Your credibility on the subject is impeccable so far 🙄 I’ve got one that will blow your mind: where I live, it’s an HOA or the ghetto. That’s how life is for those who don’t live in the sticks. And I live in a neighborhood populated by realtors, doctors, engineers and lawyers, of which I am the latter (and a judge in the military, serving over 30 years). You think we’re too stupid to investigate our own prospective neighborhoods when shopping for a house? You know what’s actually stupid? Watching stories that are the exception and deciding they’re the rule. That’s the epitome of idiotic. But really, I would love for you to educate me about my alleged stupidity. FYI, I’ve lived in no less than 7 HOAs over a career and had ZERO issues. I must have done my due diligence after all🤦🏾‍♀️

      This comment reminds me of someone who thinks the grass is always greener on the other side. Wait until you live in a hell hole, and then you’ll be complaining how little power the city has and how they won’t use it often times, and how the neighbors have no power.
      It’s easy to get all worked up and blame HOA’s because one out of five have big problems, but an 80% success rate doesn’t seem so bad.

      Personally, I'd say the community was getting off light. HOA management companies would have charged the community considerably more for the same thing. My guess is the residents are too ignorant to understand that.

      you are smart. why pay rent on something you own or have a mortgage on? the fees never go down only up, so eventually you would be paying the same amount in fees that you pay for your mortgage. what a racket.

    I never heard an HOA story that made it sound better than no HOA. Tell your realtor, "No HOA, no exception" and if they show you an HOA home you fire them.

      Cute, you clearly live somewhere that’s a viable option or don’t mind living in a ghetto. In many places it’s one or the other. You need to stay put wherever you are, presumably in an old home or in a bad neighborhood, while the rest of us living in major cities continue to function with no issues. You people watch these one-off stories then assume that’s how the majority functions. And then you go one better and insult the intelligence of everyone who lives differently than you.       We live in the middle of nowhere, specifically to avoid HOAs. Over half an hour to the closest grocery store, and still worth it. I actually like it better than living in the city or the burbs.

    My HOA in Breckenridge Colorado had a president doing the same thing, The property manager knew and was himself charging us interest for money used to pay bills, despite no need for such a “service “. I discovered this after I found out he was being paid to “supervise” the painting of our building. The paint job was lousy. In Denver our property manager was committing financial crimes against us as well. If you live in an HOA go check the expense records.

    HOAs claim the main factor you should live in an HOA is so they can regulate the front of the properties and make sure there is no blight, i have never lived in an HOA , and i have never seen such things in the neighborhoods i lived in. Most people keep there properties nice enough from my perspective.

    Never willingly enter into an HOA. They tend to always be crooked. There needs to be government oversight for any entity that can foreclose on you and take your house without being a bank or financial institution that loaned money initially on the purchase. You should be able to opt out of an HOA at any time for any reason. I'd put a lien on their property ASAP to ensure they can't sell their property then look to freeze any and all assets while the case is being investigated further.

    Because all HOA’s should have an independent auditor annually. Plus 3 signatures on all checks. Also bylaws are requiring monthly/annual meetings and approval of the bills, minutes of the previous months meeting, etc.

    Not having an annual meeting is illegal in all 50 states. At least 1 meeting must be held each year if only to affirm the officers of the board. The HOA had been operating illegally since at least 2003.

    This requires a careful read of the HOA bylaws. The husband is correct that property management is a lot of work, and appropriate compensation is an accepted practice. As a former property manager myself, the heart of the issue is always in the details. What kind of compensation was she entitled to and how is it calculated? Was she required to provide a detailed report? Did she actually violate the bylaws? There's a lot more to this story than what appears here.

    Reminds me of a scam a local realtor was doing a sixteen years ago. It was following Hurricane Katrina which had displaced thousands of people. Those displaced people had to go through the ordeal of finding a new place to live temporarily or otherwise. I filled out a rental application of a realtor who had dozens and dozens of units ready to be placed on the market. As i was getting ready to hand over the rental application i was told i needed to provide a cash payment of $40 so that a credit check could be done. I walked away from that scenario with my application in hand. I bet they pulled that scam 30-40 times a day.......

    Much as i hate HOA's, the officers probably should get some sort of agreed upon payment for the work they do. I refuse to participate in mine just because of that, I'm not doing whatever work they have to do for free. My HOA dues are 125 a month, even knocking 25 bucks off that would make me at least consider running for something. Otherwise i ain't doing jack. Don't get me wrong, those payments should be fully transparent to everyone who lives there and this chick should go to prison.

    Usually, State law prohibits compensation to Board members of HOA’s. Get a lien on her property or file a lawsuit and a lis pendens. Report it to the IRS. They can find her social security number. They’re good at it.

    I am not a fan of HOA/s at all, but to consider that all the work and necessary dealings of the assocation are assumed to be free is ridiculus of someone's time. I hope it gets worked out, but at the same time, no one up until now has noticed which does make you wonder about the fact that there haven't been any meetings held.

    keep saying the same thing HOA's should not be any more than a group of people making sure the neighborhood looks good (not by meddling with private properties ) by keeping sidewalks clean/snow-/ice-free, by making sure streets are safe, clean (renting a sweeper or throwing salt to melt the snow/ice), making sure parks stay lush and green, maintain the pool(s) if any and/or playgrounds... And maybe plan a BBQ* or some other (free) event
    -Any fee should never be more than a few bucks per (adult) person a month -kids are exempt, they lack income (let's say 20-ish maximum, maybe higher at million dollar villa neighborhoods)
    Anything else should be an automatic NO unless 90%+ of the people in the hood actually want a change, and actually gets approved
    *=can be bring your own food/drinks based to keep it cheaper

      Maybe, but she also has not paid her HOA monthly fees and she did not do so in all the years she held office, it’s called embezzling non of the residence knew about it, there are no maintenance records to backup her claims and they only had her signature only, why was there no signature from the treasurer or the secretary. There must be 2 signatures on all cheques to ensure that this sort of thing never happens.

    labor owed for is also a "reimbursement". Law says min wage at least for labor even for non-profit employees. Organizations like Easter Seals pays employees yet is a non-profit that houses homeless people through tax grants. Where in writing does it say a non-profit does not have to pay people for labor that allows the non-profit to continue to exist?

    400 dollars a month sounds fair. Why would anyone deal with other people for less than a hundred dollars a week. It would cost at least double to have a company do it and I bet you'd never see anyone

    So the former HOA president was paying herself $600 a month ($150 per week) to do a job that no one else wanted to do. This went on for 15 years? Yeah, sounds like no one else wanted her job as president of the HOA. Lazy homeowners, mad because she paid herself without their vote, which to be fair was wrong...but everybody sucks here.

    HOA are protected and not regulated. They can do whatever they want whenever they want. They can discriminate based on race and don’t have to provide any transparency. Why are they legal?
