal government should have jurisdiction over the tribes and that all of the previous treaties signed by the US government be upheld, even those previously considered moot.

@@adamhester372 If Natives were truly sovereign, they would be allowed to handle those situations in which they always have. The punishments doled out by Native Akcita (police, depending on one's tribe) were harsh, swift, and based on rules set forth within each tribe and agreed to by the tribe.
That child rapist wouldn't be raping again. You'd probably be so happy about the outcome that you'd want all rapists prosecuted by tribes.

The argument over sovereignty of tribes and the state is non existent, .... the truth is, the arguments are between the state and federal governments, either the Federal Government of the United States of America chooses to honor its treaty with sovereign tribes, or, not....the conflict is between feds and states, the tribes understand their treaty’s, the States ignored that and the Federal Government ignored the Tribes Treaty that includes Sovereignty.

Actually land owners who have land in Oklahoma only own the soil on the top of land. Sovereign tribes in Oklahoma own the minerals of the earth in Oklahoma. And whatever is mined or extracted from the earth a portion still has to go to the Sovereign Tribal Nations.

Except that Native tribes are their own nation within the US. I have a citizenship card because I am a member of the Creek (Muscogee) tribe.
The lands owned by Native tribes are supposed to be considered wholly sovereign but the US government still does not uphold its treaties. They never have and never will because the US is filled with Europeans that believe themselves superior to other races.
Native law was far better than European law, prior to colonization of Europeans. In fact, the US Constitution was based almost exclusively on the Iroquois Confederacy. Probably the greatest legal document ever created, and the longest lasting (and still exists to this very day) is the Iroquois Confederacy.
This happened long before white people showed up and continues to this very day.

@@Livingthedream333 Oh, please. Using the term "anti American" when you're talking about land that doesn't even belong to America, and governments that are not "American," that is a silly statement.
Natives are their own nation and I don't care if YOU consider it anti-American or not because this is Native country.
We'll take it back one land purchase at a time. :)
