They received my K1 packet November 2, 2020 and they still havent cashed my Cashiers check. When can I file a lawsuit? Wouldnt that make the embassy mad and not process it? I have not even received a receipt.
Who is they? USCIS? If yes, they are behind in issuing receipts and cashing checks. Still this has been over 60 days. If you are sure your filing was not defective - call the 800# and ask the customer service line re status. Unfortunately, this is not a situation where you can file a suit.
I am in Italy!!! US native born America, Married to an Italian National for 18 years and desiring to file a Mandaus, for our case, to gain a Judgement from The USCIS, our case is being held up! 2 yrs 3 mo, I have all the files I have all the responces, I have been a housewife from the start of our marriage, there in is the problem we declared my husbands income (which is good and established the proofs as required) Yet still they do not acknowledge that we filed approperately and we have been stuck for months with a non answer to our last sent proofs and commuincations, so at this point I would like to know how much will this cost me for you firm to file the Mandamus? We could file a mandamus and get your case scheduled - it will have no negative affect on the outcome of the case. It could trigger a referral to immigration court however - depending on the facts/strength of your case. You should discuss this with your attorney and if you dont or no longer have one - we could pick up the representation as well. Having said all of that - we have cases from 2016 as well well - clients sometimes choose to wait for multiple of reasons.
