  • Hey everyone! Today, we are looking at a recent work of research from a specialist drone lawyer based in the US. They looked at 70 cases where the FAA prosecuted a drone pilot to draw essential data such as how the FAA found out about the illegal flights, what the pilot was doing when they were caught and how much the fine was.

      "government" is a blanket term for a variety of different departments... in this case, the FAA is in fact minding their business. Keeping commercial air flights safe is a big deal, and citizen drones can endanger them. So it's kind of justified, even if the fines are insane.

      Exactly. We have full size plane pilots doing stupid stuff around here like they have no rules. Several have crashed. They did stalls over our rc field and flew over only about 5 feet high. One helicopter just missed the courthouse when diving over the town festival and wing walking is legal lol

    107.23 -- well there goes RC combat at the local flying field and in theory, every crash of an RC model plane constitutes a violation and risks civil fines eh? And who says the hobby is not under threat. Who learns to fly RC without ever crashing?

      Are you flying combat for living? As I understood it is part 107 - so it doesn't apply to recreational flyer, especially on AMA recognized field. But who knows...

    Its amazing we have thosends of illagal alins riding around on motorcycle and scooters on sidewalks and going against traffic with no plates and they cause in just nyc over 250 accidents a year and they walk free

    Folks here in the U.S.A. place a high value on personal privacy and personal space. Media hype serves to inflame the already suspicious mind that unscrupulous motives are behind every flight mission. I try to reduce the tension by including my few neighbors in the activity and educating them while having fun. Once they understand how much knowledge and certification is involved, they relax a bit. Trust is established and suspicions are calmed! Fly right, fly legal! Thanks for a great informative podcast. My first view.

    Seventy in one year compared to the amount of drones in the U.S. doesn't seem that high. Of course I'm thinking most of these cases were "caught" fairly easily since the FAA doesn't have a large number of investigators patrolling neighborhoods. Overall, I appreciate the work you've done in our communities information cycle on the FAA. Hope to see you on TNL soon.

    A very interesting exposition - the take-away is 'don't be stupid' - Canada has an interesting Regulation, 900.06, which is the only one applying to sub 250g drones. It deals with careless and reckless operation and basically boils down to ' don't be stupid'.

    In the US we have a "Karen" that is strategically placed every few miles to call the FAA and report a 'violation' no matter if the truly is a violation or not. Drones are known to irritate and trigger all Karens.
    Interesting to not that all the crashes involving people never amounted to a single injury. With the litigious nature of the US you would figure that someone would have sued the drone pilot for mental distress. 😄

      Never fly near a park because a Karen will think you are trawling for children. There is no way I would ever fly one near anything resembling children because the Karens would call the cops. I fly in a desolate area where I bother no one. I flew one at my house once a boy wanted to talk about the neat drone and I took it down without conversation and went in my house. Sad one has to walk on eggshells in this society.

      I fly rc and I had an issue with a neighbors drone....he would hover with the camera pointed at second story bedroom windows. People like him, are the reason for over reaching laws IMO

    This was hella informative. We see nearly all violations are from after the fact crashes and the majority people fined are non-Part 107 certified. Learn your charts, folks. Don't fly BVLOS "It won't happen to me" Wind shear near a tall building took my drone behind the radio shadow. My drone loitered but then initiated RTH But the building was in line with the home point and just above my set RTH level of 300 ft. As luck would have it I was flying my Autel EVO II and it's optical avoidance system guided the drone 60 ft off course to avoid an antenna farm on the roof. The drone regained signal after a full minute and flew back directly but it could have just as well flew into a window and cracked it. It can happen just that fast.

      I set my drone to go to highest altitude on flight. And do that first .. I make sure to raise over top everything. To clear. Also going up gets signal again. Though weird sometimes it starts flying back before going up. If altitude is close.

    My question is what are they hiding ? I spent 50 years building little flying things, biplanes, fighter planes , jets, and dragons . Then quads came about, and with them , the end of local flying ...no fly zones around airports closed flying, then the FAA counts a lone closed airport , a WTF moment . So all I ha e built and the money invested in equipment is a loss, wonder if it is deductible? ?

