The definition of ordinary hours in the BCEA is "the hours of work permitted in terms of section 9...". Section 9 permits hours up to 45 per week. And overtime is the hours in excess of ordinary hours. Therefore if you agreed in writing (and through behaviour) that the additional hours (under 45 per week) are ordinary then overtime will only be if you work more than 45 hours in a week.
If covered by the BCEA (and not a Bargaining Council or Sectoral Determination) the employee receives 1.5 x their ordinary rate (take their daily rate x 1.5) for work done on Sunday.
thank you for your explanation. Just to get clarity using values. Let say the employee earns R 10 per hour, does that mean he will be earning R10 * 1,5 per hour on a Sunday?
This video was so helpful.I have an issue at work where i was absent the Friday and Monday and the company demands a doc letter.Ive sent them a picture than i need to be absent for more than 2 days in a 8 week cycle for them to require a medical certificate.It however it stated in the company policy that you need a doc note for Fridays and Mondays evem after sending them the BCEA section 22 and 23 they still demand a sick not of it will ne unpaid,what should be done?
can traveling to meetings in distant locations be regarded as overtime if the meetings ends after the normal office hours and you end up having to travel back and geting home in the late hours of the night. and still going back to work normal time the next day?
Travel time could be considered overtime depending on the circumstances around it. Travelling to and from the usual place of work, however, would not be regarded as overtime. It also depends on the type of work performed.

Hi Carmen, how to calculate the Sunday pay for an employee who works 24*7 shifts of 4 days in and 4 days off. Basically, ordinarily works on Sunday?
