I’d honestly dock the score for the head coming that close - The driver’s seat slightly further back or a slightly taller passenger would likely have hit their head on the seat!

Thoughts like this is why protocols exist. Ratings from gut feelings would lead to a lot of inconsistencies.

It did indeed get a downgrade for the kinematics subrating for just that reason, but not enough to knock down the overall rating.
