  • Levi had been sentenced to 50 years in prison in 2012 at age 17 after he and three friends decided to enter a home they believed was unoccupied in order to burglarize the house. Levi was outside the house at the time of the burglary.
The homeowner, who was asleep upstairs, interrupted the burglary and shot and killed one of boy's inside the house.
Even though Levi was outside at the time, he and the three other boys were all charged with murder in the death of their friend, even though they didn't pull the trigger that killed him. However, since the death happened during the course of a burglary, they were charged with Felony Murder.
Eventually, Levi and one other boy appealed their cases because they believed the felony murder statute was improperly applied and their sentences were inappropriate.
Levi separately appealed his conviction of the murder charge arguing he wasn't in the house when Johnson was killed.
In September 2014, the Indiana Court of Appeals upheld the convictions.
Levi's sentence was modified to an executed term of 45 years. However, in September 2015, the Indiana Supreme Court granted a transfer and vacated the Court of Appeals' opinion and overturned the murder conviction. The court ruled that in this case, the suspects were unarmed and none of the defendants engaged in violent or threatening conduct. There was nothing in their conduct that would "clearly mediate or immediate cause" of their friend's death, according to the court.
Because of this, the court found there was sufficient evidence to maintain a conviction on burglary charges, but not on the murder charge. The murder charge was reversed for Levi and the two other boys.
In this interview from 2016, Calamari cameras were with Miles and Levi on the day Levi was being released from prison after serving 4 years behind bars. During the interview, the young men talk about life in adult prison, and Levi credits Miles for helping him better himself during his time inside. Levi talks about Miles's commitment to education, and helping Levi understand the importance of education, too. Miles also discusses what it's like watching other cellmates be released from prison while he still faces so many years ahead.
At the end of the video, we walk with Levi as he packs all his things and walks through the prison yard to the back gates to finally reunite with his family after 5 years behind bars.
Together, both young men are an inspirational example of perseverance and determination during the darkest of times.
Update: We are told Levi is doing well and continues to keep in touch with Miles.
Miles finally received a sentence modification in 2020 and was transferred to a Work Release facility to serve out one final year of his modified sentence. He was officially freed from all Dept. of Correction custody in December, 2021. He went on to finish his college degree at Holy Cross College and was valedictorian of his class.

As someone whose been released from prison. I cannot explain the feeling of being released. Its surreal, shocking, but most importantly euphoric. The feeling is amazing. The little things, walking into a store, sleeping in a bed, walking down the street. Its mind blowing.

He got his second chance at life 100% reformed after his HUGE mistake of a crime. pretty much almost the same as Levi's crime. As his sister I can tell you I have never been more proud of a human in my life. He has been out since 2017 and has done HUGE things in life owns a house a car is an architect ( I think or something to do with it making big bucks) He is doing all the correct things in life. He was lucky to get a cellmate who had a positive outlook on the terrible situation they both found themselves in. His life could’ve been drastically different had he bunked with someone who only wished to further their education in crime instead of rehabilitation and success. Miles would make a great counselor and should pursue a future in speaking to troubled youth he has a great outlook and understanding of the rehabilitative guidance kids need to be successful.

I have been to two different prisons for the things that I have done and I can tell you being released is absolutely the greatest feeling a person could ever feel in their life. It literally is better than any feeling I've ever had being out on the streets, there is no way to describe the feeling of being released from prison especially if you have done any time at all little 6 months and 1 year bids are not that bad but any length of time, and it's amazing. I got sentenced to prison 2 weeks after getting married to my ex-wife, so I had a lot of hardships in my time mentally. I have wasted 7 years of my life being incarcerated breaking the law and I can honestly say after being released for the final time in 2013, I'm simply a changed man. This boy committed an adult crime at 17 years old and though yes he is getting released and I'm happy for him but I can't say that my heart goes out to him because chances are he will be right back. Simply because he got locked up at such an early age and did not do any real time incarcerated, I can assure you he did not learn his lesson...😢 but hey best of luck to the kid I hope he straightens up and distances himself from his friends that he's had for years because that's what I had to do...

This kid seems like he has a good head on his shoulders. He seems to understand the wrongs he committed. I hope the best for him to become a productive member of society. This seems to be a great example of rehabilitating our youth instead of throwing them into the cycle of a life of crime in and out of prison. I feel the courts did right by this man by giving him a second chance to redeem his life which isn’t always the case and some can’t be rehabilitated but we should always strive to rehabilitate troubled youth. Way to often do we wipe our hands clean throw way the key and forget about them. I hope his story is a successful one.

I was in Foster homes growing up and I ended up in prison for minor offences but I've turned my life around and I have a good job and a family of my own now I've been clean for 16 years now 43 and chilled now. When the govener comes to unlock on for release it's the most amazing feeling in the world to know that your going to not only see your family but turn your life around. When I was released from scrubs I got 1 weeks money benifit money pluss money I earned in the kitchens working on the servery. The first thing I did was go straight to probation then straight in the pub. After a few pints it hits you like a ton of bricks. Because your minds working overtime if you know what I mean. Few hours before I was in my prison cell lol now I'm in a pub buzzing. I left all my canteen to my cell mate. I hope he's OK and doing well in life. Not everyone makes it most end up back in there again takes will power to not go back again. Anyway peace and love to everyone out there including my beautiful family 🙏🥊🥊🥊🥊💖💖💖💖

There is so much good that can be done inside prison. Miles or anyone can turn their lives to helping others inside (or outside through letters . . . ) prison and find great fulfillment. Also, feeling good about taking responsibility for your behaviors, showing the victims true remorse by seeing how good it feels to the victims that you are no longer a threat by being behind bars and again making good with the time you do have shows genuine maturity and social responsibility.
