Have you considered doing an HPI check when you win the car at the auction but before you pay for it - that way you would have done the HPI check anyway but are in a far stronger position with BCA ie you dont pay because its stolen but you dont have to wait many days for your money back

How about this one, bought a 2018 ZOE from a major UK car dealer company with multiple franchises, it was advertised as battery owned in a named General Manager statement. I asked for the HPi cert but didnt get it until after delivery. There were 2 records on the HPi statement one for car finance which was later settled and one for RCI/Mobilize for the battery lease! This dealer chain ended up paying £4,500 to buy the battery for me. I sold tbe battery owned ZOE to a dealer a year later for £6,500 more than we paid for it so the hassle paid off in the end. r@@ModernHeroes

Sounds to me like you’ve answered your own question. The original owner sold to WBAC, but for whatever reason (perhaps he/she had to sell quickly and had to take the usual lowball offer they give for EV’s, particularly low range ones) they then reported it stolen to get a further payout from insurance.
Obviously when WBAC did their checks in that instance, there would have been no marker on it, and because it came from them BCA aren’t going to do a second check within group before the auction.
It’s now up to the police to find the insurance company that it was reported stolen to, and for them to confront customer and press charges for insurance fraud.

We had problems with selling my Dad’s car to WBAC - within 10 minutes of change of owner being registered that same day with DVLA by WBAC Dad’s insurance company called (before we had had time to cancel the policy) to say that the car had been involved in an accident 290 miles away…………….. as we were still close to the handover hut I drove back and FaceTimed the insurers to say look the car is still here in Scotland and you are claiming it’s just had an accident in Birmingham……. that’s swift travelling for a Honda Jazz. It was an insurance fraud, what was really interesting was that the car that was parked next to mine in the car park disappeared out of the car park in a cloud of dust and squealing tyres! Must have clocked on to why we had returned!

My takeaway is the 'whatevs m8' customer service - mistakes happen - but is the response that counts. Especially as they were effectively holding on to your working capital for several days. Makes you wonder if they rely on WBAC data showing not stolen at point of purchase into the trade, and don't re-check on re-sale.

    • @ModernHeroes
      @ModernHeroes  Місяць тому

Yeah I fully expect that’s what’s happened - another check done before the sale would’ve highlighted the issue.

If 'We Buy Any Car' (even stolen ones ...) bought the car before it was reported stolen, and they checked it was OK, then that information may have just followed the car through the internal process without being checked again. BCA sold it to you after it was reported nicked. It would be interesting to know the timeline and who sold it and how they acquired it. Most likely we will never know. Caveat emptor and all that.

I have just ran a check on this car for free on Total Car Check, all you have
to do is register with them and you get a basic check with MOT history for free.
This one shows as stolen on the 02 July by the Met Police.
I think this car was bought by the vendor before it was on the stolen register.
But it takes time to enter a car into an auction so by then it would have been
    showing as stolen.
Clearly BCA are not to be trusted, i hope your refund has been received.

Interesting to hear that you’re still confident in what BCA is doing generally. It’s easier to treat this as an isolated incident because it lets you carry on using them/carrying on with your business model of picking up your cars from them. They may be doing other things correctly but I’d worry about a lot of it being a front. Not knocking you by the way.

Many, many years ago; approaching the launch of the then, brand new Mk1 Vauxhall Zafira; I was in charge of a depot with 250 examples, going out to dealers prior to launch day.
    One went missing.
It was discovered, entered for sale at a nearby BCA auction house; hours before the auction started.
I dont know exactly what happened, if it was a mistake by a dealer employee, or an actual attempt to sell it by a corrupt employee; but either way, BCA should have picked up on it, as soon as it arrived.

I bought a car from BCA and when i sent off the log book i got a letter back to say the vehicle had an export marker on it and was no longer registered in the UK! BCA were not interested and washed there hands of it. DVLA wouldnt tell me where the car had been exported to but it had Northern Ireland font plates with a garage name in NI. After speaking to them they remembered the car and who they sold it too who lived in Southern Ireland (destinctive car colour and trim). Southern Ireland had never registered it and neither had NI, I had to get statements from each, account from the dealer and eventually DVLA inspected the car and issued a new logbook.
BCA hadnt done the checks they should have in this instance and I would guess there are numerous others that also slip through the net due to the volume they process.
Have never bought through BCA again.

You're spot on. They had no title in the car, so there was no sale. The WBAC loop is a matter for BCA to sort (& it's probably a sticky conversation for someone to have) but that's nothing to do with you. You should have your money back immediately. If it's not in your account Monday, then demand a BACS transfer.

  • @ClanMidgard
    @ClanMidgard Місяць тому +4

Considering the fees, that is NOT ok. Something more than you simply getting your money back needs to happen there, and someone needs to lose their job. I would contact Trading Standards about that too, they are not living up to their ToS, meaning they are not giving you the service you are paying for.

  • @briangriffiths114

Chops Garage gradually reduced his dependency on buying from BCA and started forming relationships with dealers who had older vehicles that they had no interest in valeting and selling, as it didn't fit their business model. He also regularly promoted using Car Vertical prior to handing over money for these vehicles.
I don't know your area well, but are there local dealers that may have taken in older EVs which they would rather trade out for a reasonable price than try and sell themselves, as this would avoid all your costs of buying from auction?

Had a situation many years ago, not involving an auction house, where a car came up as "stolen, obtained by fraud". This was pre internet, etc, so no instant checks could be made. The new owner, similar to yourself, was the innocent party. He had bought it from a second hand car dealer, who I also believe was unaware. The previous owner sold the car to someone and the cheque bounced. He reported it as stolen. Meanwhile the rubber cheque man sold it to the car dealer. It was subsequently dealt with by our legal department and I have no idea of the final outcome. I have my suspicions, but absolutely no proof, that the original owner and rubber cheque man were in cahoots.
However, with the checks available to BCA, it shouldn't have got as far as being available for sale. Cheers

Typical UK experience seemingly universal - you have a problem, you talk to customer services, but you might as well talk to your dog - customer services staff utterly clueless (no doubt appallingly trained and poorly paid). They can take your money but can't handle anything that is the slightest bit non-standard or requires consideration or action. And companies wonder why people have no brand loyalty these days.....

Very interesting. How the car ended up being reported stolen is one thing; BCA's shocking and completely appaling lack of corporate integrity, not to mention its non-functioning customer service interface quite another (I'd say the guy who listened to you and respected you demonstrated his own personal values, not BCA's). I'd stay well clear of them in future. Shoreham Vehicle Auctions gets some excellent press and might be worth checking out. Best of luck with your own business. I know someone who recently worked for BCA delivering vehicles up and down the UK and were being paid less than the minimum wage because their hours would constantly over run. WHAT CAUGHT MY ATTENTION, was when you said they are preparing docs to effectively 'buy the car back off you'!
This sounds worrying to me! Could they in theory, now report you for selling them a stolen car?
Surely they have to have a refund policy, that actually refunds you and doesn't buy back from you?
I've heard from reliable sources about WeBuy terms/conditions and the potential comeback power it has over customers, even if weeks after buying a car from 'joe public' they can charge money for 'repairs' or just cancel the sale because of a major undeclared fault by the seller. That's ok in theory, but again it can open a can of worms in what they deem major fault or wear n tear!
Even though this group of companies (IMO) are a bit dodgy and they will never get my custom, I highly doubt they would be stupid enough to report you and make their reputation even worse!