    One stat that would be interesting would be the Public complaints compared to actual violations detected and how many investigations resulted in no action being taken or Warnings issued without fines

      @@TheCablebill I'm confused. If the offense goes undetected, how are they supposed record data on it? It's kinda like asking a cop " how many people ran a particular stop sign when he was not watching it?"

      @C GI @C GI @C GI to assume the amount of people that do such during rush hour, correlates to the nember of people that do it the rest of the day, doesn't seem accurate. Also people don't do things that get them in trouble if they know they are being watched. Even if " the cop" hides, the people will eventually figure out that particular spot is being monitored when everyone starts getting tickets, which flaws the formula. In any situation, assuming you know what happens when somthing is not observed is at best, a guess, unless what your not observing is a proven law of phisics, in which case it has been observed before and proven that its the only way the situation could possibly turn out. Actions of people do not fall under the laws of physics, but a rather long list of things such as emotion, mental state and so on which can not be entirely predicted. To come up with such a stat, with no observations, and then form laws around it, is not fair to anyone, and at best will cause problems.

      There are regulations that apply to Class G. The FAA might not bother you in the sticks but they do have jurisdiction and there are ways to get in trouble.

    I think you did not make much of any effort to explain HOW the FAA would catch someone if there were no crash or incident.
    Someone flies illegally, but nothing goes wrong - How would the FAA catch you?!????

    Honestly as a Business owner who flies these drones every day I feel like the fines are a little excessive. But if you took your part 107 test and passed you should be very informed about all of these rules and you should abide by them

      I have a dji mavic mini and I am 14 should I be worried about any laws ? My drone is under 250 it’s 249 so do I need to take the 107 test ?

      @@randomaccountwithyoutubere5175 being under 249 grams does not exempt you from the rules. You don't need a Part 107 if you adhere to recreational restrictions. But you must know the rules in all cases.

      Most of these fines should be in the range of a traffic ticket. The fines should be of a set amount that’s realistic for a violator to pay, not some ridiculous amount like ‘One BILLION dollars lol. Property damage is a civil issue between the pilot and the owner of the property damaged just like any other crime. This is just blatant abuse of power. If for example a pilot unintentionally killed someone, which has never happened then it should be a criminal charge like negligent manslaughter and be separate from any FAA violation like flying an unregistered drone in my opinion. Let’s keep things realistic and transparent. Willy nilly charges without a set penalty and excessive in nature are very problematic in my opinion and are probably the reason that the proposed fine by the FAA and what really ends up happening are so different.

      If your gut says "this isn't a good idea," listen, and you'll be okay. Check out the rules for a location before you fly. My state doesn't allow flying in State parks. Some cities allow park flying, others don't. Just check.

      most people flying don't have, nor need, part 107. part 107 is only for COMMERCIAL use of drones.

    I was reported for flights in a video I made public on UA-cam. I received a letter from the FAA saying that they found “insufficient evidence “ that I broke any laws. I understand not telling me who reported me, but not telling me what I was accused of seemed weird and unfair.

    As a returning drone pilot (last flew Mavic Pro 1 in 2017) I am trying to make sense of all these new and absurd regs. Regarding this video, I still cannot figure if any of this part 107 stuff you are referencing applies to recreational only pilots? Like flying over people for example. Does that only mean large groups of people, or the happenstance that I might accidentally fly over (in the course of just flying around under part 44809) somebody obscured behind a stand of trees walking their dog, etc. and they call it in and my Remote ID sells me out to the FAA, etc.

    Thanks for sharing. Basically be aware, follow the rules or don’t get caught. Since we are relying the technology (which could fail) and the likelihood of human error, don’t take unnecessary risks.

      Most of the people making rules might not have your best interest in mind , they do it as a sick fascination with having control issues and corrupt intentions of getting money out of weak minded people, when you are born you are not automatically entered into a contract to be ruled or made subservient, remember only death is real and when dead non of being controlled is gonna matter. Live your life and mind your own business

    Why was all of our rc plane flying for 40 years not a problem? We had cameras on planes that weighed up to 50 pounds, had gas engines and could fly through the clouds. All of a sudden small light toy drones are super dangerous. Makes no sense unless you are the one collecting all the fines. I still think this is all about large companies willing to pay big bucks for hobbiest air space which we had first.

