- In this episode of ‘Editorial’, Mr. Sujit Nair addresses the remarks made by the Election Commission of India (ECI) regarding Form 17C in the Supreme Court. Recently, the ECI opposed a plea requesting public access to Form 17C, the statutory record of votes cast at polling stations.
The Election Commission opposed the application by ADR and Common Cause, which sought the immediate release of voter turnout data for the ongoing Lok Sabha Elections. The ECI argued before the Supreme Court that making Form 17C data publicly available could lead to an increased risk of images being morphed, including counting results, which can create widespread public discomfort and mistrust in the electoral process.

When I went to vote, the guard at the entrance told me that I cannot carry my mobile. But they have not kept a place to deposit mobiles and I was told to leave my mobile at home and come for vote. They simply do not want people to vote unless they are sure that you are voting for the BJP!!
I carried my phone, but then I put it inside my vehicle. The alternative would be going along with your family or friends to keep your phone while you go vote, vice versa.
We were also fooled by the people there and send back.

we let the phone near the guard with no guarantee. people are good and We need no trust more than that. believe me they all keep watch for you till you come back as they are next in line. I had never seen the environment secure and the people were found within 100mtr canvasing near booth and were sent to get slip written from party people over serial no. given by eci listing. even guard is trained to say the same. too much.. returning officer was murmurring something about latest list from which I downloaded serial no. two days back. election day the site was not reachable.
By hook or crook ECI will make sure that BJP wins. It’s all settled. People’s votes doesn’t matter anymore in India.
You can leave India if you have problems living here. Nobody is stopping you

Then who will conduct elections..You and I ECI is a constitutional body. Until recently the ECI was selected not elected but by the ruling party . Now there is a committee to select the ECI. ECI is a must. The organisation which was run by a single person became a three men institution . Those in the knowhow know what prompted this change.

As a software engineer, I find it amusing that ECI is saying that the form 17c can be morphed.
From my experience in computers for over 20 years, images can be morphed. Documents maintained on a website cannot be morphed. Documents can be modified, but that would need a hacker who can gain access to their system and can replace the original copy with his/her copy.
But this is possible with all websites across the world. That's why security and other acess control mechanisms are put in place so that websites cannot be hacked.

All Candidates have Form 17 C signed by everyone from every both. The India Alliance candidates should print this form 17 C in their constituency and print this in Newspapers. Please let EC know that it should ensure that before declaring results the number of votes cast according to form 17C should tally with the results declared.

ECI has a lot of power if they want to use it. When I was in school there was an Election Commissioner by name TN Seshan. He was outright crazy and all politicians were afraid of him. I mean crazy in a good way.

ECI is trying to please the current government. I feel ECI selection should be similar to what we have for President(voting done by every candidates of both Loksakha and Rajya Sabha) and we should have their performance reviewed every year like we have in Corporates. Also no ECI terms should be extended, Is INDIA short of candidates to hold such higher position. Our India has such a pool of brilliant talented people who can take care of all type of complex responsibility.

Art 329(b) does not say any such thing as the ECI suggests...Article 329,b):
No nelection to either House of Parliament or to the House or either House of the Legislature of a State shall be called in question except by an election petition presented to such authority and in such manner as may be provided for by or under any law made by the appropriate Legislature.

It appears that ECI is Not Neutral and is favouring Ruling Combine. Opposition may be badly rattled after counting.

The 17C form does not reveal the details of to who the people voted for. So there will be no legal problem.
On the contrary, the difference between the voting and the percentage of votes would be brought to light. So the BJP and the Election Commission are afraid.
