I have part time tuition income of Rs 130000 and saving interest is Rs 1638 and fd interest is 74500
Apart of this I have some intraday loss of Rs 23435 and STCG LOSS is Rs106521 I have no other income. Which itr should I fill /itr 3 or itr 4
Secondly, when I fill all this data into itr 3 ,one error came at least one business code is mandatory either in schedule nature of business or at a point 61or 62 or 63 in schedule profit and loss account,
Please confirm which business should I opt in my case

I have a question- My father sold agriculture land in FY 2014-15 ,, but didn't file ITR . Now received Notice under sec 148. He had KCC loan on that land ,which he paid to SBI bank to get NOC at time of sell of property . Can he show that loan as Cost incurred duing transfer of property under sec 48?
REpayment of loan is not allowed as cost.

Sir, in 2010 my father in purchased a plot in my mother's name at circle rate where full payment was done in cash as seller didn't had bank account and stamp duty was paid on whole amount. Whole transaction done through dealer. Registry and mutation both are done. Will it create any problems in future if we wish to sell that plot??and In whose itr the capital gains need to be shown??
No problem as such if your cash source was duly tax paid. The cost so incurred may be claimed as cost at the time of sale of relevant property. Yet you should consult with your CA.
मेरे पिता ने अपना मकान पिछले वर्ष बेचा और उसमे से मुझे मेरा हिस्सा मेरा अकाउंट मे ट्रान्सफर किया। क्या इस राशि पर मुझे टैक्स देना होगा अगर नहीं तो इसे किस पारा मे exemption है।

Query :- Maximum income not chargeable to income tax for individual and huf to be considered as 2.5 lac or 5 lacs for asst year 2020-2021.

Hello Sir, but in case someone has deposited amount of sale proceeds in capital gains investment account in a bank for next 2-3 years as per law, then will he be required compulsorily to file ITR for next 2-3 years?
No compulsory ITR is required only in the year in which capital gain arises.
Hello sir, my father's brother have gifted me his plot of land last year in which he is joint owner with my mother. How the percentage share of property will be considered here. Since the property was bought in year 1996, in cash from the money of agriculture produce and nothing mentioned in the deed about share. So can it be considered as 50:50 or how we can calculate it for LTCG. Also will it be considered as AOP/BOI or will it be taxes as an Individual. Please help here sir..

Yes you may avail new lab rate benefit on such income however its advisable to pay tax at the time of filing return.

You have to pick the nature of asset as house property and also claim exemption under the exeption provisions.
Dear Bhatia ji I have a question regarding capital gains. I had sold my residential property in November 2020 and had obtained capital gains from it. I want to use the amount in purchasing a new house now upto which time period I have to invest the amount for new house and if I am unable to invest during the time period then upto which date I will have to open Capital Gains Account for depositing the Capital Gains.

Assuming that your ITR due date for AY 21-22 shall be 31.07.2021 you may purchase new house upto 31.07.2021, if you could not do so then invest the capital gain into Capital Gain A/c Scheme on or before above date.

I have one question that
Bihar me rural area me commercial Zameen hai jiska private rate kuch is tarah hai 7 lakh dismil but circle rate 1.20 lakh dismil hai.
Zameen ka paisa joki circle rate se buyer party de raha hai bank account me aur baki paisa kaise le.
Actual rate of transaction may be above circle rate. In such case who amount should be taken by cheque.
Agar ek dismil ka amount 1.2 lakh hai joki circle rate hai wo to bank account le sakte baki ka kaise le. Cash ya bank account me.
Waise to 6 dismil sale out karna hai
Circle rate se 1.20*6=7.20 lakh ho raha hai joki bank account me lena.
Aur private rate hai 7 lakh dismil *6=42 lakh
Baki 35 kaise le please guide.

मेरी राय है कि आप पहले सम्बंधित जमीन अपने नाम कराएं एवं फिर निर्माण करें तो छूट मिल सकती है। यद्यपि सही तथ्यों के आधार पर ही अंतिम राय दी जा सकती है।

Prima-facie exemption can't be calimed in such case. However if father gives such property in gift or rights in part and you consctruct on such portion then exemption may be claimed.

Ramesh ji in this video I tried to explain if your total income exceeds ₹2.5 lakh for the AY 2020-21 without giving exemption u/s 54 (which is usually availed in form of selling a residential house and and buying another residential house) then ITR is mandatory otherwise not.

Since NRI interest is exempt so not mandatory to file ITR as such unless you have other taxable income in India. However as a prudent person if you file ITR it will be beneficial.

There is no system of paying in EMIs rather the tax should have been paid as advance tax. Parantu yadi aap ab tax kiston mein dete hain to uss par interest bhi dena hoga. Pls consult with your CA.

Because I think he has taken deduction of ₹50 lakh from section 54ec after that his net taxable income is around ₹25 lakhs which is less then ₹50 lakhs so I think shedule al should be not applicable pls sir clarify this , thankyou
You are right since total income is less than ₹50 lakh schedule AI should not be applicable.
