  • #SomeoneTheyKnew | When Kathryn Hauser was found brutally murdered in her Albuquerque home, friends and family immediately thought it was her estranged husband. But when DNA points elsewhere, jurors have to decide if this was a random act of violence or if the crime lab got it wrong?
    A weekend of home improvement turns to horror when Linda Yancey and day-laborer Marcial Cax-Puluc are shot in the Yancey basement. Derrick Yancey, a seventeen-year veteran of the Sheriff’s Department, had a tearful tale of self-defense. But a trail of evidence forces investigators to take a closer look at one of their own.

    My theory is that between the ex-husband and the homeless man, only one man had something to gain from Kathryn's death. Hubert not only got the life insurance but all Kathryn's assets as well. He exacted revenge on the abuse victim who stood up and left him. Top it off with this; she refused to "submit sexually" to him, so he ensured that she was humiliated and made to pay for that. He instructed the rape along with murder, and that's why he already knew it had happened before the cops revealed it.
    Busey, on the other hand, was a career BURGULAR, and he didn’t even steal anything!!! He had absolutely nothing to gain from Kathryn's death except the money Hubert Hauser offered him or whatever threats or promises were made.
    It’s a shame they couldn't dig deeper to find a connection between Busey and Hauser to prove conspiracy.
    A homeless, drug addicted man who has no pattern or history of violence; let alone rape and murder doesn’t randomly take a trip out of the city, into surburbia and commit his first murder at age 42. But it makes sense if he was acting at the behest of a disgruntled, controlling abuser.

More like a controlling creep that used religion as a vehicle for his own self righteousness. He struck me as a guy who didn't believe in divorce, ever. He didn't want her to leave because he needed the $$ support & had a lot to gain from her death. Just a nasty individual.

      I agree... I think Hubert Hauser paid this homeless man for his DNA and planted it. The man convicted did NOT have a history of violent crime... he only had drug and burglary charges. Why would this homeless man be randomly walking through a residential neighborhood at 7:15 am when many people are getting ready for work? Then he decides to rape and murder a woman for the first time in his life when there would be many people around leaving for work? Who robs houses in the daytime? He is a career criminal burglar and does NOT take anything from her home? Not to mention all of this happens the day before a divorce is going to be finalized? Hubert Hauser must be the luckiest man alive! His soon to be ex-wife is coincidentally and randomly murdered the day before their divorce leaving him with her $100,000 insurance policy, her 401K and all of her assets? Hubert Hauser also could not stop SMILING during the entire trial.

    I know its the defense attorney's job to fight for their client and to do everything they can to keep them out of prison. But... Shes an attorney, she's an intelligent woman. She *KNOWS* her client is guilty of murder. She *KNOWS* his DNA was on the victim and the victim's blood/DNA was on her client. She *KNOWS* there is only *ONE* explanation as to why that would be. So, for her to stand there and cry over him being convicted of murder (knowing it was the correct verdict) is absolutely ridiculous, and she only made an ass of herself.

      Hubert Hauser got away with murder. A transient, drug addict was convicted of the murder, but I sincerely believe that Hubert Hauser framed the man that was convicted by planting the man's DNA at the crime scene. Watching video of the court proceedings, Hubert Hauser did not even bother to hide his sly, smug smiles when he saw he was getting away with murder... he was smiling throughout the trial. After her murder, Hubert Hauser received an insurance payout of close to $100,000, her 401K, as well as all of her assets and Kathyrn Hauser was coincidentally murdered the day before she was set to go to court to finalize their divorce. Either Hubert Hauser is the luckiest man in the world, or he is a murderer. Your soon to be ex-wife is murdered THE DAY BEFORE your divorce, which would have nullified your insurance payout? How lucky for Hubert... perhaps that is why he could not stop smiling in court?
      The convicted individual in question was a known drug addict. Hubert Howard could have paid the man for his semen in exchange for drugs or money. Most homeless, drug addicts would agree to a deal like that. The evidence showed that the semen present was much less than would be present for an actual sexual assault or sexual act no matter how brief. And why would a homeless person be walking through a nice, residential neighborhood early in the morning at 07:15 am, at the EXACT moment Kathryn Hauser was leaving to go to work? The man convicted of the crime, Phillip James Busey, did have a long criminal record, but actually NONE of his previous crimes involved violence or rape. All of his previous crimes involved drug charges and burglaries. Why would he beat Kathyrn Hauser over the head with a brick, rape her and then proceed to take NOTHING from her home? I thought he was a burglar? Why didn't he steal anything that day? More importantly, why would he even have interacted with Kathyrn at all if he was just in the neighborhood to rob someone? Doesn't it make more sense if you see someone leaving to go to work, to just wait for her to leave and then enter her home? Also, who robs houses at 7:15 in the morning when A LOT of people will be getting ready to go to work?

    Since Busey was a transient and the husband uses his religious beliefs as shields, excuses and weapons, isn’t there a possibility that the husband obtained the DNA and planted? Could the husband have paid someone to have sex with him and collect seamen? Could Busey have found her with her head bashed in and then took her inside? Was there valuables missing? How long exactly from the screams until the cops arrived? That makes a difference. Most homeless folks I’ve seen aren’t in the best of health and couldn’t murder, strip, rape, burglarize, leave little evidence and make a clean getaway in even 10 minutes.

    • @FirstLadyG
      @FirstLadyG Рік тому +3

      Hmmm your analysis certainly invites further investigation. I thought about dna plantation too. This case does not sit right. Something is missing. Secondly how did the husband know about what happened to the wife. Was this homeless man monitoring her before he attacked? How did she became the target and not the other neighbours? Why that time?
      Finally the person convicted did not show any emotional reaction. No objection, did not cry, did not speak. Too calm in my opinion.
      Another thought....could it also be that being in prison is better than being on the streets? Since prison provides shelter. I once watched a documentary where people purposely offended to get back into prison. Mind you depends on what type of prison. If the husband had nothing to do with this case...I am always thanking God for DNA which has acquitted many innocent people.

Something is very wrong here. In any case, this man is spiritually unfit to be a husband and father. A Christian husband is supposed to emulate Christ, who is generous and loving to His Bride, the Church. He gave His life for the Church. So, a Christian husband must emulate that ideal.

But, do they think the fact that the victim's DNA/blood being found on the defendant's clothing, AND the defendant's DNA being found at the scene of the crime, would just be swept under the rug and ignored? DNA doesn't lie, it has no bias. There is absolutely NO innocent reason for her DNA being on him and his DNA being on her. The *ONLY* explanation is that he killed her.

      @helenmurphy36 Рік тому +7

      Regardless of all the evidence against him, that’s precisely what they’re supposed to do. The clue is in the burden of proof which is beyond a reasonable doubt. Once there is reasonable doubt (husband had motive, abusive history, threats to kill, the wife was leaving her husband the day she was murdered, his comments on sex/servitude in the relationship, his flustered appearance at work on the day of the murder) then the jury cannot find the defendant guilty. They must be satisfied that if he is guilty that it is beyond a reasonable doubt. A lot of the factors I’ve listed above could cause reasonable doubt. The defence did a very good job at trying to convince the jury there was cause for reasonable doubt, but they weren’t good enough.
