From a Constitutional standpoint, that violates, among other things, your right to a fair trial. If they get away with that, we have no rights. It also will have consequences for the jury members who might have voted the opposite of the verdict.

By not specifying the alleged predicate crime and nor even narrowing it down until closing arguments, the defense had no way to know what they were defending against.
