  • The judge overseeing Gwyneth Paltrow’s ski crash trial calmly reprimanded plaintiff Terry Sanderson’s daughter, Shae Herath, for giving medical opinions that she is not qualified to provide. “There’s a lot of medical experts in this case and you are not one of them,” Judge Kent Holmberg said to Herath outside the presence of the jury.

      @@coastal5228 I haven’t watched the rest of her testimony, so don’t know if she had been repeatedly warned or not already. But this is totally how a judge should speak to a witness (except maybe if they have been warned countless times already, and are deliberately violating rules of evidence). Even law students struggle with rules of evidence and what is opinion vs fact, what is observation etc, and which are and aren’t admissible. So it’s completely expected that a layperson is not going to know the rules of evidence, and need it explained to them. (And we all saw how long it took for johnny depp to grasp the hearsay rule lol).

      Ths is how all judges are if they're simply explaining a rule. But if a witness is being defiant and disprectful, they'll be set straight or "reprimanded."

      Did you watch the Chandler Halderson and/or the Murdaugh cases? The judges were very similar. Those are just two that come to mind.

    That's how a judge, or anyone having authority over others - including parents, should speak when trying to explain an issue or attempting to get a point across. This judge is an exemplary human being.

    This isn't a "reprimand." The judge simply clarified the bounds of her testimony. She was not violating court rules or acting out of order as to be "reprimanded."

      It’s called admonishing the witness. It can be done gently if appropriate. If the witness doesn’t comply, her testimony can be stricken and the jury instructed to disregard it.

    That is one chilled judge. I am not a Paltrow fan, but I side with her defense, which falls in line with common sense. The Sanderson side appears with many problems and a circus performing leading attorney, Ms. Van Norman.

      nah her story has WAY less common sense, are you kidding me? He rode in between her skiis with his body up against her's for a while and then they fell, going slowly? and it was enough for him to break ribs and get a brain injury and lay there not moving? And she still left him there? His story makes much more sense. AND a witness saw it happen and says she is lying.

    This witness was the most dishonest. Surprised that Owens did not declare her a "hostile witness." When she said that medical-sounding descriptive of Jenny, she knew exactly what she was doing, IMO. The Team clearly had that put in her script so as to let the jury know that Jenny has some problems and might account for her father's treatment of her.

      Tbh, I don't trust the Sanderson's lawyers at all. I know lawyers will try everything to win cases but that team pulled too many stunts. The final rebuttal was a joke. They were desperate and would try anything. The question now is do they know that his version wasn't real and hope there were enough jurors hating on GP to find her at fault.

    What was crazy was that after this instruction, Paltrow's attorney asked numerous questions about her father's medical situation. If she wasn't allowed to even reference her sister's neurodiverse mentality, (to put her behavior in context) why is it acceptable for her to be expected to offer medical testimony about her father's health issues? Seems like a double standard.

      And it was very obnoxious. But, Owens got her, or rather she stepped into it at the end when she said that she withheld correct information on her deposition because her lawyers said it would be a red flag! Never pays to mess with a smart lawyer and play that game. It will come to bite you in the end. Plus, the jury sees that and it does not come off well and makes that witness very unlikable and makes them suspicious of everything you said, just about.

    In any accident, the one with higher mobility that hits a stationary or slower moving object will sub stain worse damage. He approached from behind at a high speed so it’s his fault not hers. His speed is what caused his severity of injuries.

    Neurodiversity is a generalist term can be applied to ANY disorder that causes a person to think in a manner that is different from the "norm". This can be applied to behavior disorders, complex post traumatic stress disorders, any one of the many personality disorders disorders, Autism ( with all it's sensory disorders) and so forth.

      Yes it is but most people wouldn't know or use that term until they are diagnosed by a medical professional. They are asking her to describe behavior in more of a layman's term. For example, before my nephew was diagnosed on the autism spectrum, the doctor wanted to know what my sister was seeing, tantrums, hitting his head etc. They didn't want clinical terms that she suspected.

    The one thing that is total BS about this case is Sanderson should be forced to sit in that court room along with GP in this civil suit. He is not an invalid if he was able to tour the world well after his alleged accident. I hope the jury sees this for what it is a money grab. The older sister was very pleasant in her testimony of the younger sister Jenny, but the other sister Shae is nonchalantly throwing punches at Jenny's interpretation of their father. In speaking of Jenny her sister Shae keeps saying what ever Jenny says " that was her truth" is the very same sentence her older sister said about jenny, VERY Rehearsed. She also claims she was not aware of her dad being blind in one eye that is BS as well. I do feel bad for Sanderson but it certainly at this moment does not prove his head injury was on the slopes that day, it could have happened at any time on one of his many, many vacations.       Evidently, his medical history shows he already had brain injury, due to a Stroke or something & blind in one eye.
      And he's been traveling the world, even Bungie jumping since this incident with GP. Another site covering this, were talking about the one daughter or two of them 'say he is lying & commented to them about 'the money he'll get' and they or she did not want to be a witness for him. Idk which or who was busy with little one & I haven't got to watch the whole thing yet. I'm a bit behind all of you.

    Seems that the reported injuries were to the front of the man's body. Wouldn't that suggest that he ran into her?
    If it were the other way around, he would have injuries to his back.

    seems like two things are getting conflated in this case , who hit who , which is clearly at odds, and what the effects of the accident have been on this person , if it is determined that he hit Paltrow then the medical outcome and after effects are irrelevant

      If he ran into her from behind she would have fell back onto him with her body weight. He would have been injured. I think he's trying to collect some money because he wants some. The witnesses are telling different stories. There's no video showing what happened. Somebody is lying. It's up to the jury in the end.

    You have two older sisters that have been out of the home for many years testifying about the Dad, and you have the youngest with different experiences with Dad and the older sisters are saying she is not mentally capable for testimony to be reliable.
    And they do not want to jeopardize the case with her input.
    Watch the trial it is disgusting.

    I’m not sure whom I believe at this point, but so far, the doctor’s testimony on Terry’s x-ray of his injuries shows that TS was hit from behind and the weight on his back from the fall broke his ribs. If TS ran into Paltrow from behind, his injuries would not have occurred.

    Why are they calling it a crash? People run into each other on ski hills all the freakin time, I have ran into people and people have ran into me many many many times and I even broke my wrist one time. It's unfortunate he is having neurological issues but I have a hard time believing it's because he ran into a 100lb when socking wet woman when he was skiing a few years ago. It's all about $$$

    Wait!!! @2:00 min mark, the Judge literally tells the witness she cannot use a “medical-sounding word”. Why? Does a person have to be a medical doctor to use a ‘medical-sounding word’? Does a person have to be a lawyer to use a legal-sounding word? Why will the judge allow the witness to use normal-sounding words? Does he think the Jury will wrongly believe the daughter is a doctor?
    Seems a baseless reason to ‘reprimand’ this witness.

    IMO this witness was all over the place. Too much elaboration when asked a simple question which only needed a simple answer. Going long with extended detail. Why plaintiff attorney let her go on with unrequested info was foolish IMO. Nice lady, but I thought she was a hot mess on the stand

      I would be confused too, as someone who regularly uses medical terms to describe how people act. That’s just what educated people do. The judge literally said “you can’t use medical sounding terms” which is so vague. Like depression is a medical condition. Does that mean she can’t say someone was acting depressed?

You observe someone who doesn't smile, doesn't get out of bed, doesn't go to work, doesn't leave the house, etc. She needed to say what she observed instead of what her diagnosis was.