    Any time I request to fly in airspace my request I never even acknowledged. So its automatically denied after about 4 or 5 days

    Book em Danno, we have a pilot that is doing everything legally as a hobbyist except someone just benefitted from the drone and now it's a safety issue. No one benefits, then it's not a safety issue and no license is needed. Makes perfect sense.

    After the deadline will there be a bunch of pilots being fined? Or is there going to be loads of pilots not complying with only a few actually getting caught?

    All current C-UAS systems focus almost solely on DJI. Drones flying alternate RF and telemetry systems are not prioritized. Defunct systems (72MHz and other frequencies) aren’t scanned. NoLimitDrones sells replacement firmware to de-DJI a DJI drone. Good luck FAA!

      Does that include no longer being tracked by the dji tracking systems stationed in the USA? They also have stations worldwide. This recently came out that dji was able to see how and where their done were being used in Ukraine, and sure enough it was discovered they had the same capabilities in usa.

      @@JoelPit the point I was trying to make was that DJI drones are being actively tracked, and under surveillance by a Chinese Corp (aka CCP) unbeknownst to the users. I'm sure it's not a encrypted protocol that US agencies can't also be vacuuming up like all the other metadata.

    I’d like to know who many cases, if any, end up have a certificate holder of ATP or COMM and Remote Pilot (UAS) having ALL certificates suspended when the FAA does suspend a drone operator for drone flight violation.
    Meaning a Remote Pilot has an event with the drone and the FAA comes knocking to suspend the certificate. Same pilot has an ATP - Airplane and works as an airline pilot. Does the FAA attempt to suspend ALL certificates or just the Remote Pilot certificate? The event occurred during operation and use under the Remote Pilot certificate.

    I hope the FAA updates the BVLOS rules, especially for sub 250 gram drones. With modern return-to-home technology, it is very safe.

      NOTHING BVLOS is safe. If you can't see your drone you have no idea what is anywhere around you other directly in front. Now if you're camera is on a 360 degree gimble and you can check 6 I beg to differ with the FAA, Such a set up is as good as any pilot except maybe an F-22 pilot whos Very expensive Helmet let's him/her see through the cockpit floor.

    I am not sure you answered the question you proposed "How is the FAA finding out..."? If I am flying my drone and I crash into a field in the woods, can the FAA find out? Well, not unless someone on that property sees the drone go down. Or, suppose I lost my drone in the woods. It has the FAA ID number on it. Would I be in violation because someone finds my drone and turns it in to the FAA? After all, I wouldn't lose a drone intentionally, but technically, it could be assumed I lost control of the drone, otherwise, why would it be lost in the woods and recovered by someone else maybe days later?

      Good point. So let’s say my battery dies above someone’s backyard, drone fall. Owner sees and report all my info - I’m getting fine which is probably more than actual drone cost.
      Why do I need to register it then?
      If there’s no way that guy will see my info and kindly return it to me.
      So basically, the rule is:
      Fly carefully
      Not so high
      Not above people
      Not above ppl properties
      If you crash somewhere and lose your drone - bad luck, but at least you won’t be sued 🤷‍♂️
      Or I missing something?

    One thing I still don’t understand is “flying over people”. Depending on how you want to interpret it, that means crowds, or you can only fly in the middle of the desert.
    So I can only fly if I’m 100% sure if I don’t accidentally fly over a person who isn’t (350 feet below me) protected under a parking structure, or a vehicle (which I’m apparently also not allowed to fly over)?

    I have never owned a drone so I have a few questions about how it might be tracked. 1. Do the retail drones keep coordinate or lat longs in their data? 2. When they connect to the internet can that data be retrieved? If so, these could be tracked by their MAC address, which can be associated with a pilot or violator. Or am I way off base?

