वकील साहब नमस्ते, इस क़ानून में एक बहुत बड़ी कमी है, न्यायालय भूमि मूल्य बाज़ार भाव से तय नहीं करता, संक्षिप्त में जैसे दिल्ली में एक फ़्लैट की क़ीमत बाज़ार भाव से एक करोड़ है जबकि सर्किल रेट 25 लाख ही है, आप समझ गये, विक्रेता को बहुत आर्थिक नुक़सान होने की प्रबल संभावना है, सम्पत्ति के भाव बोली के आधार पर निर्धारित हों , उस भाव पर पैतृक संपत्ति में भाई बहन को प्राथमिकता होनी चाहिए ।

You have to get NOC from siblings/ their heir. I know one case where seller paid court clerk and got papers altered showing only himself as heir and sold the property. Others didn't go to court because it's very costly and their share wouldn't justify all that trouble.

Grand daughter cannot claim. Her father (your nephew (son of your brother) being in the second tier can claim if your brother is not surving If brother is surviving, he is in first tier, so first he can claim. Tell her to send you court notice for claiming. The court will dispose her case.

1) grandmother had self acquired property. She mentioned in will and gave her property to her 2 daughter's and 1 son.
2)one daughter is divorced and have 1 daughter.
Second daughter is unmarried have no children.
And my father(grandmother's son) have two children me and my sister.
Can me and my sister claim share in property of my father and his sister who is unmarried?
Or

If Grand Father purchased property then that should be treated as ancestors property or not. Because you mentioned 4th generation but what about 3rd generation
I think Law is already there and there is not any new in judgement. So it only declaration of law which is already mentioned in the HMA, 1955

You have to get NOC from siblings/ their heir. I know one case where seller paid court clerk and got papers altered showing only himself as heir and sold the property. Others didn't go to court because it's very costly and their share wouldn't justify all that trouble.

My father is having three and half acars of land in native place, but my brother grand daughter having claiming that property,by law is eligible to claim that property. Pls replay sirji.
Grand daughter cannot claim. Her father (your nephew (son of your brother) being in the second tier can claim if your brother is not surving If brother is surviving, he is in first tier, so first he can claim. Tell her to send you court notice for claiming. The court will dispose her case.

If brother not alive then his son comes in first tier. His son can claim. If he is not alive only then his daughter (granddaughter of your brother) can claim.
