Bad idea, unless the NFA goes away first. Otherwise another agency will take over....ie. the FBI. None of us want that. They have a much.....much....much larger budget with many.....way more, agents. The ATF is very small, with a budget according.

So we all have to either keep every gun we buy forever or sell it all to an ever diminishing list of FFLs (that probably don't want anymore stuff they can't sell) for a RIDICULOUS loss.

You can’t even sell it to an FFL or have him sell it for you for a commission. If you could make a profit, You have to have an FFL to sell or trade off your collection. So I guess this will also outlaw all those “gun buy back programs” the leftist love so much. No, I expect only those poor slobs that sell their gun to the buyers standing outside the buy back will be targeted. This can not stand. It’s time to pull out your wallet and donate to the 2nd Amendment Foundation.

You can't get good dollars from an FFL anyway. $1000 gun may bring $250 at an FFL.
Private sales are the only way to get atleast $600 or more.

Before last Christmas I sold six of my guns to fund the purchase of a new one. I lost money on each of those six sales compared to what I originally bought them for. But as far as I can tell if I did the same thing today I would be a felon.
I know a lot of C&R collectors have expressed that they are not worried because of a clause at the end in "the final rule" that says it exempts something-something private collections. It does not sound to me like the ATF is really going to take that exemption seriously.
It's about big data. Let's categorize everyone. Let's know who buys what and associates with whoever. In honesty it's about control.

Guns sold on Gun Broker predominately are shipped and transferred through a 01-FFL. WHy do I need a 01-FFL????

If I read it correctly, then you are in violation of this rule even if you use a different FFL dealer to complete the sale to another person.

I think we need to quite calling these things laws, but call them by the legal term “Code of Federal Regulations” these are regulations not laws, to be a law it has to be passed by Congress, we give them more power in the PR world when we allow them to change definitions.

This shouldn't be a problem unless you guys were routinely buying then selling guns. You should be classified as a dealer the whole time.
The people who got this pinned on us buy and sell several guns a week every single week. They don't even own something 24 hours before advertising, listing or offering it for sale. They were indeed breaking the law. The guy who wants to move a gun or two out of his collection a couple times a year has always been innocent. Same for the person who loses their job, finds out the Mrs. is pregnant. The transmission goes out and he needs $3,500 - $5,200 to get it fixed randomly and unplanned etc etc etc.

The rule is bologna, All it is is a slow further erosion of firearm rights that are constitutional under the United States Constitution. Furthermore, what legally allowable item in the United States to own is prohibited from selling or transferring as a private citizen.
What should be allowed is the personal sale through a firearm stealer and doing a Nics check.

Yes, it's a licensing scheme presented as a universal background check scheme. The FFL system is based upon a federal tax in interstate Commerce. It already is infringement but is based upon that Commerce. Once a regular person has bought it from an FFL, it becomes intrastate commerce, unless it is sold to someone out of state. As a non FFL, you can't buy legally from out of state FFL'S. It isn't allowed. Therefore Congress has no jurisdiction, to change the law.
But as written, you can't sell your property without a license, period! Sell it for consignment? It says profit not background check.
Here's how they will enforce it. They will use your gun purchases to determine what you have. If you buy a lot of guns, you become a suspect! I don't see how Gunbroker survives. They will infiltrate gunshows, and other places to find suspects. If you are selling your guns because you need money for emergency..... too bad! Doing you selling through an FFL is just self incrimination.
A rule is not law. Yet……. They seem like domestic enemies by now. As are many up there.
Just don't advertise or make any paperwork related to the sale. It'll be easy to get around the rule if you purchased the gun from an individual and you're selling to a friend or family member.
Since I’m a firearms dealer I want discount and my new arms mailed directly to me. Hell I want to be an SOT so I can get my suppressor wholesale and delivery to me. Not to mention I want to be able to demo machine guns to my local law enforcement. Thanks ATF for giving me all these open doors!!!!