      EVERYTHING is tracked. Quick anecdote: I used to fly for work (Gov't). I also used to fly for recreation. Separate equipment, of course. Turns out that the app on MY phone that's required to fly MY drone is automatically linked to my DJI account. Thus, my employer has not only detailed record of flight data on company equipment (EVERYTHING, including weather that day, wind speed and direction, location, altitude, flight path, imagery, calibration data - name it, as you would expect obviously since it's Gov't property) but ALSO all the same data (including photos I took of my kid on our backyard trampoline).
      Bonus feature: since it's DJI, you know who else gets all that data every time you upgrade your firmware? Hmm ... now I can't prove who gets or how all that data is used...but I remember a certain controversy discovered by a Mr. Snowden that showed a certain government was tracking private cell phones without users' knowledge or consent.
      Could it be that a certain OTHER government might be similarly interested in tracking drone data and imagery, unbeknownst to the user (yes, including government officials here - they only know what vendors and manufacturers tell them, they don't truly understand what data is transferred or even how these advanced drones perform the tasks they do - not expertly anyway)...could it be that certain governments outside of the West have an interest in the sorts of things we're looking at? Not just hobbyists but local governments? We don't look at points of DISinterest now, do we?

    Seriously, I am afraid to even fly outside my yard. And in our rural area, even flying it towards the neighbors I can imagine their shotguns coming out!

      The license is only needed for commercial purposes. If you aren’t doing drone flying for business purposes, then you are not expected/required to get a certification.

    what about something like frequency signal stop/drop or interference signals from let's say being in a trailer home park where 50 homes have WIFI and 50 electric meters, an adjacent telecom tower and high mast electric transmission line that causes drone to accelerates and climbs until PIC can gain control and the drone breaches a FAA flight rule?

      I fly power lines for a living, up to 500 kv lines. I have used DJI M210, Air 2s, Mavic 2 Pro, and Autel Evo II Pro. I've never experienced signal interference, at least with the referenced models, and I'm flying within 2 or 3 feet of the conductors.

    I have a hobbyists certificate and have been told by a local FAA employee that they have teems of people searching for hobbyists making money. Your not even allowed to use your drone to look at the neighbors gutters for a plate of cookies. Exact words.

      Interesting 🤔 I wonder what would happen then if you invoked your first amendment rights freedom of speech and freedom of media. The FAA is not the final authority the Constitution is and if they really said that to you their blowing smoke out their tail,I don’t think what they told you is true because congress didn’t voted it into law in the first place . Next time tell them to pound sand in their statement they need to prove that their statement is law and in my opinion they won’t prove it to you.

      It assures you won't be prosecuted for violating airspace if you obtain the required reservation. You can still get in trouble for breaking other rules. Yet I believe it is probably helpful to demonstrate your desire to be in compliance and operate safely within the national airspace system. For this reason, I wish I could file "flight plans" outside the LAANC grids too. But I've also decided that LAANC reservations are a bit of security theater. A tower controller will not provide advisories to manned aircraft in Class D regarding LAANC reservations - because they probably don't even get informed, which I think is atrocious.

    Let's talk about how the FAA is violating our First Amendment right to free speech and freedom of the press when it involves UA-cam.
    It's not free speech if we have to pay a $175 fee to the government and pass their rigorous knowledge test for their permission to publish our own original work. They don't care if you fly without a commercial license or if you shoot drone photography without a commercial license. It's not the flying or photography that they object to, it's the publishing that they object to.
    The FAA says that posting our original and creative work to a non-monetized channel indicates an intent to make money from flying. That assertion assumes evidence not yet available and is nothing more than conjecture. There are many recreational pilots who don't want or need money (such as myself) but who just want to share their videos.
    But the FAA doesn't care about that and they will fine you for doing so. That's what I call preemptive punishment for a non existent crime. If they want to punish people for making money with a drone, then they should wait until money is made before punishing anyone.
    UA-cam will never monetize a channel that contains content of drug use or guns, it's against their stated policies. So if your drone videos contain any footage of people using guns or drugs, including alcohol which is a dangerous and addictive drug, just include a disclaimer and some footage of someone shooting a gun (but not at a drone!), drinking a beer or smoking a joint (but not before or during flying!) and your channel will never be monetized. That eliminates any nonsense about your "intent."
    The FAA's glaring hypocrisy is evident by the fact that while drones are shot at frequently, they have to date only prosecuted one case of drone shooting that I am aware of.
    Fly on and be free! Power to the people!

      That's not how free speech works, you sound clueless about the First Amendment. UA-cam is a for-profit corporation, not a public space. If you upload content, whether you make money or not, it's still content distributed by a profit driven company. So if you dont have a part 107 license, in theory you are breaking the law. It's not about silencing you, as you are free to keep your content up there, but you still can be fined. The thing about free speech is that it does not mean freedom from the consequences of your speech. It only means you have the right to say it without being prosecuted for what you said.

