      I was thinking the same, or the end was sticking out a little and it got bumped if she got a little too close, fell over, got hit that way. also if it was just laying out behind her car she'd have seen it just as much as he would. That tiny surfboard prop doesnt really do justice to how long that board actually was.

      Yep. I have kayaks. You NEVER lean them against cars as they have a tendency to fall over. You tie them up immediately or keep them in the grass away from cars to dry off.

    So here's how it happened, he leans it against his car like he said, then get into his car to put on his wetsuit and when he is moving around getting into the wetsuit his car rocks back and forth a bit which knocks down the surfboard to the ground then she comes out and doesn't see it then backs over it.

      Yep. It’s an accident, but it’s hardly her fault because there’s no way to see it from the car.
      Just one of those things where you’re supposed to kick yourself for not taking better care to avoid an accident like this.

      Yep. I have a kayak and you are NEVER supposed to unload it unless you are immediately ready to go put it in the water. Not only can the item be damaged by cars but it can be stolen or fall down and crack

    Even after he admits in court that his story makes no sense, he is still unable to accept fault for his own actions in the end. There are only 2 real possibilities with what happened here - either the Plaintiff arrogantly placed his surfboard on the ground behind a random car because he assumed no one would be leaving the beach that early and thought it would be safe while he changed, or he placed it behind this womans car on purpose with the purpose of having her drive over it, so he could then demand she pay him for a new board. I suppose he could also have placed the board the way he said, and then whle he was changing the board fell over in such a way that it was in the Defendants way as she was backing up to leave...but in any case, the Defendant is not at fault at all.

    She totally drove over it. He may have been careless with where he put it but if you're backing up you sure as heck better check your surroundings. That's how kids get run over.

      I agree. He was careless but she had an attitude about the whole situation. I think she saw the board on the ground when she got in her car and ran it over. I don’t believe that the police told her to pay for it either.

    The plaintiff was negligent about not securing his surfboard, (it probably fell over) then the defendant ran over it not seeing it. I totally believe the plaintiff was intimidating - saying his parent was a cop, just bought it 2 years ago, his surfer friends were around etc. Good job to the lady for not agreeing to pay.

    Not a surfer (live near the mountains and so there is no waves) but I do have kayaks. You are responsible for ensuring they are OFF the ground and out of the way of cars. Keep them either tied on cars or in the grass/off the concrete. They are easily damaged on hard surfaces so as soon as you are done with it put it up high or in a trunk if it fits.

    Couldve just left it on ur roof or something while u changed lol. When i put on my snowboard gear outside i dont lay my board on the ground. It stays in my trunk until im done. My snowboard is too expensive to be ran over by someone's car. Common sense

    I know how it might have happened, it happened to a friend of mine, he had put his board as the plaintiff said against his own car but a good part of it was sticking out beyond his car, which meant as the defendant backed out and cornered slightly then she would have knocked over his board, and then run it over, which means this would have been his fault any way, for leaving the board in a precarious position...

    I think they're both responsible. He was careless with where he put his board and she probably needed to double check her surroundings when she backed out, which is what you're supposed to do. I don't understand why Judge Milian didn't bring that up. I think that's kinda an important point.

    Y’all are messed up IT DOES NOT MATTER IF HE PUT IT THERE OR NOT if a person is standing there and she runs them over is it the persons fault for being there? No it is always the drivers responsibility to make sure you do not impact anything ESPECIALLY in a parking lot. In fact most parking lot collisions result in 50/50 responsibility. She’s taking it out on him because he may or may not have left the board there. ALSO the wind may have pushed the board over you don’t know. No one does cause no one was watching. He’s inside the car and she doesn’t car. Unreal people. Think

    He's suing her for $924.25, When he only paid $550.00 for it. And she wasn't even at fault. And even if she had been, she would only have to pay the depreciated value, which certainly is not $924.25, when he didn't pay that amount in the first place, and he's had it for two years. This guy was trying to pull a fast one. I'm glad he lost the case.

    Honestly, the plaintiff still had a case. Any driver must perform a 360 search of their vehicle prior to moving the vehicle. The defendant failed and should have been held somewhat responsible for the damages…

    It sounds like either he just dropped it to get changed, not paying attention to where he left it (which is what I think happened), or he put it against his car, not carefully, and it fell over. ENTIRELY his fault. In fact, he's lucky his surfboard didn't damage her car/tires or HE would be responsible for her damage. A good lesson for him.

    How is this defendants fault anyway? He needs to take care of his property not put it under someones vehicle. I have feeling he damaged it and then tried to set up the lady to pay for it😬. Unless he put it agains his car and it fell over right under her car.

    She should have made a point that accidents happen. There was absolutely no reason to have flipped out on her even if it was her fault. Kids these days need to calm the fck down and take a breath. It’s not hard to act like a decent human being.

    The fact he didn't point out or JM couldn't figure out that having his surf board exactly as he stated and her hitting it because it could have been sticking out past the trunk boggles my mind. Plenty of surfers lay them exactly like that throughout my years, I leave mine on my roof till I'm ready for these exact reasons. If it was on the ground like she says, SHE would have seen it getting in her car. I think they are both liable

      Exactly what I was thinking! I thought it could have been leaning up against his car but stuck out further at the trunk. Then I thought , she got into her car but didn’t see the board behind it? She might not have had she come from the front of her car to get in though. Kind of a case of he said/she said.
