  • If this video is helpful but you want something more, why not check out my new video "Contract Law in Two Hours" which takes you right through an undergraduate contract law course in two hours! It's at • Contract Law in Two Hours
    This presentation is part of a course on Contract Law presented by Anthony Marinac from CQUniversity www.cqu.edu.au/law. In this video we look at the difference between social agreements and commercial agreements - because not every agreement (particularly between family and friends) is truly supposed to create obligations which give rise to legal rights and responsibilities.
    The full course may be viewed on iTunesU at the CQUniversity site. Visit CQU Law on Facebook / cqu-law .

      Hi Nick, thanks so much for your kind words! At the moment life is already too crazy for me, and I am not sure I would be able to guarantee the level of support a tutored student would require. Good luck with your studies though! :)

    Anthony thank you for your lectures.
    Also, please try to up the volume of your videos. When I listen to your videos, they are uploaded in low sound volume and when an ad comes the sound volume difference breaks my ear drums.
    Cheers

      Hi there, thanks for this. The contract law lectures were recorded in 2014, and frankly back then I had no clue about audio recording or postproduction. Hopefully my videos are heaps better these days :)

    Hi Anthony. Do you agree that there is not much value to rely on general presumptions in the context of intention to create legal relations because the situations in individual relationships and the agreements made between individuals vary infinitely?

    • @AnthsLawSchool
      @AnthsLawSchool  3 роки тому +2

      Hi JMF,
      What I would say is that the presumptions give a starting point, and no more than that. They are presumptions, not rules. From there, it will be up to the parties to advocate their views as to whether the presumption should apply or not, and why :)

    hello, i have a question. what about a friend who is selling his car and writes to his friend , telling him the price, and give him a due date when it will be up. would that be an intention to create legal relation?

      It really does depend on the surrounding evidence. Was this just a deal between mates? And did the buyer ever actually agree?

    Hi Anthony, have you been following this case at all-Burrell v Shelmerdine, where the daughter is suing her mother over a promised mansion. I believe the daughter Celia Burrell won the right to use the mansions kitchen over Christmas! I was just interested to see that these kind of disputes between family members over promises can end up in court. I couldn't find any major details regarding what was actually in writing, and what was merely a promise. Sounds very messy and unpleasant.

    • @AnthsLawSchool
      @AnthsLawSchool  3 роки тому +1

      Hi Jase, I am aware of that case, but only through the media. When you get to succession law, you'll learn about mutual wills, which operate like a contract between two parties making wills. Add in some interesting ethical issues and about a squillion bucks and you get Burrell v Shelmerdine :)
