So here's how it happened, he leans it against his car like he said, then get into his car to put on his wetsuit and when he is moving around getting into the wetsuit his car rocks back and forth a bit which knocks down the surfboard to the ground then she comes out and doesn't see it then backs over it.

There are only 2 real possibilities with what happened here - either the Plaintiff arrogantly placed his surfboard on the ground behind a random car because he assumed no one would be leaving the beach that early and thought it would be safe while he changed, or he placed it behind this womans car on purpose with the purpose of having her drive over it, so he could then demand she pay him for a new board. I suppose he could also have placed the board the way he said, and then whle he was changing the board fell over in such a way that it was in the Defendants way as she was backing up to leave...but in any case, the Defendant is not at fault at all.

Not a surfer (live near the mountains and so there is no waves) but I do have kayaks. You are responsible for ensuring they are OFF the ground and out of the way of cars. Keep them either tied on cars or in the grass/off the concrete. They are easily damaged on hard surfaces so as soon as you are done with it put it up high or in a trunk if it fits.