    I would be interested in finding out how many Real Estate photographers get fined? I live within 5 miles of a private airport and I'm sure the photographers are not getting permission, How do you find out if a person has a permit? I have seen plenty of drones flying over festivals and have my doubts that they have permits.

    They're mostly just toys that many people enjoy flying as a hobby, a hobby that nobody learns or participates in without crashing, and until the death-toll equals one 10th of one commercial aircraft disaster, which will never happen, I would ignore ridiculous regulations, happy flying!

    I'm curious what this means for FPV freestyle, racing, etc. I believe for FPV hobbyists doing anything other than cruising (so racing and freestyle, mostly) crashing into your field, or another empty field you're intentionally flying over is pretty much a certainty at some point. Would this somehow constitute a violation (loss of control) warranting a civil penalty?

    Do these fines only apply to drones over a certain weight? How is it they identify the flyer of the drone? Seems like that would be very difficult, unless these are professional drones that require markings or electronic identification? Are people taking steps to assure their drone signals are not interfered with or their signal pirated to take over control of their drone or block communications?

      People do indeed have different eyesight. However, there is a limit of ANY human vision and a Mini 2 would not be visible at 2 miles. Any resulting court action/investigation would be put through the same reasonable tests as any other case.

    Not surprised by the number of actual of violations/penalties given the number of drones flying. My experience with the FAA in PART 91/135 issues I've heard about over the years has been the FAA will often "forgive a "MINOR" and/or "Unintentional" violation but will come down hard on intentional conduct or "non-cooperative" individuals. "Conpliance attitude" is one of the parameters they use when evaluating the penalty.

    I find it strange that there is no apparent distinction about the "loss of control" issue. Let's assume you are a Part 107 pilot, had LAANC authorization, for a commercial job. Then *the DJI Go 4 app crashes* (as it happens worldwide for some buggy reason) *multiple times back to back and you always restart the app, but after the last app crash, the signal is lost* and you can't recover the signal and control over your drone and it crashes without damage.
    It seem to me that, according to Jonathan, despite this being a technical issue of malfunctioning manufacturers software, the RPIC is legally and financially liable for FAA enforcements.
    Seems pretty harsh to me, or did I miss something?

      I think if you cause damage or disruption through no fault of your own, but fess up immediately and file the report with FAA that you are supposed to, I can't see them issuing you any kind of penalty unless you were being extraordinarily reckless.

      @@garywatson Sure, I mean, we have the reporting requirement of within ten days, if the damage to property is over $500 (not including the drone), or if there is physical harm and the injured person needs to stay more than a day in the hospital (faint memory about that part).
      However, according to Jonathan Rupprecht's article interpretation, it gives me the impression that there is no distinction of fault, e.g. software failure, etc.
      I am not talking about super reckless behavior (what exactly is that?), if nobody was endangered, no damage to anything.
      The FAA doesn't require reporting of such incidents, although the NTSB requires any incidents to be reported. Not for enforcement action, but for safety statistics.
      Not sure if anybody does that, or even know about it.

    Interesting. US, not UK, but lots of things do cross the Atlantic.
    I and a friend fly FPV competitively - between ourselves, not in official competitions. We basically follow all the rules, avoiding restricted areas, flying far from people and stopping immediately if anyone starts to approach. We spot for each other even if it is a waste of time, we are correctly registered etc.
    Sounds OK, but there is always a strong risk of loss of control and crashes, simply because we are racing for fastest times and pushing the limits. In my view, given the points above we do absolutely nothing wrong, but would guess that if someone official wanted to be difficult, they could point to the risks of flying at competitive speeds.

      Hey Nick! Crashing is part of FPV and it sounds like you guys are taking every step to make it as safe as possible. Where I think the issue comes up is aircraft found crashed where illegal flight took place.
      I hope I do not see the day when FPV flyers need to worry about it.

      @@Geeios1 spotters are required at all times, though my reading of article 16 might give a loophole in some cases. We always do spot, but to be honest that is so on a crash we know where it is. Being aware of people etc is actually easier to see on the FPV display than for the spotter. Once beyond about 50 yards the spotter usually has great difficulty in placing the position of the quad relative to obstacles.
