    वकील साहब नमस्ते, इस क़ानून में एक बहुत बड़ी कमी है, न्यायालय भूमि मूल्य बाज़ार भाव से तय नहीं करता, संक्षिप्त में जैसे दिल्ली में एक फ़्लैट की क़ीमत बाज़ार भाव से एक करोड़ है जबकि सर्किल रेट 25 लाख ही है, आप समझ गये, विक्रेता को बहुत आर्थिक नुक़सान होने की प्रबल संभावना है, सम्पत्ति के भाव बोली के आधार पर निर्धारित हों , उस भाव पर पैतृक संपत्ति में भाई बहन को प्राथमिकता होनी चाहिए ।

      But actual rate is always higher that difference is taken as cash..

    mere bhae father ke dwara kharidi comercial property ka use kar raha hai or mujhe use nahi karne deraha hai or partiton suit bhi kar diya hai 5 year se suit chal hi raha hai hum kya kare jise hum bhi us jajah ko istemal ka sake ?

    Mera ek Doubt tha jo 3rd party kl represent krt he..
    Support 2 bhai he A & B.
    Aur A ne property 3rd party C ko bech diya B ko puche bina..
    Aur court ne bol diya ke aap B ko puche biger bech mhi skte matlb A & C ka deal cancle mana jayega..
    To iss situation me C ko kya milega? Usne jo paise lagaye the usme se use kita return milega ya nhi? Aur agr mila to kuch add home milega ya nhi?

    1. Date of verdict kya hai aur Kya ye back date se lagu hoga ya ab aage se isko lagu karenge.
    2. Jitne bhi bhai bahan hai unse kya NOC lena hoga?

    Meri Nani ka property hai aur meri maa aklouti hai , humlog teen Bhai hain , mai second no per hoon , mere bare Bhai aur chhote bhai ,dono mile huye hai, mother ko bhi mujhse door Up (Uttar Pradesh)me Rakhte hai , mere se khatpat ho rakha hai , property jharkhand me hai , kya ush property per Mera adhikar hoga ya nahi , kyunki wah dono bhai ush karoro ki property bechna chahta hai aur koshish bhi kar raha hai , please reply????

    1) grandmother had self acquired property. She mentioned in will and gave her property to her 2 daughter's and 1 son.
    2)one daughter is divorced and have 1 daughter.
    Second daughter is unmarried have no children.
    And my father(grandmother's son) have two children me and my sister.
    Can me and my sister claim share in property of my father and his sister who is unmarried?
    Or
    They can give their property to whoever they want to like my grandmother?? Will we get equal share like ansestral property?

    If Grand Father purchased property then that should be treated as ancestors property or not. Because you mentioned 4th generation but what about 3rd generation

    I think Law is already there and there is not any new in judgement. So it only declaration of law which is already mentioned in the HMA, 1955

    If the price Valued by authorised agency is far less than the actual market value then what ??
    Secondly if third party is ready to pay at market value or more than it then what??
    If property is sold 15-20 years ago...can legal proceedings by done today ????

      You have to get NOC from siblings/ their heir. I know one case where seller paid court clerk and got papers altered showing only himself as heir and sold the property. Others didn't go to court because it's very costly and their share wouldn't justify all that trouble.

    Mere papa (expired) ki self acquired property hai Delhi main 5 crore ki.... And ancestors ki 1 crore ki...main and mere brother main koi disputes nhi hai..... But humari 1 crore ki village main padi hai boht saalo se....

    My father is having three and half acars of land in native place, but my brother grand daughter having claiming that property,by law is eligible to claim that property. Pls replay sirji.

      Grand daughter cannot claim. Her father (your nephew (son of your brother) being in the second tier can claim if your brother is not surving If brother is surviving, he is in first tier, so first he can claim. Tell her to send you court notice for claiming. The court will dispose her case.

      @@gangadhar3954 , I am lady dear.. I hope you understood.. Property belongs to your father. So property is distributed between all children. Your brother and you in first tier. If brother not alive then his son comes in first tier. His son can claim. If he is not alive only then his daughter (granddaughter of your brother) can claim. Tell her to take NOC from her father and grandfather (your brother).

    Dear Sir,
    Thanks for your clarification however I have a doubt.....
    1. Is this rule or regulation is valid within the close family or within the cousins also?
    Example - My Grandfather had 4 Cousins and one of the cousin family (third generation) now selling their Patrik Sampatti to a other Person, Now can I put a case against him stating that he has not asked from us ??

      You can do that only if that stated property is registered on the name of your "Great-grandfather". And your grandfather is his legal heir
