I am a supporter of the law enforced in 2005 that even girls have share in their parent’s property as all kids are equal for parents. But I believe there should also be a condition to this law that if a married daughter takes equal share as her brother then why the care taking of parents is the sole responsibility of a son and her wife? I mean at the time of treating girls equal to boys while dividing the property then it should be lawfully compulsory to sign a memorandum that in case of medical emergencies of parents the hospital bills( which are huge these days) should also be shared by the daughters. If they agree so only then they should be given their share.

hello sir, Confusion about the below clause. 1. Mother purchased land 1942 & died before 1956 2. Daughter has right on this property? 3. The third generation of the mother's grandson claims daughter cannot claim share on this property for becoz she died before 1956 where daughter cannot claim as per previous laws of HSL The third generation of the daughter's son has stayed since 1955 & built the house on his income but on 2011 received a letter for eviction . Sir as per the first right you mentioned, if the son is born after grandfather/mother expired then he/she doesn't have right in the property by birth. Does that mean he/she doesn't have right in the property at all? E.g. if X's only child is Y and Y's only child is Z. Z is born after demise of X. Will he ever be able to claim his right in the ancestral property passed on to Y from X after his death?

As I understand ancestral inherited property (without will) can not pass on to next generation by WILL. It is not willable. So next generation gets right in such property. Whereas you said that it gets converted to self acquired property.

Regarding Rights of daughters,in ancestral property..it is still in favour of sons.Else ,why daughters have to fight for her legal right.The brothers refuse to give sisters their share of wealth and fight against sisters ,to not give ancestral wealth. Court matter simply means a long wait . The merit of the case is hardly seen or read by busy lawyers and judge. It is more about the procedure that the actual justice. I am a supporter of the law enforced in 2005 that even girls have share in their parent’s property as all kids are equal for parents. But I believe there should also be a condition to this law that if a married daughter takes equal share as her brother then why the care taking of parents is the sole responsibility of a son and her wife? I mean at the time of treating girls equal to boys while dividing the property then it should be lawfully compulsory to sign a memorandum that in case of medical emergencies of parents the hospital bills( which are huge these days) should also be shared by the daughters. If they agree so only then they should be given their share.

मैंने कुछ ऐसे केस देखे हैं जो साथ 70 साल की बुढ़ि महिलाए भी अपने पैतृक संपत्ति पर अधिकार जमाने के लिए गई है जिनके बेटे ,पोते सभी बड़े बड़े काम में लगे हुए हैं। जिस भाई पर मुकदमा किया है वे भी जीवित नहीं है, आमदनी में गरीब भतिजा के स लड़ रहा है सिर्फ एक मिट्टी के मकान के लिए।
उत्तराखंड राज्य मे आज भी पैतृक संपत्ति की जानकारी तहसीलों तक सीमित है।इसका दुरुपयोग हो रहा है।

property should be automatically distributed equally between sons and daughters. There must be few formality or not at all. Because sometimes parents have 3 sons and they make difference in them and give 2 sons more share/ all share and one remains without any share. This is not good for that poor son future.
My maternal grandfather never gave a single rupee to my mom. He wrote everything to his son, ( my mama) . my mother took care of her aged, sick parents fo years, but finally she got nothing.

But what if that son doesn't respect his parents . If somebody is not being respectful to their parents then the share of parents property shouldn't be given to him/her.
Why are sons dependent on father's property, unlike western countries they're getting rent free accomodation, free child care and family support. Why isn't this enough and we also need to fight for his property instead of working to create our own properties. I wish these property issues never get resolved and rot in court for decades.

Confusion about the below clause.
1. Mother purchased land 1942 & died before 1956
2. Daughter has right on this property?
3. The third generation of the mother's grandson claims daughter cannot claim share on this property for becoz she died before 1956 where daughter cannot claim as per previous laws of HSL
The third generation of the daughter's son has stayed since 1955 & built the house on his income but on 2011 received a letter for eviction .

Sir as per the first right you mentioned, if the son is born after grandfather/mother expired then he/she doesn't have right in the property by birth. Does that mean he/she doesn't have right in the property at all? E.g. if X's only child is Y and Y's only child is Z. Z is born after demise of X. Will he ever be able to claim his right in the ancestral property passed on to Y from X after his death?

As I understand ancestral inherited property (without will) can not pass on to next generation by WILL. It is not willable. So next generation gets right in such property. Whereas you said that it gets converted to self acquired property.
If there are other coparcener his share can't be bequeathed by Will.

Second wife doesn't have any right in the property as this marriage is not legal according to hindu marriage act but children born with second wife will have all the rights in the property.
The landed property recieved on succession by my grandfather was equally divided in 5 equal parts. He distributed 4 parts to his sons including my father and kept 1part for himself.
My grandmother inherited this property on the demise of my grandfather.
One of my surviving uncle (my father and one of my uncle have since died) got this property transferred (by way of WILL or Sale Deed is not known to me) in his name from my grandmother, before her death.
Do I have any right on the above property inherited by my grandmother ?
You'll have to get the old documents to be exactly sure & then take advice from some advocate .

Regarding Rights of daughters,in ancestral property..it is still in favour of sons.Else ,why daughters have to fight for her legal right.The brothers refuse to give sisters their share of wealth and fight against sisters ,to not give ancestral wealth. There is no law in this country ,guarding the daughters or sisters or girl child's equal share in ancestral wealth...the brothers, role in money and sisters die pauper .
Brothers say in HUF ,girls have no right..the Courts never,never never help.
Girls don't look after their parents but a son does

Court matter simply means a long wait . The merit of the case is hardly seen or read by busy lawyers and judge. It is more about the procedure that the actual justice.
If one is cursed with any litigation than only God can help. The truth of the matter hardly means anything. It s like the sword is hanging either you compromise or keep attending the adjournments. Even if you regularly follow your suit sometimes the judge is absent , sometimes the lawyer and sometimes the parties. For one or the other reasons one is not heard and matter prolongs for years together without an out come. The lawyers feeds only on your fees so he is hardly interest in quick justice. Many times they don't even know the matter they are alloted. It's a hopeless , redundant,slow system of Justice.

Sir my bro has very thoughtgully taken sign on no objection letter of handling over flat of dad to him from we 3 sisters. Now flat is being redeveloped.
