When a trans goes over 100,000 miles for service, fluid is black or has never been serviced, when it gets serviced there is a chance that can cause problems with the trans. This doesn't happen every trans but the problem is common enough that shops are not going to gamble making a couple hundred dollars on a risky service only to have a problem and get sued for thousands of dollars.
